AN ORDINANCE CONCERNING THE DISSOLUTION OF THE VILLAGE OF
BUFFALO GROVE APPEARANCE COABUSSION
WHEREAS, the Village of Buffalo Grove is a home rule unit pursuant to the Illinois
Constitution of 1970; and
WHEREAS, the PAR Group conducted a study of the Village's committees, commissions and
boards which study dated January 12, 1999 recommended the dissolution of the Village's
Appearance Commission; and
WHEREAS, the duties and responsibilities of the Appearance Commission are reassigned to
the Village's Plan Commission, the Village's Zoning Board of Appeals or the Village staff.
WHEREAS, the Village Board on June 21, 1999 enacted Ordinance No. 99-57 entitled "An
Ordinance Providing For the Dissolution of the Village of Buffalo Grove Appearance
Commission."
WHEREAS, the Village of Buffalo Grove Village Board has conducted a public hearing and
has determined that changes are necessary to the Village's Municipal Code on account of the
dissolution of the Appearance Commission.
WHEREAS, the Village Board on June 21,1999 enacted Ordinance No. 99 -55 entitled "An
Ordinance Amending Chapter 2.44, Zoning Board of Appeals," which ordinance increased the
size of the Zoning Board of Appeals from seven to nine members; and
WHEREAS, the Buffalo Grove Village Board has conducted a public hearing and has
determined that changes are necessary to sections 17.52.010 and 17.52.020 of the Village's
Zoning Ordinance concerning the Zoning Board of Appeals.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE
COUNTIES, ILLINOIS, as follows:
SECTION 1. Section 14.08.035, entitled Appearance Commission, of the Village of Buffalo
Grove Municipal Code is hereby repealed.
SECTION 2. Subsection B. of Section 14.12.020, entitled Permit Application Procedure, of
the Village of Buffalo Grove Municipal Code is amended to read as follows:
B. Permit Approval Procedure. Approval of sign permits shall be governed by the
following procedures and requirements:
1. Following receipt of required permit application materials, the Administrator
shall undertake a review of the proposed signage for compliance with the Village's
Appearance Plan, this Title and the ordinances of the Village.
2. The Administrator shall approve or deny all sign permits which require no
variances from the provisions of this Title. If sign permit is denied, appeal may be
made as provided in Section 14.12.050.
3. Where sign permits require variance to the provisions of this Title, the
Administrator shall conduct a complete review of the proposed signage and transmit
recommendations thereon to the Zoning Board of Appeals.
4. The Zoning Board of Appeals shall hear requests for variances in accordance
with Chapter 14.44 of this Title. If a sign permit requiring a variance is approved by
the Zoning Board of Appeals, the Administrator shall issue a permit. If a sign permit
requiring a variance is denied, appeal may be made as provided in Chapter 14.44 of
this Title.
SECTION 3. Section 14.12.050, entitled Appeals, of the Village of Buffalo Grove
Municipal Code is hereby amended to read as follows:
14.12.050 Appeals
A. Any person aggrieved by the decision of the Administrator in regard to
the denial of a sign permit shall have the right to appeal to the Village Manager or
designee.
Such appeal shall be taken by filing with the Administrator, within 15 days after
notice of denial, a written statement setting forth the grounds for appeal. The Village
Manager or designee may approve, overrule or modify the decision of the
Administrator.
B. Any person aggrieved by the decision of the Village Manager or
designee shall have the right to appeal to the Zoning Board of Appeals.
Such appeal shall be taken by filing with the Village Manager or designee,
within 15 days after notice of denial, a written statement setting forth the grounds for
appeal. The Zoning Board of Appeals may approve, overrule, or modify the decision of
the Village Manager or designee.
SECTION 4. Section 14.20.040, entitled Town Center Planned District, of the Village of
Buffalo Grove Municipal Code is hereby repealed.
SECTION 5. Section 14.20.060, entitled Uniform Sign Package, of the Village of Buffalo
Grove Municipal Code is hereby amended to read as follows:
14.20.060 Uniform sign package.
The builder, developer or management of all developed parcels shall be required
to submit a uniform sign package which must be compatible and harmonious with the
architectural scheme of the development and comply with all the requirements of this
Title. Once said package has been approved by the Village any permits for individual
signs conforming to said sign package as approved shall be issued by the

