1996-07210/15/96 ORDINANCE NO. 96 -72 AN ORDINANCE PROVIDING FOR THE RECOUPMENT OF ADVANCES FOR CONSTRUCTION OF STORM SEWERS WHEREAS, the Village S9 1 673 1 Ljjje 6ffyfReyerd in: NARY ELLEN VANDERVENTER - RECORDER On Jan 03 1997 At 10:25x■ Receipt 40466 Doc/Type DeputY - Cashier 03RD of Buffalo Grove, Cook and Lake Counties, Illinois, hereinafter referred to as "Village" and Ice Associates, L.L.C.( "Developer "), have agreed, that inasmuch as the storm sewer constructed would benefit neighboring properties not owned by the Developer, the Developer should recover a proportionate amount of the cost of construction from the benefited owners, and; WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois Constitution of 1970; and, WHEREAS, the property benefited, as shown on Exhibit "A" attached hereto and made a part hereof, is described as follows: Property 1. That part of the Southwest 1/4 of the Northwest 1/4 of Section 27 and that part of the Southeast 1/4 of the Northeast 1/4 of Section 28, Township 43 North, Range 11 East, of the third Principal Meridian in Lake County, Illinois, lying West of the Wisconsin Central Ltd. Railroad (formerly the Soo Line Railroad) , South of a line 680.00 feet North of and parallel to the North line of Lot 5 and North of a line 393.63 North of and parallel to the North line of Lot 5 in the Abbott Business Center Subdivision, recorded July 9, 1991, as Document No. 3038077 and East of the East line of the Tract described in Document No. 3832991. WHEREAS, it has been estimated that the amount to be recaptured for the cost of the storm sewer is as follows: Connection to Existing @ $1,000.00 15 L.F. - 15" R.C.C.P. @ $20.00 265 L.F. - 18" R.C.C.P. @ $25.00 1 - 60" Manhole @ $1,600.00 2 - 48" Manhole @ $1,300.00 110 C.Y. Spoil Removal @ $12.00 TOTAL Less Benefit to Developer Recapture Cost Engineering (2.5%) Review and Inspection (3.5 %) TOTAL RECAPTURE COST $ 1,000.00 140.00 6,625.00 1,600.00 2,600.00 ON I W01,11 $15,685.00 13,360.00 2,325.00 58.12 81.38 $ 2,464.50 WHEREAS, it has been agreed that the estimate amount to be recaptured from the benefited property is as follows: PROPERTY PROPORTIONAL SHARE COST 1 10006 $2,464.50 WHEREAS, the Village and Developer have agreed that payment shall be made in accordance with the actual costs of the project which shall be submitted to the Village upon completion and approved by the Village Engineer. 2 a "16' 31 NOW, THEREFORE, be it ordained by the President and Board of Trustees of the Village of Buffalo Grove, Cook and Lake Counties, Illinois; SECTION 1. The hereinbefore stated whereas clauses are incorporated herein and made a part hereof. SECTION 2. No person, firm, or corporation as owner of, or party interested in, or any contractor, agent, or other representatives of such owners or party interested in the property set forth above, shall connect to or tap onto the improvement described without having first obtained a permit from the Village. No permit shall be issued unless the applicant shall pay the actual cost of construction as approved by the Village Engineer plus interest at the rate of six percent (6 %) per annum computed from the date of final acceptance by the Village of the project construction. The fee shall be paid in one lump by the applicant. Only one basic fee shall be recovered from the parcel. The same shall be paid in one lump sum by the first applicant. SECTION 3. All monies collected from the applicant for such permit shall be remitted to Buffalo Grove. Five percent (5 %) of all monies collected shall be retained by the Village as the cost of collection. 3 3916'731 SECTION 4. Any person, firm, or corporation being the owners or any parties interested in any property herein above described or any contractor, agent, or representative of such person, firm, or corporation making any connection with the above improvements without first making application and paying the amount required shall be subject to a fine of not less than $50.00 or no more than $500.00 upon conviction thereof, and the Village shall have the right to enter on the property without notice or permission and remove all such connections so made. SECTION 5. The improvement described shall be a public improvement and title shall be vested in the Village. Nothing herein contained shall vest any proprietary rights in said improvement in the Developer. 4 3916731 9 SECTION 6. This Ordinance shall be in full force and effect from and after its passage, approval and publication. This Ordinance shall not be codified in pamphlet form. NOW, THEREFORE, be it ordained by the President and Board of Trustees of the Village of Buffalo Grove, Cook and Lake Counties, Illinois; SECTION 1.
