1998-028e • ORDINANCE NO. 98- 28 AN ORDINANCE CREATING CHAPTER 5.64, GARAGE SALES OF THE VILLAGE OF BUFFALO GROVE MUNICIPAL CODE WHEREAS, the Village of Buffalo Grove (the "Village ") is a home -rule municipality in accordance with the Constitution of the State of Illinois of 1970; and WHEREAS, the Village has the authority to adopt ordinances and to promulgate rules and regulations that pertain to its government and affairs and that protect the public health, safety and welfare of its citizens. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Buffalo Grove as follows: Section 1. Chapter 5.64, Garage Sales, is hereby added to the Village of Buffalo Municipal Code, to read as follows: CHAPTER 5.64 Garage Sales 5.64.010 Definition. The term "garage sale" includes all general sales open to the public, conducted from a residential premise for the purpose of disposing of personal property including, but not limited to, all sales entitled "garage ", "lawn ", "yard ", "attic, "porch ", "room ", "backyard ", "patio ", "flea market", "rummage ", "estate ", or "moving" sale. Bulk sales, the sale of multiple new items of the same description and the sale of consigned merchandise, merchandise brought to the premises for resale or for reconditioning for resale are prohibited. 5.64.020 Permit required. It shall be unlawful for any person to conduct or allow the conducting of a garage sale as defined herein on premises zoned or used for residential purposes without first obtaining a Village permit to conduct such sale. The fee for a garage sale permit shall be Three Dollars ($3.00). The permit shall be in the form of a garage sale sign, which shall be prominently displayed on the premise covered by the permit in such a manner as to be easily visible to persons passing by the premises. 5.64.030 Limit on Length and Frequency of Sales. Garage sales shall be permitted for three (3) consecutive days between the hours of nine o'clock (9:00) a.m. and sunset of each day. Not more than three (3) garage sales shall be conducted on the same premises within any calendar year or by the same person(s) within any calendar year. 5.64.040 Location of Sale. It shall be unlawful for any person to use the public sidewalk or public right of way for the purpose of a garage sale or to display personal property for such sale. o • 5.64.050 Violation - Penalty. Any person violating the provisions of this Chapter shall be subject to penalties prescribed in Chapter 1.08. Section 2. Subsection A of Section 14.36.010 of the Village of Buffalo Grove Municipal Code is hereby amended to read as follows: 14.36.010 Designated. The following signs are exempt from Sections 14.12.010, 14.12.030, 14.12.060 (except subsection C), and 14.12.090 through 14.12.110: A. Directional or Instructional Signs. Signs which provide direction or instruction and are located entirely on the property to which they pertain and do not in any way advertise a business and do not exceed four square feet in area, signs identifying rest rooms, public telephones, walkways, or signs providing direction such as parking lot entrance and exit signs and those of similar nature Section 3. This ordinance shall be in effect from and after is passage, approval and publication. This ordinance may be published in pamphlet form.
