1997-012i • ORDINANCE NO. 97- 12 GRANTING A VARIANCE FROM SECTIONS 14 20 030 and 14 20 080 OF THE BUFFALO GROVE SIGN ORDINANCE WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS, DENNIS SNYDER, of Edward Jones Investments, the Lessee of the hereinafter legally described real property common- ly known as 826 South Buffalo Grove Road, Buffalo Grove, Illi- nois, has requested a variation from Sections 14.20.030 and 14.20.080 of the Buffalo Grove Sign Ordinance relative to the re- quirement of not allowing a wall sign for an occupancy within a developed parcel unless the parcel has frontage on a street; and, WHEREAS, the Zoning Board of Appeals has held a public hearing, received testimony, prepared minutes, made certain findings, and has made an affirmative recommendation on said request for variation; and WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby determine and find that said variation is in harmony with the general purpose and intent of the Sign Ordinance, and that (1) the ordinance in question would cause undue and unneces- sary hardship to the sign user because of unique or unusual conditions pertaining to the property, (2) the granting of the requested variance will not be materially detrimental to the property owners in the vicinity, (3) the unusual conditions applying to the specific property do not apply generally to other properties in the Village, and (4) the granting of the variance 1 E • will not be contrary to the general objective of this title of moderating the size, number and obtrusive placement of signs and the reduction of clutter. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows: Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate Authorities. Section 2. A variation is hereby granted to Sections 14.20.030 and 14.20.080 of the Village Sign Code Ordinance to the following legally described real property: Lot 1 in Ranch Mart Subdivision, being a subdi- vision in the West 3/4 of the Southwest 1/4 of Section 4, Township 42 North, East of the Third Principal Meridian, in Cook County, Illinois. The specific variation is to permit the installation of a wall sign on the south elevation of the shopping center to identify Edward Jones Investments, pursuant to Petitioner's Exhibit "E"; and This variation is conditioned upon the signs being construct- ed in compliance with the plans and exhibits submitted to and approved by the Village and the sign conforming to the sign criteria for the Plaza At Buffalo Grove, as amended on December 2, 1996. Section 3. This Ordinance shall be in effect from and after its passage and approval.
