ORDINANCE NO. 99 -10
AN ORDINANCE AMENDING TITLE 16 OF THE BUFFALO
GROVE MUNICIPAL CODE, BEING THE DEVELOPMENT
ORDINANCE
WHEREAS, the Village of Buffalo grove is a Home Rule Unit pursuant to the Illinois
Constitution of 1970.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES,
ILLINOIS, as follows:
Section 1: The following sections of Title 16 of the Buffalo Grove Municipal Code are
amended to read as follows:
Section 16.20.130.B.2.:
2. The Developer shall post a security in a sum sufficient to cover 108% of the
approved engineer's estimate of cost as described above. The financial security shall be in the form
of either cash, an irrevocable letter of credit issued by a financial institution authorized to do
business in the State of Illinois and subject to the approval of the Corporate Authorities, or direct
financial obligations of the United States of America subject to the approval of the Corporate
Authorities. The approval of any of the above mentioned securities is subject to a minimum of one
(1) percent of the amount of the security, but not less than Five Thousand Dollars ($5,000.00) being
deposited in cash with the Village.
Section 16.50.030.D.6.b.:
b. Storm sewer serving sump pumps shall not be less than eight (8)
inches in diameter, and roof drains shall not be less than six (6) inch diameter.
Section 16.50.040.C.4.:
4. Permanent ponds shall be designed in accordance with Exhibit No. 209.
Ponds shall have a two (2) foot horizontal to one (1) foot vertical side slope (2:1) from a point one
and one -half (1 1 /2) feet above normal water level, down to a point three (3) feet below normal water
level. This 2:1 sloped area shall be covered with a layer of natural stones, with a minimum diameter
of eighteen (18) inches. A diameter of less than eighteen (18) inches may be approved by the
Corporate Authorities. The surface of the stones on the 2:1 slope shall be arranged in such a manner
so as to enable a person to climb out of the pond over the stones. The use of "North American Green
C350 Erosion Control /Turf Reinforcement Mat" or equal may also be used when approved by the

Corporate Authorities. When this reinforcement mat is used, the pond shall have a five (5) foot
horizontal to a one (1) foot vertical side slope (5:1) from a point one and one -half (1 %2) feet above
normal water level, down to the normal water level. The area between the top of the 2:1 or 5:1 slope
and the high water level must be protected by sodding in order to prevent soil erosion. The first
twelve (12) feet of the sodded area at the top of the 2:1 or 5:1 slope shall be sloped at two (2) percent
towards the pond. At the toe of the 2:1 slope, a twelve (12) foot wide safety ledge sloped toward the
shore at four (4) percent shall be provided. Beyond the safety ledge, the pond bottom shall slope at
two (2) horizontal to one (1) vertical (2:1) down to the pond bottom elevation. The minimum pond
bottom elevation shall be fifteen (15) feet below normal water level. Points of inflow to the pond
shall be accessible to construction equipment for dredging as necessary. If retention facilities are
designated for recreational purposes, appropriate consideration shall be reflected in the design for
maintenance of fish life, boating, and safety. All ponds shall be provided with aeration equipment.
Aeration facilities to prevent pond stagnation and promote water quality will be provided. Design
calculations to demonstrate the effectiveness of these aeration facilities will be submitted.
Section 16.50.040.D:
D. Other Requirements
Streets or habitable structures built adjoining detention facilities shall meet the
clearance required of the Village Flood Plain Regulations. This shall ensure that all structures be
set back a minimum of twenty -five (25) feet from the high water level of a detention facility and
the elevation centerline of any street and the low point of any parking lot be elevated to one (1) foot
above the high water line of any detention facility.

