1999-0650 0 ORDINANCE NO. 99- 65 GRANTING A VARIATION FROM SECTION 17.44.060.E.6 OF THE BUFFALO GROVE ZONING ORDINANCE Walgreen's 15 North Buffalo Grove Road WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS, the Petitioner, Walgreen's, has requested a variation of the hereinafter legally described real property, commonly known as 15 North Buffalo Grove Road, Buffalo Grove, Illinois, from section 17.44.060.E.6 of the Buffalo Grove Zoning Ordinance for the purpose of installing various signs; and WHEREAS, the Zoning Board of Appeals has held a public hearing, received testimony, prepared minutes, made certain findings, and has made an affirmative recommendation on said request for variation; and WHEREAS,the Corporate Authorities of the Village of Buffalo Grove hereby determine and find that said variations are in harmony with the general purpose and intent of the Zoning Ordinance, and 1) not allowing the variances will cause undue and unnecessary hardship due to the Petitioner, 2) granting the requested variances would not be detrimental to the property owners in the vicinity, 3) unusual conditions apply to specific property that do not apply generally to other properties in the Village, and 4) granting the variances will not be contrary to the general objective of the Sign Code of moderating the size, number and obtrusive placement of signs and the reduction of clutter. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows: SECTION 1. The preceding WHEREAS clauses are hereby adopted by the Corporate Authorities. SECTION 2. Variations are hereby granted to Section 17.443060.E.6 of the Village Zoning Ordinance to the following legally described property: Lots 1 & 2 in Walgreen's Buffalo Grove Resubdivision being a reubdivision of parts of the southwest quarter of Section 35, Township 43 North and part of the northwest quarter of Section 3, Township 42 North, Range 11, East of the Third Principal Meridian, in Lake and Cook Counties. E 0 The specific variations will permit installation of "Pharmacy" and "Open 24 Hours" wall signs on the south and east elevations and a "Drive Thru Pharmacy" directional sign on the south elevation. All signs shall be installed pursuant to the Exhibits presented to the Zoning Board of Appeals except that the "1- Hour Photo" sign shall be eliminated. SECTION 3. This ordinance shall be in effect from and after its passage and approval. This ordinance shall not be codified. AYES: 5 - Marienthal, Braiman.
