1999-007ORDINANCE NO. 99 -7 GRANTING A VARIANCE FROM SECTIONS 14.20.030 and 14.20.080 OF THE BUFFALO GROVE SIGN ORDINANCE WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS, AMERICAN STORES PROPERTIES, 348 E. South Temple, Salt Lake City, Utah, Owner of the hereinafter legally described real property commonly known as 1202 Dundee Road, Buffalo Grove, Illinois, has requested a variation from Sections 14.20.030 and 14.20.080 for the purpose of installing additional wall signs on the east and south elevations of the building located at the Strathmore Square shopping center; and WHEREAS, the Zoning Board of Appeals has held a public hearing, received testimony, prepared minutes, made certain findings, and has made an affirmative recommendation on said request for variations; and WHEREAS, the Corporate .Authoritie-- of the Village of Buffalo Grove hereby determine and find that said variations are in harmony with the general purpose and intent of the Sign Ordi- nance, and that (1) the ordinance in question would cause undue and unnecessary hardship to the sign user because of unique or unusual conditions pertaining to the property, (2) the granting of the requested variances will not be materially detrimental to the property owners in the vicinity, (3) the unusual conditions applying to the specific property do not apply generally to other properties in the Village, and (4) the granting of the variances will not be contrary to the general objective of this title of moderating the size, number and obtrusive placement of signs and the reduction of clutter. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows: Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate Authorities. Section-2. Variations are hereby granted to Sections 14.20.030 and 14.20.080 of the Village Sign Ordinance to the property legally described as follows: The east 22 acres of the south 60 acres of the south half of the southeast quarter of Section 6, Township 42 North, Range 11, East of the Third Principal Meridian. Except the north 470 feet as measured on the east and west lines thereof, except the west 200 feet as measured on the south line thereof of that part lying south of the north 470 feet as aforesaid, and except the east 80 feet of the west 280 feet of the south 225 feet as measured on the south and west lines thereof, and except the south 170 feet of the east 233 feet as measured on the east and south lines thereof, except the south 50 feet lying east of the west 280 feet and lying west of the east 233 feet thereof, and except the east 50 feet lying south of the north 470 feet and lying north of the south 170 feet thereof, (except that part taken for widening Arlington Heights Road), in Cook County, Illinois. The specific variations are: 1. East Elevation: Wall signs will be permitted with the letters "RX" to be 32" letters and "Drive -Thru" to be 15" letters, 2. East Elevation: Only a wall sign for "Osco Drug" will be permitted facing Arlington Heights Road, and 3. South Elevation: Wall signs for "Osco Drug" and "Food Mart" (but not 1 Hr. Photo "), will be permitted. Section 3. These variances are subject to the condition that the petitioner install eight (8') foot fencing above grade, to shield the neighbors from car lights from the Drive -Thru lane. Irz r � i Section 4.
