1999-09712/1/99 � J ORDINANCE NO. 99 -97 AN ORDINANCE APPROVING A SPECIAL USE IN THE INDUSTRIAL DISTRICT, VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS Areawide Cellular Retail Facility 1615 -1619 Barclay Boulevard Rogers Center for Commerce -East WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois Constitution of 1970; and, WHEREAS, the real property legally described in EXHIBIT A ( "Property ") attached hereto is zoned in the Industrial District; and, WHEREAS, Arthur J. Rogers and Co. is the Owner of the Property; and, WHEREAS, Areawide Cellular, Inc., together with its subsidiary Areawide Cellular, L.L.C., as tenant of the Property has petitioned the Village for approval of a Special Use in. the Industrial District for a retail sales facility, and; WHEREAS, Areawide Cellular occupies a lease space of approximately 9,400 square feet within a building on the Property and proposes to establish a retail sales area and showroom of approximately 264 square feet within said lease space to sell phones and related communications items pursuant to the following exhibits: EXHIBIT A Legal Description EXHIBIT B Letter dated October 26, 1999 from Darryl P. Jacobs, General Counsel, Areawide Cellular H 2 L;] EXHIBIT C Overall layout of the Rogers Center for Commerce -East EXHIBIT D Floor Plan of Areawide Cellular facility, 1615 -1619 Barclay Boulevard WHEREAS, notice of the public hearing concerning the petition for approval of the Special Use was given and the public hearing was held by the Buffalo Grove Plan Commission; and, WHEREAS, the Plan Commission determined that the criteria for a Special Use as set forth in Section 17.28.040 of the Village's Zoning Ordinance, including the requested variation concerning the sale of items not manufactured on the premises, have been met and development of the Property as proposed would be compatible with adjacent properties; and, WHEREAS, the President and Board of Trustees after due and careful considera- tion have concluded that the development of the Property on the terms and conditions herein set forth would enable the Village to control development of the area and would serve the best interests of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: Section 1. This ordinance is made pursuant to and in accordance with the Village's Zoning Ordinance, Development Ordinance and the Village's Home Rule powers. The preceding whereas clauses are hereby made a part of this Ordinance. Section 2. The Corporate Authorities hereby adopt a proper, valid and binding ordinance approving a Special Use for the retail sales facility pursuant to EXHIBITS B, C, and D for the Property legally described in EXHIBIT A attached hereto. Section 3. The Special Use is subject to the following conditions: A. A variation of Section 17.48.020.C.14.a. of the Zoning Ordinance is hereby granted allowing phones and other communications equipment and accessories not manufactured on the premises to be sold in the retail operation. B. Any changes or amendments to the Special Use and exhibits approved herein are subject to Village approval, and the Village will determine if additional public hearings are H E41# 3 necessary for proposed changes or amendments. Section 4. This Ordinance shall be in full force and effect on and after its passage and approval. This Ordinance shall not be codified. Areawide presently operates 30 retail stores and has a corporate direct sales force of five (5). Areawide is the largest independent specialty retailer of cellular and wireless products, services and accessories in the Chicago metropolitan area. Areawide's stores, which are located predominantly in shopping centers or near major shopping areas, seek to offer one- C stop shopping for consumers seeking to purchase cellular, paging, and other wireless products and services and related accessories. Areawide also performs cellular telephone and anti -theft vehicle deterrent installations at our mobile installation bays located at 20 of the 30 locations. Of the 9400 square feet, approximately 6000 feet will be used for offices, 2000 will be used for our distribution facility and 1000 will be used for our technical and service facility. In addition, as an adjunct to our service facility, we are planning to set aside 264 square feet for a small retail showroom. Although retail will not be a primary activity at our corporate headquarters, customers bringing cellular phones or pagers often desire to purchase accessories or to upgrade their existing phones or pagers. By having a small showroom as an adjunct to our service facility, we will be able to service these customers without sending them to our primary retail locations. Consequently, we are requesting a special use permit to allow us to maintain the small showroom and to allow for the adjunct retail sales. AREAWIDE CELLULAR® Approximately 25 employees will be located at our corporate headquarters with approximately 18 office personnel and seven warehouse and service technical personnel. There will be no retail employees. Rather, certain of the office and service technical employees will assist customers. Areawide Cellular is proposing to use a 264 - square foot portion of its lease space for retail sales of phones and related items. Retail activity of the proposed size is an accessory use in the Industrial District, and a special use is required. The proposed area of 264 square feet complies with the Zoning Ordinance standard limiting the amount of retail space to the lesser of 1,000 square feet or 5 percent of the building floor area. The zoning standards also require that products sold in the retail operation are to be manufactured on the premises. Areawide is requesting a variation to sell phones and other items that are not manufactured at the property. The Plan Commission held a public hearing on November 10, 1999 and voted 8 to 0 to recommend approval of the special use. The draft minutes of the Plan Commission meeting are not yet available, but there was no public testimony at the public hearing other than the presentation by the petitioner. Notice of the public hearing was published in the Daily Herald on Thursday, October 28, 1999. Mr. Leider explained that the property was annexed to Buffalo Grove about 15 years ago in order to have Buffalo Grove water. The property is surrounded by Lake County and the area is unpopulated, Mr. Leider said the existing sign is parallel to Aptakisic Road and cannot be seen by passing traffic unless cars are right in front of the property. The proposed sign will be perpendicular to Aptakisic and the changeable copy will permit promotion of seasonal products. The sign will have a clear lexan cover that prevents the letters from blowing off and it will be is internally illuminated. The background will be black with white letters and green The sign will have extensive landscaping around the base The total height of the sign will be 11'2" and will be installed on a 2 -1/2 foot berm. The height will give better exposure to drivers traveling along Aptakisic Road. The Commissioners had no objections. There were no comments from the audience. Com. Teplinsky made the following motion: I move we recommend to the Village Board, that the request made by The Leider Horticultural Companies, Ins. d.b.a. Leider Greenhouses and Prairie View Gardens, 855 E. Aptakisic Road, for variation of Sign Code, Section 14.40.020, that would permit replacement of the existing Leider Greenhouses and Garden Center ground sign with a changeable copy ground sign, be granted. Sign to be constructed in accordance with plans submitted with the request. Sign is recommended pursuant to Sign Code, Section 14.44.010, Sub - section A. Com. Windecker seconded the motion.
