2015-05-18 - Ordinance 2015-033 - GRANTING A VARIATION TO SECTION 17.36.040 OF THE ZONING ORDINANCE - 2710 MAIN ST ORDINANCE NO. 2015 - 33 GRANTING A VARIATION TO SECTION 17.36.040 OF THE VILLAGE OF BUFFALO GROVE ZONING ORDINANCE Prairie House Restaurant- 2710 Main Street, Buffalo Grove, IL WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS, the real property ("Property") hereinafter legally described is zoned in the B-3 Planned Business Center District and is commonly known as The Prairie House Restaurant, 2710 Main Street, Buffalo Grove, Illinois; and, WHEREAS, request is being made by Gary Gilliam, on behalf of on Hansen from Prairie House Realty, LLC, 2710 Main Street, for a variation to 17.36.040 of the Village of Buffalo Grove Zoning Ordinance to allow an expansion of the building without increasing the current number of on-site parking spaces and; WHEREAS, the Planning & Zoning Commission held a public hearing at which it received testimony on the requested variation; and WHEREAS, the Planning & Zoning Commission made certain findings of fact, made a positive recommendation for the variation; and, WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby determine and find that the standards for variation have been met, as set forth in Section 17.52.070 of the Village of Buffalo Grove Zoning Ordinance, in that the Petitioner has shown: (1) The property in question cannot yield a reasonable return if permitted to be used only under the conditions allowed by the regulations of the zoning district in which it is located except in the case of residential zoning districts, (2) The plight of the owner is due to unique circumstances, and (3) The proposed variation will not alter the essential character of the neighborhood. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES O F T HE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows: Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate Authorities and made a part hereof. Section 2. Variation is hereby granted to Section 17.36.040 of the Village of Buffalo Grove Zoning Ordinance to allow an expansion of the building without increasing the current number of on-site parking spaces located at 2710 Main Street, legally described as follows: 1 That part of Lot 33 of the School Trustee's Subdivision of Section 16, Township 43 North, Range 11 East of the Third Principal Meridian, described as follows: Beginning on the westerly line of the Minneapolis, St. Paul and Sault Ste. Marie Railway Company Depot Grounds, 280.8 feet, measured on the westerly line of said Depot Grounds, southeasterly from a brick and stone comer located at the northeast comer of said Depot Grounds; thence west 102 feet; thence south 100 feet; thence east 141 feet to the westerly line of said Depot Grounds; thence northwesterly along said westerly line of said Depot Grounds, 108 feet to the point of beginning, including any adjacent unincorporated highway, all in Lake County, Illinois. Section 3. This Ordinance shall be in full force and effect from and after its passage, and approval. This Ordinance shall not be codified.
