AN ORDINANCE AMENDING CHAPTER 5.32 TOBACCO AND
CHAPTER 10.18 ENFORCEMENT AND PENALTY OF
THE VILLAGE OF BUFFALO GROVE MUNICIPAL CODE
+ + AS, the Village of Buffalo Grove is an Illinois Home Rule Unit pursuant to
the Illinois Constitution of 1970.
NOW THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES,
ILLINOIS:
Section 1 Section 5.32.150 of the Village of Buffalo Grove Municipal Code is hereby
amended as follows:
5.32.150 Violation - Penalty.
A. Unless otherwise set forth in this Chapter, any person violating the provisions
of this Chapter shall be punished as provided in Chapter 1.08.
B. Any person violating Section 5.32.105 may be issued a citation as set forth in
Chapter 10.18.
The following options, as determined by the Village, may be appropriate dispositions
for any person violating Section 5.32.105:
1. Satisfy the citation as set forth in Chapter 10. 18, or
2. In lieu of a fine, be released upon supervision under the direction and
control of the Juvenile Officer of the Village's Police Department.
Release on supervision shall be on the condition that the person perform
community service. Five (5) hours of community service shall be
performed within fourteen (14) days of the violation, or
3. In lieu of a fine, be released upon supervision under the direction and
control of the Juvenile Officer of the Village's Police Department.
Release on supervision shall be on the condition that the person
complete participation in the Village's Tobacco Awareness Education
Program within thirty -five (35) days of the violation.
4. For any person not fulfilling the foregoing options within the time
specified, the Village has the option to file a complaint and prosecute
in the Circuit Court.

C. The foregoing options, under subsection B shall not be available to any person with
multiple violations of Section 5.32.105.
Section 2. Subsections A.21, B.21, C.21 and D.21 are added to Section 10.18.030 of the
Village of Buffalo Grove Muncipal Code, to read as follows:
A.21. Minors in possession of tobacco
B.21. Minors in possession of tobacco
$50.00
$75.00
C.21. Minors in possession of tobacco $100.00
D.21. Minors in possession of tobacco $150.00
Section 3. This ordinance shall be in full force and effect from and after its passage, approval
and publication.
