1998-019ORDINANCE NO. 98- 19 GRANTING VARIANCES FROM SECTIONS 14.20.0309 14.20.070 & 14.20.080 OF THE BUFFALO GROVE SIGN ORDINANCE WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS, SHELL OIL COMPANY, Owner of the hereinafter legally described real property commonly known as the "southwest corner of Illinois Route 83 and Arlington Heights Road" has requested variations from Sections 14.20.030, 14.20.070 and 14.20.080 of the Buffalo Grove Sign Ordinance for the purpose of permitting signage to be installed at the Shell Oil /McDonald's facilities located at said southwest corner; and WHEREAS, the Zoning Board of Appeals has held a public hearing, received testimony, prepared minutes, made certain findings, and has made an affirmative recommendation on said request for variations; and WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby determine and find that said variations are in harmony with the general purpose and intent of the Sign Ordi- nance, and that (1) the ordinance in question would cause some hardship to the sign user, (2) the proposed signage is of particularly good design and in particularly good taste; and (3) the entire site has been particularly well - landscaped. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows: Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate Authorities. Section 2. Variations are hereby granted to Sections 14.20.030, 14.20.070 and 14.20.080 of the Village Zoning Ordinance to the following legally described real property: That part of the northeast 1/4 of the southeast 1/ of Section 30, Township 43 North, Range 11, East of the Third Principal Meridian, described as follows: Commencing at the intersection of the center line of Illinois Route 83 with the east line of said quarter quarter section; thence south along the east line of the northeast 1/4 of the southeast 1/4 aforesaid, 338.24 feet; thence west at right angles to said east line 520.0 feet; thence north parallel with the east line of said quarter quarter section 493.65 feet, more or less, to the center line of Illinois Route 83; thence southeasterly along the center line of said road 542.73 feet to the point of beginning (except that part described as following: Beginning at the intersection of the centerline of Illinois Route 83 and the east line of said southeast 1/4; thence northwesterly 543.22 feet along said centerline on an assumed bearing of north 73 degrees 11 minutes 03 seconds west, to the grantor's west property line; thence south 00 degrees 07 minutes 34 seconds west, 73.08 feet along the said west ppty line; thence south 73 degrees 11 minutes 03 seconds east, parallel with the centerline of said Illinois Route 83, 401.47 feet, thence southeasterly 153.64 feet along a tangential curve concave to the southwest and having a radius of 120.00 feet, central angle 73 degrees 21 minutes 36 seconds; thence south 00 degrees 10 minutes 33 seconds west 165.58 feet along the westerly right of way line of Arlington WM Heights Road as per Document 1685014; thence southwesterly 39.27 feet along a tangential curve, concave to the northwest and having a radius of 25.00 feet, central angle 89 degrees 59 minutes 41 seconds; thence south 89 degrees 49 minutes 46 seconds east, 75.13 feet to the east line of the southeast '/a of said Section 30; thence north 00 degrees 10 minutes 25 seconds east 338.04 feet along said east line to the point of beginning) in Lake County, Illinois. The specific variations are to permit variations to Section 14.20.030 pertaining to Business District Signs; Section 14.20.070 pertaining to Ground Signs; and Section 14.20.080 pertaining to Wall Signs pursuant to the Findings of Fact by the Zoning Board of Appeals and the following plans which are all stamped received by the Village Building and Zoning Department on January 8, 1998: (1) Sign Elevations (one sheet) (except "Sign H" shall be fifteen feet (15') in height and not twenty feet (20') in height); (2) Oil 1511 Building (two sheets - sheet A -2 and A -3); and (3) Car Wash Elevation and Gas Canopy Elevation (untitled) (one sheet). These variations are subject to the following conditions: (1)the McDonald's signs be separately lighted and turned off at those times when McDonald's is not open and operating; (2) the pole sign at the corner (labeled "Sign H ") not exceed fifteen feet (15') in height and be setback twenty feet (20') from the property line; (3) the number and location of signs be installed in accordance with the plans approved herein; and (4) that both Shell Oil and McDonald's names and logos be permitted on all three (3) ground signs. -3- Section 3. This Ordinance shall be in effect from and after its passage and approval. This Ordinance shall not be codified.
