1999-014ORDINANCE NO. 99- 14 AN ORDINANCE AMENDING CHAPTER 5.40 OF THE VILLAGE OF BUFFALO GROVE MUNICIPAL CODE DEALING WITH HOURS OF OPERATION ADJACENT TO RESIDENTIAL AREAS WHEREAS, the Village of Buffalo Grove is a. Home Rule Unit of government pursuant to the Illinois Constitution of 1970; and WHEREAS, the possibility exists that certain retail operations within the Village adjacent to residential zoning districts may be required to provide additional service hours of operation in order to remain competitive. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS the following: Section 1. Section 5.40.010, Retail Operations, of Chapter 5.40 of the Village of Buffalo Grove Municipal Code is hereby amended to read as follows: 5.40.010 Retail Operation Except as otherwise provided in this Chapter, where the property line or portions of a retail structure or the customer parking area or driveway and /or portion thereof is located within eighty feet of a property line of a residential structure, the operation of same between the hours of midnight and seven a.m. is prohibited, except that a retail operator or shop owner may petition the Village Manager for a five a.m. opening provided: A. Parking is restricted in a method authorized by the Village Manager within the eighty -foot buffer between the hours of five a.m. and seven a.m. In addition, no deliveries can occur prior to six a.m. B. A request is submitted to, and approval received from the Village Manager which sets forth the requirements, maintenance and other guidelines for the restricted parking and deliveries as well as any other conditions that may be considered appropriate. Section 2. This ordinance shall be in full force and effect from and after its adoption, approval and publication. AYES: 5 - Marienthal, Reid. Rubin, Hendricks. Glover .
