ORDINANCE NO. 2015-32
AN ORDINANCE APPROVING THE
FIRST AMENDMENT OF THE ANNEXATION AGREEMENT
FOR
PRAIRIE HOUSE RESTAURANT
2710 Main Street, Buffalo Grove, Illinois
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois
Constitution of 1970; and,
WHEREAS, the Village entered into an Annexation Agreement approved July 21, 2009
with Prairie House Realty, LLC which was approved by Village Ordinance No. 2009-41 for the
real property ("Property") legally described in EXHIBIT A hereto; and,
WHEREAS, Owner is the owner of a certain tract of property (hereinafter referred to as
the "Property") comprising 0.27 acres legally described and identified in the Legal Description,
attached hereto as EXHIBIT A and made a part hereof, known as 2710 Main Street; and,
WHEREAS, Owner has requested Preliminary Plan approval and a variation of the onsite
parking requirements to construct a building addition incorporating a retractable cover over the
area currently used as a deck and an outdoor dining area; and,
WHEREAS, the Village Board has determined that it is in the best interest of the Village
of Buffalo Grove to approve the First Amendment of the Annexation Agreement and variation
of the Village Zoning Ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS:
Section 1. This ordinance is made pursuant to and in accordance with the Village's
Zoning Ordinance, Development Ordinance and the Village's Home Rule powers. The preceding

Section 2. The First Amendment of the Annexation Agreement dated May 18, 2015,
a copy of which is attached hereto and made a part hereof as EXHIBIT B, is approved.
Section 3. The President and Clerk of the Village are hereby authorized to execute said
Agreement on behalf of the Village of Buffalo Grove.
Section 4. This Ordinance shall be in full force and effect from and after its passage and
approval. This Ordinance shall not be codified.

VILLAGE OF BUFFALO GROVE
COOK AND LAKE COUNTIES, ILLINOIS
This agreement is made and entered into as of this 18" day of May 2015 by and between the
Village of Buffalo Grove (hereinafter referred to as "Village") by and through the President and
Board of Trustees of the Village(hereinafter collectively referred to as the"Corporate Authorities")
and Prairie House Realty, LLC (hereinafter referred to as "Owner").
WITNESSETH:
WHEREAS,the Village of Buffalo Grove is a Home Rule Unit by virtue of the provisions of
the Constitution oft e State of Illinois of 1970; and,
WHEREAS,the Village entered into an Annexation Agreement approved July 21,2009 with
Prairie House Realty, LLC which was approved by Village Ordinance No. 2009-41 forte real
property("Property") legally described in EXHIBIT A hereto; and,
WHEREAS, Owner is the owner of a certain tract of property(hereinafter referred to as the
"Property")comprising 0.27 acres legally described and identified in the Legal Description,attached
hereto as EXHIBIT A and made a part hereof, known as 2710 Main Street, and,
WHEREAS, Owner has requested Preliminary Plan approval and a variation of the onsite

made a part hereof, and,
WHEREAS, pursuant to the provisions of Section 5111-15.1-1 et seq., of the Illinois
Municipal Code (65 ILCS 5111-15.1-1 et seq.) and as the same may have been modified by the

Village's Home Rule Powers, a proposed amendment to the Annexation Agreement consisting of a
Preliminary Plan and a parking variation request was submitted t o t he Corporate Authorities and a
public hearing was held thereon pursuant to notice as provided by Statute; and,
WHEREAS,pursuant to due notice and advertisement,the Planning&Zoning Commission
has held a public hearing and made its recommendations with respect to the requested parking
variance; and,
WHEREAS, the President and Board of Trustees after due and careful consideration have
concluded that t e a mendment to the annexation agreement approving the preliminary plan and
parking variation request for the Property would serve the best interests oft e Village; and,
WHEREAS,the following EXHIBITS,some of is were presented in testimony given by
the Owner or the witnesses during the hearings held before the Planning&Zoning Commission prior
to the execution of this Agreement, are hereby incorporated by reference herein,made a part hereof
and designated as shown below.

NOW, THEREFORE, in consideration of the premises, mutual covenants and agreements
herein set forth, the parties hereto agree as follows:
1. The preceding Whereas clauses are incorporated herein.
2. That certain Annexation Agreement dated July 21,2009 approved by Ordinance No.
2009-41 is hereby amended to allow the construction on the Property of an addition
to the rear of the building as depicted in EXHIBIT B and EXHIBIT C.
3. A variation of Section 17.36.040 of the Buffalo Grove Municipal Code is hereby
granted.

instrument to be executed by their respective proper of duly authorized to execute the same
