1997-085• ORDINANCE NO. 97- 85 GRANTING A VARIANCE FROM SECTION 14.20.010 OF THE BUFFALO GROVE SIGN ORDINANCE WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS, COVINGTON MANOR CONDOMINIUM ASSOCIATION, owner of the hereinafter legally described real property, commonly known as 351 -367 Parkview Terrace, Buffalo Grove, Illinois, has requested a variation from Section 14.20.010 of the Buffalo Grove Sign Ordinance relative to the requirement of not allowing any ground sign to be located within the required setback, and WHEREAS, the Zoning Board of Appeals has held a public hearing, received testimony, prepared minutes, made certain findings, and has made an affirmative recommen- dation on said request for variations; and WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby determine and find that said variations are in harmony with the general purpose and intent of the Sign Ordinance, and that (1) the ordinance in question would cause undue and unneces- sary hardship to the sign user because of unique or unusual conditions pertaining to the property, (2) the granting of the requested variance will not be materially detrimental to the property owners in the vicinity, (3) the unusual conditions applying to the specific property do not apply generally to other properties in the Village, and (4) the granting of the variance will not be contrary to the general objective of this title of moderating the size, number and obtrusive placement of signs and the reduction of clutter; • NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows: Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate Authorities. Section 2. Variations are hereby granted to Section 14.20.010 of the Village Sign Ordinance to the following legally described real property: PARCEL "A" (Original Parcel) Of that part of Lot 1 of "CEDAR VIEW PHASE I" being a subdivision of part of the East half of the Northwest quarter of Section 8, Township 42 North, Range 11, East of the Third Principal Meridian, according to the plat thereof recorded in the Cook County Recor- der's Office on July 11, 1984 as Document No. 27168381 described as follows: Beginning at the Northeast corner line of Lot 1 in said "CEDAR VIEW PHASE I "; thence along the North line of said Lot 1 North 89 degrees 28' 40" West a distance of 300.14 feet; thence South 00 degrees 31' 20" West a distance of 111.00 feet; thence South 89 degrees 28' 40" East a distance of 301.15 feet to a point on the East line of said Lot 1; thence along the East line of said Lot 1 North 00 degrees 00' East a distance of 111.00 feet to the point of beginning. The specific variation is to allow the installation of a new ground sign within the required setback at the southwest corner of Golfview Terrace and Park View Terrace. The sign variance is subject to the following conditions: i) Placement of the sign shall not be within forty-two (42') of the curblines projected, per the Village Engineer's Review, dated October 28, 1997. ii) The sign shall be constructed in accordance with the exhibits submitted to the Zoning Board of Appeals Section 3. This Ordinance shall be in effect from and after its passage and approval. This Ordinance shall not be codified.