Administrator.
SECTION 6. The first paragraph prior to subsection A. of Section 14.20.100, entitled
Canopy or Marquee Signs, of the Village of Buffalo Grove Municipal Code is hereby amended
to read as follows:
14.20.100 Canopy or marquee signs.
Canopy signs are allowed only upon approval by the Village. Such signs
shall be subject to the following conditions:
SECTION 7. Section 14.20.140, entitled Embellishments, of the Village of Buffalo
Grove Municipal Code is hereby amended to read as follows:
14.20.140 Embellishments.
No embellishment and /or advertising is allowed unless approved by the Village.
SECTION 8. The last full paragraph of Section 16.20.020 of the Village of Buffalo
Grove Development Ordinance is hereby amended to read as follows:
For residential developments, the number of dwelling units, number of stories and
bedroom mix shall be provided. The Concept Plan shall include a site data table
summarizing information depicted on the Plan. The Concept Plan shall include a note
stating: "Signs and fences depicted on this Plan are not approved and are subject to
review and approval by the"..-"Building Commissioner, and if necessary, the Zoning
Board of Appeals, subject to applicable ordinances."
SECTION 9. Subsection A. 15. of Section 16.20.030 of the Village of Buffalo Grove
Development Ordinance is hereby amended to read as follows:
15. A note stating: "Signs and fences depicted on this Plan are not approved and
are subject to review and approval by the Building Commissioner, and if necessary, the
Zoning Board of Appeals, subject to applicable ordinances."
SECTION 10. The first paragraph prior to the listing of "Tree Selection" in subsection
G, entitled Approved Trees of Section 16.50.120 of the Village of Buffalo Grove Development
Ordinance is hereby amended to read as follows:
G. Approved Trees
Trees to be planted in Village parkways shall be selected from the tree species
listed below, unless in the opinion of the Village Forester the tree will not survive, be a
nuisance in the location or locations indicated, or result in an over - population of a
species in the area. The following is a list of trees which may be approved and not
necessarily a recommendation.

SECTION 11. Subsection H., entitled Variety in Planting of Section 16.50.120 of the
Village of Buffalo Grove Development Ordinance is hereby amended to read as follows:
H. Variety in Planting
1. Diversification of tree species selection is desired to be as great as possible.
For every linear mile, and succeeding mile or fraction thereof, of parkway in a
development, a minimum of four (4) different species is required. Deviation from the
above will be considered only after approval by the Village Forester.
2. An approved master tree planting schedule shall be submitted and must be
approved by the Village Forester.
SECTION 12. Subsection B.4., entitled Landscaping Islands, of the Section 16.50.150
of the Village of Buffalo Grove Development Ordinance is hereby amended to read as follows:
4. Landscaping Islands
A landscaped island of a minimum size of one hundred eighty (180) square feet
shall be provided for every twenty (20) parking spaces. In open parking areas larger
than four (4), but smaller than twenty (20) spaces, proportional amounts of landscaping
area within the parking facility shall be provided as approved by the Village Forester.
Design of the island shall be approved by the Village Engineer.
SECTION 13. Section 17.12.615 of the Village of Buffalo Grove Zoning Ordinance is
hereby amended to read as follows:
17.12.615 Zoning Administrator.
The Building Commissioner of the Village of Buffalo Grove.
SECTION 14. Subsection EA.c. of Section 17.28.050 of the Village of Buffalo Grove
Zoning Ordinance is hereby amended to read as follows:
C. No modifications of any kind may be made to the approved building
architecture in a Planned Unit Development where there is more than one building on a
zoning lot unless approved by thei.Building Commissioner. No accessory buildings or
structures are permitted unless approved on the preliminary plan.
SECTION 15. Subsection H.1. , entitled Transitional Yards, of Section 17.44.020 of the
Village of Buffalo Grove Zoning Ordinance is hereby amended to read as follows:
H. Transitional yards.
1. Where a rear or side lot line coincides with a side or rear lot line in an
adjacent residential district, a buffer strip of not less than twelve (12) feet wide shall be
provided. Such buffer strip shall be sodded, planted, shrubbed and maintained and
there shall be provided adjacent to the residential district boundary line, a solid
wall, fence, or hedge constructed and maintained to form a screen not less than six (6)
feet in height. Such screen shall be required prior to issuance of a certificate of
occupancy. A temporary certificate of occupancy may be issued if the Village Forester
determines that installation of said screen may be delayed due to seasonal conditions.
If a solid wall or fence is utilized, it shall be placed immediately adjacent to the
property line unless otherwise approved by the Village due to one or more of the
following circumstances:
a. The nature of the use would be detrimental to the required landscaping
thereby requiring any landscaped area to be located outside the wall or
fence.
b. The impact of the close proximity of adjacent uses would be reduced if
some or all of the landscaped area was located outside the wall or fence.
C. The general appearance of the area would be enhanced by locating the
wall or fence other than immediately adjacent to the property line.

