ORDINANCE NO. 2016- 052
AN ORDINANCE AMENDING CHAPTER 5.20, LIQUOR CONTROLS, OF THE
BUFFALO GROVE MUNICIPAL CODE
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois
Constitution of 1970; and
WHEREAS, a request has been made to the Village to allow the bringing of alcoholic
liquor into a premises that has a Village liquor license; commonly referred to as bring your own
bottle or BYOB.
NOW THEREFORE BE IT ORDAINIED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE
COUNTIES, ILLINOIS, as follows:
Section 1. The foregoing recitals are hereby adopted and incorporated into and made a
part of this Ordinance as if fully set forth herein.
Section 2. Section 5.20.105 of the Buffalo Grove Municipal Code is hereby amended to
read as follows:

5.20.10-5 Bring Your Own Bottle (RY0B)
A. Any person or entity with a Villa tcClass A, B.-E, F, G 1, G2, G3, G4, 65. G7, or
K liquor license under Section 5.20.070 may apply for a bring your Own bottle
("BYOB") License pursuant to this Section 5.20,105.
B. A BYOB license allows within the area s-Decificallv designated in the license as the

1. Patrons may only consume cornmercially manufactured beer as defined by 235
ILLS 511-3.04) or wine (as defined by 235 ILLS 511-3.03);
2. Any patron who brings alcohol under this license to tile premises for consumption
must give the alcoliol to a BASSET qualified employee of the licensee who shall
inspect the alcohol to ensure that it is commercially manufactured beer or wine
(as outlined above) and in its original, scaled container. The BASSET qualified
employee shall open the alcohol for the patrons at their table and patrons may not
open then-own alcoho I i c beverages until they are inspected as pro v i dcd herel 11:
3. Patrons will not be allowed to leave the premises with oven alcohol containers;
however. if a patron wishes to cork their wine bottle, the corking Must COMDIV
with 235 ILCS 51.6-33 and the licensee must place the bottle of wine in a securely
sealed. transparent one-time use tamper-proof baR-,
4. Any alcohol not consumed by the patron and not corked in accordance with
Subsection B. above shall be destroyed by the licensee,•
5. The annual fee for each license shall be one-hundred and fi fty dollars;

7. The licensee may charge a corking fee or comparable fee for uncorking or
opening bottles wider this license.
C. A BYOB licenses be automatically revoked I _Levokc if the licensee liquor license under
Section 5.20.070 is revoked.
D. The BYOB1iqUor licensee shall comply with all the provisions of Chapter 5.20 of the
Buffalo Grove Municipal Code.
E. A BYOB license shall only be effective for the hours of operation of the underlying
Village liquor license.
Section 3. If any section, paragraph, clause or provision of this Ordinance shall be held
invalid, the invalidity thereof shall not affect any other provision of this Ordinance.
Section 4. Any person violating any portion of this Ordinance shall be punished
according to the provisions of Section 5.20.260 of the Buffalo Grove Municipal Code.
Section 5. This Ordinance shall be in full force and effect from and after its passage,
approval and publication. This Ordinance may be published in pamphlet form.
