2014-11-03 - Ordinance 2014-073 - APPROVING A SPECIAL USE FOR PRAIRIE KRAFTS AT 1310 BUSCH PKWY10/28/2014 ••0 1 ,..•• r 11 RIFCt VILLAGE OF ,, • GROVE, COOK AND LAKE COUNTIES, ILLINOIS Prairie Krafts Inc. 1310 Busch Parkway The Corporate Grove Business Park WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois Constitution of 1970; and, WHEREAS, the real property legally described in Exhibit A ( "Property ") attached hereto is zoned in the Industrial District; and, WHEREAS, C.G.A. Investments Co., LLC c/o Van Vlissingen and Company is the owner of the Property; and, WHEREAS, Prairie Krafts Inc., as lessee of the Property, proposes to occupy a space of 3,338 square feet known as 1310 Busch Parkway to operate a brewery, including accessory retail sales of products brewed on the premises and food items; and, WHEREAS, Prairie Krafts Inc., an Illinois corporation, intends to file an application with the Illinois Secretary of State for an assumed name of "Prairie Krafts Brewing Company "; and, WHEREAS, said retail use requires approval as a special use in the Industrial District pursuant to Section 17.48.020.C.14 of the Village Zoning Ordinance; and, WHEREAS, Prairie Krafts Inc. has petitioned for approval of a special use for an accessory retail sales area; and, WHEREAS, Prairie Krafts Inc. has requested a variation of Section 17.48.020.C.14 of the Village Zoning Ordinance to allow an accessory retail area of 600 square feet, exceeding the allowed area of 167 square feet (5 percent of the floor area of the business); and, WHEREAS, the proposed retail use would be developed and operated in accordance with and pursuant to the following exhibits: 2 EXHIBIT A Legal Description EXHIBIT B Petitioner acceptance and agreement concerning special use EXHIBIT C Project description and parking information EXHIBIT D Overall site plan of Property EXHIBIT E Floor plan of lease space WHEREAS, the notice of the public hearing concerning the petition for a special use was given, and the public hearing was held by the Buffalo Grove Planning & Zoning Commission; and, WHEREAS, the Planning & Zoning Commission voted 5 to 0 recommend approval of the special use, including findings of fact that the proposed accessory retail area meets the criteria for a special use set forth in Section 17.28.040 of the Village Zoning Ordinance, and approval of a variation of Section 17.48.020.C.14 of the Village Zoning Ordinance to allow said retail area to be 600 square feet; and, WHEREAS, the President and Board of Trustees after due and careful consideration have concluded that development of the Property as proposed would be compatible with adjacent properties. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: Section 1. This ordinance is made pursuant to and in accordance with the Village's Zoning Ordinance, Development Ordinance and the Village's Home Rule powers. The preceding whereas clauses are hereby made a part of this Ordinance. Section 2. The Corporate Authorities hereby adopt a proper, valid and binding ordinance approving a special use for an accessory retail use, including a variation of Section 17.48.020.0.14 of the Village Zoning Ordinance to allow said retail area to be 600 square feet, pursuant to Exhibits C, D and E attached hereto for the Property legally described in Exhibit A attached hereto, subject to the following conditions: A. The special use is granted to Prairie Krafts Inc. and does not run with the land. 91 B. The special use granted to Prairie Krafts Inc. is assignable to subsequent petitioners seeking assignment of this special use as follows: 1. Upon application of a petitioner seeking assignment of this special use, the Corporate Authorities, in their sole discretion, may refer said application for assignment to the appropriate commission(s) for a public hearing or may hold a public hearing at the Village Board. 2. Such assignment shall be valid only upon the adoption of a proper, valid and binding ordinance by the Corporate Authorities granting said assignment, which may be granted or denied for any reason. C. Prairie Krafts Inc. shall submit the executed Petitioner's Acceptance and Agreement attached hereto and incorporated herein as Exhibit B. D. Prairie Krafts Inc. shall obtain a Class K liquor license pursuant to Section 5.20.070 of the Village of Buffalo Grove Municipal Code prior to selling any liquor products on the premises. Section 3. This Ordinance shall be in full force and effect upon the submittal of the Petitioner's Acceptance and Agreement as set forth in Section 2.C. of this Ordinance. This Ordinance shall not be codified.