Village of Buffalo Grove Zoning Ordinance is hereby amended and read as follows:

Village of Buffalo Grove Zoning Ordinance is hereby amended to read as follows:
G. Transitional yards.
1. Where a rear or side lot line coincides with a side or rear lot line in an

SECTION 19. Subsection E.6.a.(i) of Section 17.44.060 of the Village of Buffalo
Grove Zoning Ordinance is hereby amended to read as follows:
(i) The Building Commissioner shall review signs for the Town Center and shall
approve or deny same.
SECTION 20. Subsection F.6.b., entitled Transitional Yards, of Section 17.48.010 of
the Village of Buffalo Grove Zoning Ordinance is hereby amended to read as follows:
b. Along any district boundary line which abuts or adjoins a residential district,
there shall be provided immediately adjacent to the residential district boundary line a
solid wall, fence, or hedge constructed and maintained to form a screen not less than
six (6) feet in height. Such screen shall be required prior to issuance of a certificate

Forester determines that installation of said screen may be delayed due to seasonal

e. An Appearance Plan for all proposed developments must be submitted for the
Village's approval.
SECTION 23. Sections 17.52.010 and 17.52.020 of the Village of Buffalo Grove
Zoning Ordinance are hereby amended to read as follows:
17.52.010 Appeals and Review
The Zoning Board of Appeals (hereinafter referred to as "Board ") shall hear
appeals from and review any order, requirement, decision, or determination made by
the Zoning Administrator. An appeal to the Board may be taken by any person
aggrieved or by any officer, department, or board /commission of the Village. Such
appeal shall be taken by filing with the officer from whom the appeal is taken, a notice
of appeal specifying the grounds thereof, together with such plats and exhibits as are
reasonably necessary. Such appeal shall be taken upon forms provided by the Board.
The officer shall forthwith transmit to the Board all of the papers constituting the
record upon which the action appealed was taken. The Board shall fix a reasonable
time and place for the hearing of appeals and shall give notice thereof to the persons
appealing and to the officer from whom the appeal is taken. At the hearing, parties in
interest may appear in person or by agency or attorney.
17.52.020 Authorization for Variations
The Board, after a public hearing, may determine and vary the regulations of
this Title in harmony with the general purpose and intent of this Title so that such
variances, which may be granted, will not be contrary to the public interest.
Furthermore, such variations may be authorized only in those specific instances
enumerated in Section 17.52.040 and then only after the Board has made findings of
fact based upon the criteria for variations set forth in Section 17.52.070.
SECTION 24. This ordinance shall be in full force and effect from and after its
passage, approval and publication. This ordinance may be published in pamphlet form.

