1998-087ORDINANCE NO. 98- 87 GRANTING A VARIANCE FROM SECTIONS 14.20.030, 14.40.145. 14.40.020 and 14.20.080 OF THE BUFFALO GROVE SIGN ORDINANCE WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS, WENDY'S INTERNATIONAL, INC., One Energy Center, 40 Shuman Boulevard, Suite 130, Naperville, Illinois, Owner of the hereinafter legally described real property commonly known as 300 Half Day Road, Buffalo Grove, Illinois, has requested a variation from Sections 14.20.030 and 14.40.145 of the Sign Code for the purpose of installing an off - premises ground sign less than two hundred fifty feet (250') from an existing permanent ground sign, Section 14.40.020, for the purpose of installing a second ground sign (a Menu Board), and Section 14.20.080 for the purpose of installing a wall sign on the west elevation of the building that does not face a public right -of -way; and WHEREAS, the Zoning Board of Appeals has held a public hearing, received testimony, prepared minutes, made certain findings, and has made an affirmative recommendation on said request for variations; and WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby determine and find that said variations are in harmony with the general purpose and intent of the Sign Ordi- nance, and that (1) the ordinance in question would cause undue and unnecessary hardship to the sign user because of unique or unusual conditions pertaining to the property, (2) the granting of the requested variances will not be materially detrimental to the property owners in the vicinity, (3) the unusual conditions applying to the specific property do not apply generally to other properties in the Village, and (4) the granting of the variances will not be contrary to the 0 general objective of this title of moderating the size, number and obtrusive placement of signs and the reduction of clutter. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows: Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate Authorities. Section 2. Variations are hereby granted to Sections 14.20.030, 14.20.145, 14.40.020 and 14.20.080 of the Village Sign Ordinance to the property legally described in Exhibit "A" hereto. The specific variations are: 1. Ground Sign - An off - premises ground sign is to be permitted as shown Petitioner's Exhibit "A ". The sign is to be no greater than 9' in width and 10' in height and the brick base is to be 2'2" in height. The sign portion will be 7'10" without the Wendy's logo. The base of the sign will be landscaped with a variety of evergreens and other plants. The sign will be lighted only during the hours the store is open for business to the general public. The sign will be perpendicular to Route 22. 2. Menu Board - A second ground sign, a Menu Board, will be permitted as shown on Petitioner's Exhibit "A ", as revised. The sign will be 57" in height and will be landscaped with evergreen and plantings that are an approximate height of 6', so that car headlights will be shielded from Route 22. Petitioner will also provide landscaping in front of the angled parking spaces facing outside of the drive -up window pursuant to a landscape plan presented to the Board. 3. Wall Signs - Petitioner will be allowed to install a wall sign on the west elevation of the building, facing Buffalo Grove Road, per Exhibit E, but agrees to eliminate all wall signs on the southeast and north elevations of the building. Section 4. This Ordinance shall be in effect from and after its passage and approval. ZONING BOARD OF APPEALS NOVEMBER 17, 1998 - PAGE TWO Mr. Gylling said Wendy's does not have any alternate signs. The proposed signs are trademarks. Mr. Dragisic described the signs that have been requested: 1. The wall sign on the east elevation consists of illuminated channel letters. 2. An off - premise ground sign in front of the building that is less than 250 feet from an existing Woodland Commons ground sign. 3. A changeable copy menu board with a speaker pedestal. Graphic slicks that can be changed are used in place of lettering. Ch. Heinrich had no problem with the menu board. Com. Arbus said the menu board must be screened from Rt. 22. Mr. Gylling presented the landscape plan that includes plantings along Route 22. The shrubs are 36" and 24" and were intended to shield car headlights. The Village Forester has approved the plan. 1. Menu Board: Ch. Heinrich noted that the menu board on the site plan submitted to the ZBA is not in the same location as the one Mr.Gylling presented. The menu board will not be parallel to Route 22 and the lettering will not be seen. Mr. Gylling said this is a brand new prototype Wendy's building and there are only 2 or 3 in the whole country. Concessions were made to screen the trash enclosure with brick and raise the parapet to screen the HVAC equipment. The stacking lanes have been revised. The Village Board has approved the site plan and the landscaping. Ch. Heinrich said the residents, who were present at the last ZBA meeting, objected to the car lights shining out toward Route 22. The menu board is 517" in height and the shrubs in front of the driveway along Route 22 need to be to six feet (61) tall and they should be evergreens, not deciduous plants. ZONING BOARD OF APPEALS NOVEMBER 17, 1998 - PAGE THREE Mr. Gylling agreed to this stipulation. Com. Windecker said the menu board should be screened and the plantings in front of the cars should be six foot (61). Com. Paul said with proper screening he had no objections to the menu board. There are some parking spaces in front of the building that are angled toward Route 22. Mr. Gylling said most people will prefer to park on the other side of the building. This is a state right -of -way and it would require state approval to plant anything in front of these spaces. He will review this issue with the landscape architect. Com. Sandler agreed that the bushes should screen the driveway. 2. Wall Signs: After review of the wall signs on the south and west elevations, Mr. Gylling agreed to eliminate the one on the south elevation facing Route 22, because the ground sign will be sufficient identification of the building. 