2015-08-03 - Ordinance 2015-038 - GRANTING VARIATIONS FROM SIGN CODE FOR ST MARY SCHOOL, 50 BUFFALO GROVE RD 7/17/2015 ORDINANCE NO. 2015 - 38 GRANTING VARIATIONS FROM CERTAIN SECTIONS OF THE BUFFALO GROVE SIGN CODE St. Mary School, 50 Buffalo Grove Road WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS, the real property ("Property") hereinafter legally described is zoned in the RI Residential District — Special Use and is commonly known as St. Mary School, 50 Buffalo Grove Road, Buffalo Grove, Illinois; and WHEREAS, request is being made by St. Mary School, 50 Buffalo Grove Road, for variations to Section 14.16.010 and Section 14.16.070 of the Village Sign Code (Title 14 of the Buffalo Grove Municipal Code) for the purpose of installing more than one (1) wall sign on the south elevation of the building facing Lake Cook Road with the total area of the all signs combined exceeding the maximum allowable area of sixteen (16) square feet at 50 Buffalo Grove building; and WHEREAS, the Planning& Zoning Commission held a public hearing at which it received testimony on the requested variations; and WHEREAS, the Planning& Zoning Commission made certain findings of fact, made a positive recommendation forte variations, and prepared minutes of the public hearing; and WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby determine and find that the requested sign variations are in harmony with the general purpose and intent of the Sign Code (Title 14 of the Buffalo Grove Municipal Code) , and that (1) the requirements oft e Sign Code would cause undue and unnecessary hardship to the sign user due to unique or unusual conditions pertaining to the property, (2) the granting oft e requested variances will not be materially detrimental to the property owners in the vicinity, (3) the unusual conditions applying to the specific property do not apply generally to other properties in the Village, and (4) the granting of the variances will not be contrary to the general objectives oft e 1 Sign Code of moderating the size, number and obtrusive placement of signs and the reduction of clutter. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows: .Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate Authorities and made a part hereof. Section 2. Variations are hereby granted to Section 14.16.010 and 14.16,070 of the Village Sign Code (Title 14 of the Buffalo Grove Municipal Code) for the purpose of installing more than one (1) wall sign on the south elevation oft e building facing Lake Cook Road with the total area of the wall signs combined exceeding the maximum allowable area of sixteen (16) square feet at 50 Buffalo Grove Road, legally described as follows: Parcel B: Commencing at the southwest comer of said southwest quarter of Section 33, Township 43 north, Range 11, east of the Third Principal Meridian, thence north 56 degrees east, 784.74 feet to the center of McHenry Road; thence south 34 degrees east along center of said McHenry Road, 129.36 feet-, thence south 56 degrees west, 583.44 feet tote south line of Section 33, Township 43 north, Range 11, east of the Third Principal Meridian; thence west on the south line of said Section 33, 227.58 feet to the place of beginning, in lake County, Illinois (except therefrom that part taken for roadway purposes). Parcel C: Commencing on the south line of said Section 33, Township 43 north, Range 11, east of the it Principal Meridian, at a point 227.58 feet east of the southwest comer of said Section 33; thence east on said Section line 325.05 feet; thence north 66 degrees 35 minutes east, 321.76 feet to the center of McHenry Road; thence north 34 degrees west along center of McHenry Road, 242.20 feet; thence south 56 degrees west 583.44 feet, to the place of beginning, in Lake County, Illinois (except therefrom that part taken for roadway purposes). Parcel G: A parcel of land in the northwest quarter oft e northwest quarter of Section 4, Township 42 north, Range 11, east of the it Principal Meridian, in Cook County, Illinois and in the southwest quarter oft e southwest quarter of Section 33, Township 43 north, Range 11, cast of the Third Principal Meridian, in Lake County, Illinois, described as follows: (in the following courses the west line of Section 4 is assumed as "due north & South") Beginning at a point in the west line of said Section 4, 260.04 feet south of the northwest comer thereof-, thence north 65 degrees 51 minutes east a distance of 955.35 feet tote center line of Buffalo Grove Road- thence south 34 degrees 26 minutes east along said center line, a distance of 83.21 feet to a point which is 9.65 feet southeasterly of the northeasterly comer of a tract conveyed to John Kline by Warranty Deed recorded 2 June 21, 1899 as Document No. 2836175; thence south 66 degrees 04 minutes west parallel to the northwesterly line of said tract, 282 feet to the southwesterly line of said tract; thence south 34 degrees 26 minutes east along said line, 237.70 feet to a point 9.65 feet northwesterly of southwesterly comer of said tract; thence south 64 degrees 53 minutes 30 seconds west, a distance of 878.45 feet to a point in the west line of said Section 4, said point being 621 feet south of northwest comer thereof-, thence north along said line, 36096 feet, to the place of beginning (except therefrom that part taken for roadway purposes). Section 3. The variations are subject to the following condition: A. The sign is to be installed pursuant to Attachment"5" of Exhibit"2" submitted into evidence by the Planning & Zoning Commission at the public hearing held July 15, 2015. Section 4. This Ordinance shall be in full force and effect from and after its passage, and approval. This Ordinance shall not be codified.
