1998-0950 ORDINANCE 98 -Q5 GRANTING A VARIANCE FROM SECTIONS 14.20.030 AND 14.20.080 OF THE BUFFALO GROVE SIGN ORDINANCE WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS, Illini Partners, Buffalo Grove, L.L.C., c/o Terraco, Inc., the Owner of the hereinafter legally described real property, located at the comer of Buffalo Grove Road and Aptakisic Road, Buffalo Grove, Illinois, have requested variations from Sections 14.20.030, pertaining to the number of wall signs for each occupancy, and 14.20.080, pertaining to wall signs, of the Buffalo Grove Sign Ordinance; and, WHEREAS, the Zoning Board of Appeals has held a public hearing, received testimony, prepared minutes, made certain findings, and has made an affirmative recommendation on said request for variation; and WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby determine and find that said variation is in harmony with the general purpose and intent of the Sign Ordinance, and that (1) the proposed signage is of particularly good design and in particularly good taste; and (2) the entire site has been or will be particularly well- landscaped; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows: Section . The preceding WHEREAS clauses are hereby adopted by the Corporate Authorities. Section 2. A variation is hereby granted to Sections 14.20.030 and 14.20.080 of the Village Sign Code Ordinance to the following legally described real property: See Exhibit "A" attached hereto and made a part hereof. The specific variations are to permit the installation of one additional wall sign on the north and west elevations of the Walgreen's building and permit a Drive -Thru Pharmacy wall sign on the south elevation of the building that exceeds the size limitation. This variation is conditioned upon the signs being constructed in compliance with the plans and exhibits submitted to and approved by the Village and upon the agreement of the petitioner to reduce the size of the pylon sign at the entrance on Buffalo Grove Road from 16' 1 " to 14' 1 " in height. Section 3. This Ordinance shall be in effect from and after its passage and approval. This Ordinance shall not be codified. Skokie Blvd., Suite 303, Skokie, IL 60077 were sworn in. Notice of the public hearing was published in the Buffalo Grove Herald on October 2, 1998. Com. Hefler disclosed that his company does some work for Walgreen's, but they do not do the electrical hook -up. Mr. Skelton confirmed that is permissible for him to take part in the discussion and vote. Mr. Stewart informed the Commissioners that they have been through the Plan Commission and Appearance Commission process and have eliminated the Food Mart sign that typically appears on the front elevation of Walgreen's. The usual location of the word Pharmacy has been changed and One Hour Photo will be placed in the lower right -hand corner of the signs on the north and west elevations. He requested a variance of Sign Code, Section 14.20.030, pertaining to Business Districts, and Section 14.20.080 pertaining to Wall Signs to permit two (2) additional signs (Pharmacy and One Hour Photo), on the north and west elevations of the Walgreen's building; and to permit a Drive -Thru Pharmacy wall sign on the south elevation of the Walgreen's building that exceeds the size limitation. Approval of the variation for these signs and for two (2) ground signs was recommended by the Appearance Commission on September 24, 1998. The height of the Walgreen's sign at the corner of Buffalo Grove Road and Aptakisic Road was reduced from sixteen feet (161111) to twelve feet (121111) and the reader board section was eliminated. The second Walgreen's ground sign that will be installed on Buffalo Grove Road will be sixteen feet (161) in height and it will have panels for two (2) tenants that will occupy space in the second building to be constructed on the site. This 13,000 square foot multi- tenant will have five (5) stores. They expect to have two (2) tenants, designated Tenant A and Tenant B. A video store and a coffee store are possible tenants, along with typical strip center stores, such as a cleaners, Subway, etc. The stores with names on the ground sign will have reduced wall signs. The height and setbacks of the two (2) ground signs conform with the requirements of the Sign Code. Ch. Heinrich objected to the sixteen foot (161) height of the ground sign on Buffalo Grove Road and said that the Zoning Board has typically required lower signs when variances are requested. The subject property is, or will be, surrounded by residential districts and the sign will be the only business sign in the area. Mr. Stewart said it would be possible to lower the sign a couple of feet and agreed to make it fourteen feet one inch (141111) in height by lowering the seven foot (71) posts to five feet (51). This would still permit visibil- ity below the tenant panels. Drive -Thru Pharmacy on the south elevation will be twelve inch (1211) red letters. Ch. Heinrich questioned the need for the additional signs on the two (2) Walgreen's wall signs? Mr. Stewart said Pharmacy and One Hour Photo are requested for identification of these services. All new Walgreen's are being constructed on corners. They hope to break ground Ch. Heinrich asked what landscaping is proposed around the signs and on the site? He noted that the landscape plan does not show landscaping around the base of the ground sign on Buffalo Grove Road. Miami Mr. Stewart said the site is well landscaped and there will be landscaping at the base of the ground signs. They do not expect to break ground until spring. Comments from Commissioners: Com. Hefler said the signs are not too large. Com. Windecker had no objection to Pharmacy on the wall signs or for the Drive -Thru, but the One Hour Photo sign is not necessary. He agrees with the height reduction of the ground sign on Buffalo Grove Road. He would also like to know what hours the signs will be illuminated. Mr. Stewart said they originally asked for a lot more signs and they already made many concessions. He would have to approach Walgreen's for approval to delete One Hour Photo. Com. Arbus would only recommend the Pharmacy signs. Ch. Heinrich said if the request is Tabled, there is still enough time for the petitioner to consult Walgreen's with regard to the One Hour Photo sign. The Commissioners are split on the decision, so if a vote is taken, it will go to the Village Board as a negative recommendation. The decision is up to the petitioner. Mr. Stewart said