2015-07-06 - Ordinance 2015-036 - GRANTING VARIATIONS FROM SIGN CODE FOR COOPER MIDDLE SCHOOL, 1050 PLUM GROVE CIRCLE 6/29/2015 ORDINANCE NO. 2015 - 36 GRANTING VARIATIONS FROM CERTAIN SECTIONS OF THE BUFFALO GROVE SIGN CODE Cooper Middle School, 1050 Plum Grove Circle, Buffalo Grove WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS, the real property ("Property") hereinafter legally described is zoned in the R-5 Residential District and is commonly known as Cooper Middle School, 1050 Plum Grove Circle, Buffalo Grove, Illinois; and, WHEREAS, request is being made by Michael Sauer, on behalf of Community Consolidated School District 21/James Fenimore Cooper Middle School, for variations to Section 14.16.010 of the Village Sign Code (Title 14 of the Buffalo Grove Municipal Code) to exceed sixteen (16) square feet in area, to exceed five (5) feet in height, to not place the sign flat against the building, and to allow the sign to be located within the required building setback area for the purpose of relocating and replacing the ground sign that is currently located along Arlington Heights Road to an area further south on the parcel to improve visibility, and; WHEREAS, the Planning& Zoning Commission held a public hearing at which it received testimony on the requested variations; and WHEREAS, the Planning& Zoning Commission made certain findings of fact, made a positive recommendation for the variations, and prepared minutes of the public hearing; and WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby determine and find that the requested sign variations are in harmony with the general purpose and intent of the Sign Code (Title 14 of the Buffalo Grove Municipal Code) , and that (1) the requirements of the Sign Code would cause undue and unnecessary hardship to the sign user due to the following unique or unusual conditions pertaining to the property in that the current location of the ground sign set so far to the north of the entrance to the school off of Plum Grove Circle, has caused the current ground sign to be ineffectual in identifying the entrance to passing motorists looking for the site; and the chain link fencing that is installed along Arlington Heights Road effectively blocks the visibility of a smaller sign, (2) the granting of the requested variances will not be materially detrimental to the property owners in the vicinity, (3) the unusual conditions applying to the specific property do not apply generally to other properties in the Village, and (4) the granting of the variances will not be contrary to the general objectives of the Sign Code of moderating the size, number and obtrusive placement of signs and the reduction of clutter. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OFT E VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows: .Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate Authorities and made a part hereof. Section 2. Variations are hereby granted to Section 14.16.060 of the Village Sign Code (Title 14 of the Buffalo Grove Municipal Code) for the purpose of relocating and replacing the ground sign that is currently located along Arlington Heights Road to an area further south on the parcel legally described as follows: SUBJECT PROPERTY LEGAL DESCRIPTION: The south 300.00 feet of Lot "C" together with the north 114.00 feet of the south 414.00 feet of the east 450.00 feet of Lot "C" in Strathmore in Buffalo Grove, Unit 1, being a re-subdivision certain lots and vacated streets in Arlington Hills in Buffalo Grove, being a subdivision in Sections 5 and 6 and of sundry tracts of land in the west half of said Section 5 all in Township 42 north, Range 11, cast of the Third Principal Meridian, in Cook County, Illinois. SUBJECT PROPERTY COMMON DESCRIPTION: James Fenimore Cooper Jr. High School 1050 West Plum Grove Road, Buffalo Grove, IL 60089 Section 3. The variations are subject to the following conditions: A. The sign is to be installed pursuant to the plans attached hereto as Exhibit A. B. The sign shall not be illuminated between the hours of 10:00 p.m. and 6:00a.m. C. The sign shall be setback a minimum of fifteen (15) feet from the west property line and thirty(30) feet from south property line. Section 4. This Ordinance shall be in full force and effect from and after its passage, and approval. This Ordinance shall not be codified.
