2016-08-15 - Ordinance 2016-041 - GRANTING PRELIMINARY PLAN APPROVAL AND PLAT OF SUBDIVISION WITH VARIATIONS TO ZONING - THERMFLO, 875 BUSCH PKWY August 3,2016 ORDINANCE NO. 2016-04I GRANTING PRELIMINARY PLAN APPROVAL AND A PLAT OF SUBDIVISION WITH VARIATIONS TO THE VILLAGE OF BUFFALO GROVE ZONING ORDINANCE Therm Flo Inc. 875 Busch Parkway, Buffalo Grove, |L WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois Constitution of197O; and, WHEREAS, the real property ("Property") hereinafter legally described in Exhibit is zoned in the | Industrial District and is commonly known as 875 Busch Parkway, Buffalo Grove, Illinois; and, WHEREAS, Therm Flo Inc., ("Petitioner") proposes to construct o new 4O,437 square foot warehouse/office facility and associated infrastructure and landscaping; and, WHEREAS, said site improvements require approval as a Preliminary Plan and Plat of Subdivision with variations pursuant to the Village Zoning Ordinance (Title 17 of the Buffalo Grove Municipal Code); and, WHEREAS, the Village Plan Commission conducted a public hearing on July 13, 2016 concerning the petition for Preliminary Plan and Plat of Subdivision with variations; and, WHEREAS, the Plan Commission determined that the petition meets the standards for a variation set forth in Section 17.52.O70ofthe Buffalo Grove Zoning Ordinance; and, WHEREAS, the Plan Commission voted 8 to O to recommend approval of the Preliminary Plan and Plat of Subdivision with variations; and, WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby determine and find that the standards for variation have been met, as set forth in Section 17.52.070 of the Village of Buffalo Grove Zoning Ordinance, in that the Petitioner has shown: (1) The property in question cannot yield e reasonable return if permitted to be used only under the conditions allowed by the regulations of the zoning district in which it is located except in the case of residential zoning districts, (2)The plight of the owner is due to unique circumstances, and (3) The proposed variation will not alter the essential character of the neighborhood WHEREAS, the proposed industrial building sha|l be constructed in accordance with and pursuant to the following exhibits: EXHIBIT Legal Description 2 EXHIBIT Preliminary Plan Set, including site plan, landscaping plan, preliminary engineering and elevations NOW,THEREFORE, 0E |T ORDAINED BY THE PRESIDENT AND BOARD []F TRUSTEES C)FTHE VILLAGE C)F BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: Section 1. This Ordinance is made pursuant to and in accordance with the Village's Zoning Ordinance and the Village's Horne Rule powers. The preceding whereas clauses are hereby made a part of this Ordinance. Section 2. The Corporate Authorities hereby grant approval of the Preliminary Plan and Plat of Subdivision with the hm||mvving variations to Sections 17.36.030 of the Village of Buffalo Grove Zoning Ordinance to allow for an industrial building subject to the following conditions: I. The proposed development shall be developed in substantial conformance to the plans attached as part of the petition. The final engineering plans and landscape plan shall be revised to reflect the most recent site plan dated July 5, 2016. 2. Final engineering shall be reviewed and approved by the Village Engineer. 3. The plat of subdivision shall he revised in a manner acceptable 10 the Village Attorney, acknowledging that Therm Ho Inc. shall be responsible for the repair and restoration of the vvatermnain easement area.
