1999-0688/16/99 o • ORDINANCE NO. 99 -68 AN ORDINANCE APPROVING AN AMENDMENT TO THE PRELIMINARY PLAN VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS Commonwealth Edison Company Aptakisic Road Sub - station, TSS 109 South of Aptakisic Road, east of Buffalo Grove Road WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois Constitution of 1970; and, WHEREAS, the Commonwealth Edison Company (hereinafter referred to as "Owner "), is the Owner of the 27.67 -acre property (hereinafter referred to as the "Property ") described in EXHIBIT A attached hereto, which exhibit is made a part hereof, and which real estate is within the corporate limits of the Village; and, WHEREAS, the Property is zoned in the R -1 One - family Dwelling District with a Special Use for a public utility facility, pursuant to the annexation agreement dated October 3, 1988 approved by Ordinance 88 -90; and, WHEREAS, said annexation agreement included Exhibit D, Preliminary Plan, depicting existing and future improvements to the utility facility and in Section 23.A. of said agreement provisions are made to allow Owner to replace or add equipment within the existing fenced yard as a minor change to the Special Use 2 authorization; and, WHEREAS, Owner requests approval of a minor change to the Preliminary Plan to add an equipment enclosure and transformer unit and to modify the location of the existing fence on the west side of the fenced yard pursuant to the following exhibits: EXHIBIT A Legal Description EXHIBIT B Letter dated July 30, 1999 from Ron Crawford, Public Affairs Director EXHIBIT C Preliminary Plan (Plot Plan) dated as last revised July 27, 1999 by Commonwealth Edison Company EXHIBIT D Landscaping Plan dated July 27, 1999 by Commonwealth Edison Company WHEREAS, the President and Village Board of Trustees after due and careful consideration have concluded that the development of the Property on the terms and conditions herein set forth would enable the Village to control development of the area and would serve the best interests of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: Section 1. This Ordinance is made pursuant to and in accordance with the Village's Zoning Ordinance, Development Ordinance, and the Village's Home Rule powers. The preceding whereas clauses are hereby made a part of this Ordinance. Section 2. The Corporate Authorities hereby adopt a proper, valid and binding ordinance approving the amended Preliminary Plan (EXHIBIT C) attached hereto, subject to the following conditions: m • 3 A. Modifications to the height and type of fencing is subject to review and approval by the Village Zoning Board of Appeals. B. Owner shall maintain the existing trees along the west and south sides of the Property. C. Owner shall provide plans and elevations for the proposed equipment enclosure and plans for site improvements for Village review and approval. D. Owner shall remove any existing structures and equipment on the Property that is no longer in use in accordance with a schedule approved by the Village. E. Owner shall revise the attached Landscaping Plan dated July 27, 1999 (EXHIBIT D) attached hereto to provide additional landscape screening adjacent to the north side of the fenced area on the Property. Said revised Landscaping Plan is subject to review and approval by the Village Forester. Section 3. This Ordinance shall be in full force and effect on and after its passage and approval. This Ordinance shall not be codified.
