2015-05-18 - Ordinance 2015-032 - APPROVING THE FIRST AMENDMENT OF THE ANNEXATION AGREEMENT FOR PRAIRIE HOUSE RESTAURANT - 2710 MAIN ST I1111{lfll III INI1111 Ii 1{111N 1{lillll I{11 I{1{ ilN{II{11111111 Imaged 054302320015 Type: ORD Recorded: 08/26/2015 at 09:27:59 AM Recelpt#: 2015-00051829 Pane I Of 15 Fees: $36.00 IL Rental Housing Fund: $0.00 5 11 15 Lake County IL Recorder Mary Ellen vanderventer Recorder File7225107 ORDINANCE NO. 2015-32 AN ORDINANCE APPROVING THE FIRST AMENDMENT OF THE ANNEXATION AGREEMENT FOR PRAIRIE HOUSE RESTAURANT 2710 Main Street, Buffalo Grove, Illinois WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois Constitution of 1970; and, WHEREAS, the Village entered into an Annexation Agreement approved July 21, 2009 with Prairie House Realty, LLC which was approved by Village Ordinance No. 2009-41 for the real property ("Property") legally described in EXHIBIT A hereto; and, WHEREAS, Owner is the owner of a certain tract of property (hereinafter referred to as the "Property") comprising 0.27 acres legally described and identified in the Legal Description, attached hereto as EXHIBIT A and made a part hereof, known as 2710 Main Street; and, WHEREAS, Owner has requested Preliminary Plan approval and a variation of the onsite parking requirements to construct a building addition incorporating a retractable cover over the area currently used as a deck and an outdoor dining area; and, WHEREAS, the Village Board has determined that it is in the best interest of the Village of Buffalo Grove to approve the First Amendment of the Annexation Agreement and variation of the Village Zoning Ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: Section 1. This ordinance is made pursuant to and in accordance with the Village's Zoning Ordinance, Development Ordinance and the Village's Home Rule powers. The preceding Whereas clauses are incorporated herein. 2 Section 2. The First Amendment of the Annexation Agreement dated May 18, 2015, a copy of which is attached hereto and made a part hereof as EXHIBIT B, is approved. Section 3. The President and Clerk of the Village are hereby authorized to execute said Agreement on behalf of the Village of Buffalo Grove. Section 4. This Ordinance shall be in full force and effect from and after its passage and approval. This Ordinance shall not be codified.
