GRANTING A VARIANCE FROM SECTIONS 14.20.050 AND 14.20.080 OF THE
BUFFALO GROVE SIGN ORDINANCE
WHEREAS, the Village of Buffalo Grove is a home rule unit pursuant to the Illinois
Constitution of 1970; and
WHEREAS, Charles Zenn of Olympic Signs on behalf of NEXTEL, lessee of the
hereinafter legally described property commonly known as 1080 -1090 Johnson Drive (Chevy
Chase Business Park, Building No.2), Buffalo Grove, Illinois, has requested variations from
Sections 14.20.050 and 14.20.080 of the Buffalo Grove Sign Ordinance for the purpose of
installing an additional wall sign on the south elevation of the building that would not face a
public right of way; and
WHEREAS, the Zoning Board of Appeals has held a public hearing, received
testimony prepared minutes, made certain findings, and has made an affirmative
recommendation on said request for variations; and
WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby
determine and find that said variations are in harmony with the general purpose and intent of
the Sign Ordinance, and that (1) the ordinance in question would cause undue and unnecessary
hardship to the sign user because of unique or unusual conditions pertaining to the property,
(2) the granting of the requested variances will not be materially detrimental to the property
owners in the vicinity, (3) the unusual conditions applying to the specific property do not apply
generally to other properties in the Village, and (4) the granting of the variances will not be
contrary to the general objective of this title of moderating the size, number and obtrusive
placement of signs and the reduction of clutter.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD
OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE
COUNTIES, ILLINOIS, as follows:
Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate
Authorities.
Section 2. Variations are hereby granted to Sections 14.20.050 and 14.20.080 of
the Village Sign Ordinance to the following legally described real property.
PARCEL 1:
Lots 18, 19 and 20 in Chevy Chase Business Park, being a resubdivision of part of the South
1/2 of Section 34, Township 43 North, Range 11, East of the third Principal Meridian, and
part of the Northeast 1/4 of Section 3, Township 42 North, Range 11, East of the Third
Principal Meridian, according to the plat thereof recorded in Lake County, Illinois on
November 22,1985 as Document 2401511, all in Lake and Cook Counties, Illinois.
PARCEL 2:
Non - exclusive easement appurtenant to and for the benefit of Parcel 1 across and upon
easement premises No. 2 described below for the purpose of providing pedestrian and
vehicular ingress and egress to, from and between that certain road commonly known as
Johnson Drive and Parcel 1 and the adjoining property described therein, as set forth in the
declaration of driveway easement dated as of January 20,1990 made by LaSalle National Bank,
as Trustee under Trust Agreement dated July 2,1985 and known as Trust No. 11048 recorded
March 30,1980 as Document 2891038, across and upon the following described real estate:
that part of Lot 21 in Chevy Chase Business Park, being a resubdivision of part of the South
1/2 of Section 34, Township 43 North, Range 11, East of the Third Principal Meridian and
part of the Northeast 1/4 of Section 3, Township 42 North, Range 11, East of the Third
Principal Meridian, according to the plat thereof recorded November 22,1985 as Document
No. 2401511. In Lake County, Illinois described as follows: beginning at the Northwest corner
of said Lot 21; thence North 71 degrees 01 minutes 09 seconds East along the Northwesterly
line of said Lot 21, 255.00 feet, thence South 18 degrees 58 minutes 51 seconds East, 15.00
feet; thence South 71 degrees 01 minutes 09 seconds West parallel with the Northwesterly line
of said Lot 21, 230.11 feet, thence South 49 degrees 16 minutes 41 seconds West, 27.00 feet
to a point on the Westerly line of said Lot 21, 25.00 feet, as measured along said Westerly
line, Southwesterly of the Northwest comer of Said Lot 21; thence North 18 degrees 32
minutes 46 seconds West along the Westerly line of said Lot 21, 25.00 feet to the point of
beginning.
The specific variation is to allow the petitioner to install and additional illuminated wall
sign on the south elevation of the building that would not face a public right -of -way.
SECTION 3. Conditions. The NEXTEL letters are to be illuminated only from dusk
to 10:00 p.m. C.S.T.
SECTION 4. This ordinance shall be in full force and effect from and after its passage
and approval. This ordinance shall not be codified.