Section 16.50.090. B: & C.:
B. Off - street bikepaths shall be constructed with a minimum width of ten (10) feet and
with a minimum thickness of four (4) inches of Class I asphaltic surface course.
C. Bikepaths on or within twenty (20) feet of and parallel to street right -of -ways shall
conform to all requirements of sidewalks and shall have a width of ten (10) feet, as shown on
Exhibit No. 502.
Section 16.50.120.C.:
C. Protection of Existing Trees
1. All developers with sites containing any trees four (4) inches in diameter or
greater, calipered at four and one -half feet (41/2) above the highest ground level, shall prepare a Tree
Survey which shall certify the locations of all such trees and the species of each. Each tree which
is required to be certified shall be tagged with an inventory number, mapped on the Concept Plan,
and a written evaluation and rating of the tree's condition shall be submitted and shall include a
description of the rating system and process used in the evaluation at the time of Concept Plan
submittal. A Tree Preservation Plan shall be submitted showing such existing trees that are proposed
to be razed and those that are proposed to be saved and shall include a grading plan.
4. Where trees are to be saved, provision shall be made for erection of
temporary fencing at the periphery of the drip line to keep construction from killing the tree or from
compacting soil and damaging shallow feeder roots. At a minimum, all provisions of Section 201.05
of the "SSR & BC ", latest edition, shall be followed. All trees destroyed or razed in violation of the
approved plan shall be replaced with the sum of the inch - diameter equal to twice the inch - diameter
of trees destroyed. The size of replacement trees shall be a minimum of four (4) inch diameter,
calipered at four and one -half feet (4 1/2') above the highest ground level.
5. The care and protection of all plant materials specified to be preserved shall,
at a minimum, follow the requirements of Section 201.06 of the "SSR & BC".
Section 16.50.120.D.2.:
2. Areas to be sodded shall be graded smooth and topped with at least four (4) inches
of black dirt after compacting and removal of stumps, trees that cannot be saved, boulders and other
debris. These areas shall be sodded in accordance with Section 252 of the "SSR & BC".

Section 16.50.120.I.1.f.:
f. Trees shall be a minimum trunk diameter of two and one -half (2%2)
inches, calipered at four and one -half feet (4 1/2') above the highest ground level. Trees shall be
northern nursery grown (hardiness zone 5 USDA MAP). Trees shall have been transplanted twice,
the last transplanting not less than four (4) years prior to planting. All trees shall be tagged and
identified as to species, size, and place of origin. Tags shall remain in place until inspection and
approval by the Public Works Department is done both at the nursery and at the final planting site.
All trees shall be balled and burlapped. All trees shall have straight trunks and good branching.
Branches shall begin from five (5) to six (6) feet above ground level and shall be high quality
representatives of their species in all regards, including general shape. Each tree shall be planted
plumb and at the same level as where it stood in the nursery in relation to finished grade. Backfill
shall be black top soil properly fertilized with organic fertilizer and shall be thoroughly watered
when the hole is two - thirds (2/3) full of topsoil. All spoils, shall be removed from the site.
Section 2: Title 16 of the Buffalo Grove Municipal Code is amended by adding the
following:
Section 16.50.040.C.4.:
4) Planting - Native Materials
a) Any areas of the pond shoreline not surfaced with natural stones which is
subject to the normal fluctuation in water levels, and those portions of detention
facility bottoms which will be routinely submerged for extended periods of time
shall be planted with plants tolerant of such fluctuation.
b) The Planting plan shall describe the materials to be used and shall describe their
tolerance for the conditions to be expected.
Section 3: Title 16 of the Buffalo Grove Municipal Code is further amended by
amending EXHIBIT NO. 209 entitled, "TYPICAL CROSS - SECTION OF POND SHORE,"
attached hereto.
Section 4: Title 16 of the Buffalo Grove Municipal Code is further amended by adding
EXHIBIT NO. 502 entitled, "SIDEWALK DETAIL," attached hereto.
Section 5: Title 16 of the Buffalo Grove Municipal Code is further amended by adding
EXHIBIT NO. 504 entitled, "BIKE PATH DETAIL," attached hereto.