A landscaped island of a minimum size of one hundred eighty (180) square feet
shall be provided for every twenty (20) parking spaces. In open parking areas larger
than four (4), but smaller than twenty (20) spaces, proportional amounts of landscaping
area within the parking facility shall be provided as approved by the Village Forester.
Design of the island shall be approved by the Village Engineer.
SECTION 13. Section 17.12.615 of the Village of Buffalo Grove Zoning Ordinance is
hereby amended to read as follows:
17.12.615 Zoning Administrator.
The Building Commissioner of the Village of Buffalo Grove.
SECTION 14. Subsection E.4.c. of Section 17.28.050 of the Village of Buffalo Grove
Zoning Ordinance is hereby amended to read as follows:
C. No modifications of any kind may be made to the approved building
architecture in a Planned Unit Development where there is more than one building on a
zoning lot unless approved by theBuilding Commissioner. No accessory buildings or
structures are permitted unless approved on the preliminary plan.
SECTION 15. Subsection H.1., entitled Transitional Yards, of Section 17.44.020 of the
Village of Buffalo Grove Zoning Ordinance is hereby amended to read as follows:
H. Transitional yards.
1. Where a rear or side lot line coincides with a side or rear lot line in an
adjacent residential district, a buffer strip of not less than twelve (12) feet wide shall be
provided. Such buffer strip shall be sodded, planted, shrubbed and maintained and
there shall be provided adjacent to the residential district boundary line, a solid

wall, fence, or hedge constructed and maintained to form a screen not less than six (6)
feet in height. Such screen shall be required prior to issuance of a certificate of
occupancy. A temporary certificate of occupancy may be issued if the Village Forester
determines that installation of said screen may be delayed due to seasonal conditions.
If a solid wall or fence is utilized, it shall be placed immediately adjacent to the
property line unless otherwise approved by the Village due to one or more of the
following circumstances:
a. The nature of the use would be detrimental to the required landscaping
thereby requiring any landscaped area to be located outside the wall or
fence.
b. The impact of the close proximity of adjacent uses would be reduced if
some or all of the landscaped area was located outside the wall or fence.
C. The general appearance of the area would be enhanced by locating the
wall or fence other than immediately adjacent to the property line.
SECTION 16. Subsection G.1., entitled Transitional Yards, of Section 17.44.030 of the
Village of Buffalo Grove Zoning Ordinance is hereby amended and read as follows:

SECTION 19. Subsection E.6.a.(i) of Section 17.44.060 of the Village of Buffalo

(i) The Building Commissioner shall review signs for the Town Center and shall
approve or deny same.
SECTION 20. Subsection F.6.b., entitled Transitional Yards, of Section 17.48.010 of
the Village of Buffalo Grove Zoning Ordinance is hereby amended to read as follows:

SECTION 22. Subsection G.2.e. of Section 17.48.020 of the Village of Buffalo Zoning
Ordinance is hereby amended to read as follows:
e. An Appearance Plan for all proposed developments must be submitted for the
Village's approval.
SECTION 23. Sections 17.52.010 and 17.52.020 of the Village of Buffalo Grove
Zoning Ordinance are hereby amended to read as follows:
17.52.010 Appeals and Review
The Zoning Board of Appeals (hereinafter referred to as "Board ") shall hear
appeals from and review any order, requirement, decision, or determination made by
the Zoning Administrator. An appeal to the Board may be taken by any person
aggrieved or by any officer, department, or board /commission of the Village. Such
appeal shall be taken by filing with the officer from whom the appeal is taken, a notice
of appeal specifying the grounds thereof, together with such plats and exhibits as are
reasonably necessary. Such appeal shall be taken upon forms provided by the Board:
The officer shall forthwith transmit to the Board all of the papers constituting the
record upon which the action appealed was taken. The Board shall fix a reasonable
time and place for the hearing of appeals and shall give notice thereof to the persons
appealing and to the officer from whom the appeal is taken. At the hearing, parties in
interest may appear in person or by agency or attorney.
17.52.020 Authorization for Variations
The Board, after a public hearing, may determine and vary the regulations of
this Title in harmony with the general purpose and intent of this Title so that such
variances, which may be granted, will not be contrary to the public interest.
Furthermore, such variations may be authorized only in those specific instances
enumerated in Section 17.52.040 and then only after the Board has made findings of
fact based upon the criteria for variations set forth in Section 17.52.070.