they have been through many Plan Commission and Village Board meetings. They have tried to work under- neath the limits of the Sign Code by compromising with the Village. Now they are being held to a higher standard than other retailers. It would difficult to explain to Walgreen's why they have to give up the One Hour Photo sign. After consulting with Mr. Bean, Mr. Stewart said they would prefer not to Table. If they agree to eliminate the One Hour Photo signs, they will come back if Walgreen's does not agree? The hours the signs are to be illuminated was discussed and it was agreed that they should be turned out one (1) hour after closing, unless Walgreen's is a 24 -hour store. Com. Arbus made the following motion: PPEJOWED I move we recommend to the Village Board of Trustees that the variance requested by Illini Partners, Buffalo Grove, L.L.C. c/o Terraco, Inc. For variance of Sign Code, Section 14.20.030, pertaining to Business Districts, and Section 14.20.080, pertaining to Wall Signs, for the purpose of installing additional wall signs, as indicated on the exhibits submitted by the petitioner, be granted, with the stipulation that the Pharmacy sign under Walgreen's is permitted, but One Hour Photo is to be eliminated, from the north and west elevations of the Walgreen's building at the corner of Buffalo Grove Road and Aptakisic Rd. The Drive -Thru Pharmacy wall sign on the south elevation that does not face a right -of -way and exceeds the size limitation, is to be permitted. The ground sign on Buffalo Grove Road shall be no higher than fourteen feet one inch (141111). Signs are recommended pursuant to Sign Code, Section 14.44.010, Sub - section B. Hours of illumination shall be the hours the store is open, plus one (1) hour after closing. Petitioner has agreed to provide landscaping at the base of the ground sign on Buffalo Grove Road. Petitioner has agreed to amend the petition on its face to comply with the conditions as stated. Com. Windecker seconded the motion. Mr. Timothy Stewart, Stewart Nosky Architects, Inc. testified at the hearing and presented documentary evidence. No individuals appeared on behalf of the applicant. No objectors appeared at the public hearing. No written objections were received. Illini Partners - Walgreens's and Commercial Building Buffalo Grove Road an Aptakisic Road - Full Review: Architecture, Materials, Colors, Landscaping, Lighting and Signs with Recommendation for Variance Mr. Timothy F. Stewart, AIA, Stewart -Nosky Architects, Ltd. 1430 Branding Lane, Suite 100, Downers Grove, IL 60515 (630- 241 -0444) recalled the workshop that was held on July 9, 1998 and requested a recommendation for approval of the plans. He described the site plan at the corner of Buffalo Grove Road and Aptakisic Road. The two (2) buildings being proposed are a 15,000 square foot Walgreens structure and a 13,000 square foot building for small retail shops. They have received notification from IDOT that their curb cuts have been approved with minor variations on the widths and the elimination of a pork chop. The Appearance Commissioners recommended the addition of some brick piers to break up the south elevation of the Walgreens building and this has been done. The brick is beige color and the drivit is lighter. The buildings have a four foot (41) parapet so the HVAC units will not be visible. Walgreens has an enclosed refuse area and the retail building has an internal refuse area. There are six (6) handicapped spaces provided on site. APPEARANCE COMMISSION SEPTEMBER 24, 1998 - PAGE THREE r The Walgreens signs on the north and west had included Food Mart, Pharmacy and One Hour Photo, but the Food Mart sign has been eliminated; the word Pharmacy will be located under the Walgreens's sign with One Hour Photo off -set. The Walgreens ground sign at the corner has been lowered from sixteen feet (161) to twelve feet (121) in height. They have also eliminated the reader board sign. Mr. Stewart said the Landscape and Lighting Plans have not been changed since the workshop review. The architecture of the smaller building was not changed. They have submitted an application for variance of the Sign Code that would permit additional signs on the north and south elevations which do not face a right -of -way. They expect to rent the end spaces to national tenants and they will be permitted to install signs with national logos style lettering and colors. There are spaces for two (2) or three (3) smaller, possibly local tenants and the Appearance Commission requested Sign Criteria be selected. Tenant signs for the stores that front on Buffalo Grove Road to be Helvetica Medium letters with red, yellow or green faces with matching returns. They anticipate two (2) larger tenants at the ends of the build- ing and there is space for two (2) or three (3) tenants in the middle of the building. The Walgreens ground sign at the entrance on Buffalo Grove Road will be sixteen feet, one inch (161111) in height with two (2) tenant panels. If the panels are taken by the national tenants, they will be permitted to use their logo style lettering and colors. Stores who appear on the ground sign will be limited to 200 of the frontage. The smaller, local tenants will be limited to Helvetica Medium red, yellow or green letters and they will be permitted to use 3016 of the frontage. Ch. Gordon questioned the choice of red, yellow or green lettering for the smaller tenants an after discussion, Mr. Stewart agreed to eliminate yellow. He informed Mr. Stewart that should one of the three(3) middle tenants prefer a different color, it would have to be submitted to the Appearance Commission for approval. Mr. Stewart agreed with these requests. The red would be Walgreens red and the green would be Mermaid #404. Mr. Stewart summarized the variations they are requesting. They are the Pharmacy and-One Hour Photo signs on the north and west elevations of the Walgreens building and for the north and south elevations of the retail building for the corner tenants because they do not face a right -of -way. Com. Johnson made a motion to recommend approval of the architecture, materials, colors, landscaping and lighting for the Walgreens and Retail Buildings at Buffalo Grove Road and Aptakisic Roads, as submitted, with a recommenda- tion for a variation for the number of signs per face on north and west elevations of the Walgreens building and the percentage size of-the Drive Thru Pharmacy on the non- right- of -way face of the Walgreens building.
