1999-0230 0 ORDINANCE NO. 99- 23 GRANTING VARIANCES FROM SECTION 17.44.060.E.6 OF THE BUFFALO GROVE ZONING ORDINANCE WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS, the Petitioner, Thomas Scesniak, on behalf of Burger King, has requested a variation of the hereinafter legally described real property, commonly known as the Town Center, Buffalo Grove, Illinois, from Section 17.44.060.E.6 of the Buffalo Grove Zoning Ordinance for the purpose of installing three wall signs, one ground sign and one menu board; and, WHEREAS, the Zoning Board of Appeals has held a public hearing, received testi- mony, prepared minutes, made certain findings, and has made an affirmative recommendation on said request for variation; and WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby determine and find that said variation is in harmony with the general purpose and intent of the Zoning Ordinance, the property in question cannot yield a reasonable return if permitted to be used only under the conditions allowed by the regulations of the zoning district in which it is located, the plight of the owner is due to unique circumstances, and the proposed variation will not alter the essential character of the neighborhood. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows: 0 • Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate Authorities. Section 2. A variation is hereby granted to Section 17.44.060.E.6 of the Village Zoning Ordinance to the following legally described real property: That part of Lot 1 in Buffalo Grove Town Center Unit 7, being a resubdivision of Lot 1 in Buffalo Grove Town Center Unit 6 in Section 33, Township 43 North, Range 11 East of the Third Princi- pal Meridian, described as follows: Commencing at the Northeast corner of Lot 1 in said Buffalo Grove Town Center Unit 7; thence along the easterly line of said Lot 1 the following 5 courses: south 09 degrees 11 minutes 51 seconds east 537.38 feet, south 06 de- grees 20 minutes 05 seconds east 100.11 feet, south 09 degrees 11 minutes 51 seconds east 222.48 feet, south 09 degres 11 minutes 51 seconds east 222.48 feet, south 89 dgrees 35 minutes 49 seconds west 10.12 feet and south 09 degrees 11 minutes 51 seconds east 192.42 feet; thence south 82 degrees 05 minutes 21 seconds west 23.43 feet to the point of beginning; thence continuing south 02 degrees 05 minutes 21 seconds west 84.70 feet; thence south 07 degrees 54 minutes 39 seconds east 132.11 feet; thence north 86 degrees 03 minutes 18 seconds east 88.02 feet thence north 09 degrees 11 minutes 81 seconds west 138.23 feet to the place of beginning, in Lake County, Illinois. The specific variations will allow the Petitioner to install one (1) ground sign on Route 83, not to exceed 3' by 3' with a base consisting of 3 courses of kingsize brick that matches that used at the Eagle Food store; one (1) wall sign on the north elevation; two (2) wall signs on the west elevation and a menu board, per exhibits submitted by the Petitioner. Section 3. This ordinance shall be in effect from and after its passage and approval. This ordinance shall not be codified.