3. Ground Sign: Mr. Gylling said the ground sign will be installed on a 212" brick base that will match the building. It is not the standard Wendy's ground sign. The restaurant opens at 10 AM. It closes at midnight Monday through Thursday and closes at 1 AM on Saturday and Sunday. The lights will be on a timer and will not be left on all night. The base of the sign will be landscaped. The Commissioners had no objection to the ground sign if the wall sign on the south elevation is eliminated. There were no comments from the audience. ZONING BOARD OF APPEALS NOVEMBER 17, 1998 - PAGE FOUR Ch. Heinrich mentioned Tabling until December to permit the petitioners to consult the landscape architect with regard to the plantings in front of the drive -thru. Mr. Gylling said the configuration of the bed of plantings in front of the driveway could be straightened and planted with two rows of evergreens - one 6' and one 3' in height. They hope to open mid - January and it is necessary to have the signs approved on December 7th. He would prefer not to Table. Trustee Reid suggested making this a regular Agenda item. Ch. Heinrich agreed and said he would attend the meeting and the Village Board can address the landscape issue. Com. Petitioner also indicated the desire to provide landscaping in front of the angled parking spaces facing outside of the drive -up window. He will consult with the landscape architect and will present the revisions to the Village Board. 3. Wall Signs: Petitioner has agreed to amend the petition and eliminate the wall signs on the southeast and north elevations of the building and install a sign on the west elevation, facing Buffalo Grove Road, per Exhibit E submitted with the petition. Variance is recommended pursuant to Sign Code, Section 14.44.010, Sub - section B, per the testimony to be given at the Zoning Board of Appeals meeting. He informed Mr. Stewart that should one of the three(3) middle tenants prefer a different color, it would have to be submitted to the Appearance Commission for approval. Mr. Stewart agreed with these requests. The red would be Walgreens red and the green would be Mermaid #404. Mr. Stewart summarized the variations they are requesting. They are the Pharmacy and One Hour Photo signs on the north and west elevations of the Walgreens building and for the north and south elevations of the retail building for the corner tenants because they do not face a right -of -way. Johnson made a motion to recommend approval of the architecture, materials, colors, landscaping and lighting for the Walgreens and Retail Buildings at Buffalo Grove Road and Aptakisic Roads, as submitted, with a recommenda- tion for a variation for the number of signs per face on north and west elevations of the Walgreens building and the percentage size of the Drive Thru Pharmacy on the non- right- of -way face of the Walgreens building. The Wendy's architecture, materials and colors were reviewed on Septem- ber 24, 1998 and the petitioners were informed that some of the signs require variance of the Sign Code. APPEARANCE COMMISSION SEPTEMBER 24, 1998 - PAGE FIVE Mr. Dragisic said Wendy's has withdrawn the request to install a wall sign on the northeast elevation that faces he shopping center. He described the following signs and requested a recommendation for variances of the Sign Code: 1. Two (2) #WYL -36c signs, Wendy's with the cameo. Two (2) signs on the southeast and east elevations. The sign on the southeast elevation faces Half Day Road and is permitted. The sign on the right elevation (facing east) requires a variance. Colors will be Wendy's red with bronze returns. 2. One (1) Drive -Thru menu board with changeable copy and a speaker pedestal would located at the west end of the building. Monthly specials are depicted across the top four(4) sections of the menu board. Backgound color of these sections will match the menu board. The speaker is not attached to the menu board. 3. A second ground sign would be an off - premise sign and it would be located on the mall's property. A letter, dated August 27, 1998, from Wasily Demichow, Wendy's Project Manager, was submitted approving the installation of the proposed sign. This sign would be located approximately 170 feet from the existing Woodland Commons ground sign. The sign has a two foot two inch (21211) brick base (to match the building)and is ten feet (101)in height. It is fifty -four square feet (54 sf) in area if the space around the cameo is not included in the meaurement. Based on property frontage the Sign Code permits a sixty square foot (60 sf) ground sign. Ch. Gordon asked if the height of the base could be reduced and Mr.Dragisic responded the 212" base permits snow removal without damage to the sign. Com. Johnson suggested an alternate location of the sign on the island at the east corner of the property. This would be farther away Woodland Commons ground sign, but part of this island is not located on the Wendy's parcel. APPEARANCE COMMISSION SEPTEMBER 24, 1998 - PAGE SIX Mr. Dragisic said he could not be sure if the sign would fit on the island and permit any landscaping around the base. Another thing to consider would be if there is a setback issue. The proposed location does not obstruct traffic and is perferred. Ch. Gordon agreed that the island would be a more prefera- ble location for the ground sign and the Appearance Commis- sion can recommend it to the ZBA and Village Board. This would be an issue for Staff to review. Com. Johnson made a recommendation to the Zoning Board of Appeals and Village Board to grant variances of the Sign Code that have been requested by Wendy's at 300 Half Day Road, Woodland Commons Shopping Center. The Appearance Commission further recommends consideration that the ground sign be relocated to the southeast corner of the site to increase the distance from the Woodland Commons ground sign. Com. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows: Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate Authorities. Section 2. The sign will be perpendicular to Route 22. 2. Menu Board - A second ground sign, a Menu Board, will be permitted as shown on Petitioner's Exhibit "A ", as revised. The sign will be 57" in height and will be landscaped with evergreen and plantings that are an approximate height of 6', so that car headlights will be shielded from Route 22. Petitioner will also provide landscaping in front of the angled parking spaces facing outside of the drive -up window pursuant to a landscape plan presented to the Board. 3. Wall Signs - Petitioner will be allowed to install a wall sign on the west elevation of the building, facing Buffalo Grove Road, per Exhibit E, but agrees to eliminate all wall signs on the southeast and north elevations of the building. Section 4. This Ordinance shall be in effect from and after its passage and approval.
