1999-055ORDINANCE NO. 99- 55 AN ORDINANCE PROVIDING FOR THE DISSOLUTION OF THE VILLAGE OF BUFFALO GROVE APPEARANCE COMMISSION WHEREAS, the Village of Buffalo Grove is a home rule unit pursuant to the Illinois Constitution of 1970; and WHEREAS, the PAR Group conducted a study of the Village's committees, commissions and boards which study dated January 12, 1999 recommended the dissolution of the Village's Appearance Commission; and WHEREAS, the duties and responsibilities of the Appearance Commission are reassigned to the Village's Plan Commission, the Village's Zoning Board of Appeals or the Village staff (hereinafter referred to as designated Village official) as set forth herein. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows: Section 1 Chapter 2.22, Appearance Commission of the Village of Buffalo Grove Municipal Code is hereby amended to read as follows: Chapter 2.22 APPEARANCE PLAN 2.22.010 Title. The ordinance codified in this Chapter, including any regulation hereafter adopted, shall be hereafter known, cited and referred to as the "Buffalo Grove Appearanc Plan". 2.22.020 Intent and purposes. The intent and purpose of this Chapter are as follows: A. To promote the public health, safety, morals, comfort and general welfare of the citizens of the Village; B. To enhance the values of property throughout the Village; C. To protect and to stabilize the general appearance of buildings, structures, landscaping and open areas, in all the zoning districts of the Village, including public lands and planned developments; D. To ensure adequate light, air and privacy for property in the Village; E. To encourage and promote acceptability, attractiveness, cohesiveness and compatibility of new buildings, development, substantial remodeling and additions so as to maintain and improve the established standards of property values within the Village. 1 o - • 2.22.030 Definitions. "External architectural feature" means the architectural style and general arrangement of such portion of a building or structure as is designed to be open to view from a public street, place, or way, including the kind, color and texture of the building material of such portion, and the types of windows, doors, lights, attached or ground signs and other fixtures appurtenant to such portion. 2.22.040 Appearance plan. The Village shall maintain an Appearance Plan. The Appearance Plan shall be based on the intent and purposes of this Chapter, which such plan shall be intended as the standard or guidelines for future physical developments and should consider, among other features: A. The external architectural features (as defined in this Chapter) of proposed buildings and landscaping and site planning thereof; B. Existing Village ordinances as amended, as to, but not limited to, zoning, building, subdivision, trees and shrubs; provided, however, nothing in the appearance plan shall conflict with, modify or alter any provisions of the Zoning, or Development Ordinances, or Building Code.. 2.22.050 Appearance plan compliance. A. No permit or other approval required pursuant to Village ordinances shall be issued until the designated Village official has determined that the proposed development request or application conforms to the Appearance Plan. B. The Village Plan Commission will determine compliance with the Appearance Plan on (1) all new development projects and (2) any existing development project amendment that will require approval by Village ordinance and (3) any referral by the designated Village official. C. The Village Zoning Board of Appeals will determine compliance with the Appearance Plan on any plan modifications not requiring approval by Village ordinance unless otherwise approved by the designated Village official. 2.22.060 Appeal A. Any person aggrieved by the decision of a designated Village official in regard to the denial of the application or permit shall have the right to appeal to the Village Manager or designee. Such appeal shall be taken by filing with the designated official, within 15 days after notice of a denial, a written statement setting forth the grounds for appeal. The Village Manager or designee may approve, overrule or modify the decision of the designated Village official. B. Any person aggrieved by the decision of the Village Manager or designee shall have the right to appeal to the Plan Commission or the Zoning Board,of Appeals pursuant to their jurisdiction as set forth in Section 2.22.050. Such appeal shall be taken by filing with the Village Manager or designee, within 15 days after notice of the decision, a written statement setting forth the grounds for appeal. The Zoning Board of Appeals or the Plan Commission may approve, overrule or modify the 2 decision of the Village Manager or designee. 2.22.070 Minor Changes The designated Village official may authorize minor changes to an approved plan if the changes do not substantially alter or significantly impact upon the overall general appearance. Section 2.. This ordinance shall be in full force and effect from and after its passage, approval and publication. This ordinance may be published in pamphlet form.
