1996-041• ORDINANCE NO. 96- 41 AN ORDINANCE ADDING CHAPTER 3.52 OF THE VILLAGE OF BUFFALO GROVE MUNICIPAL CODE ESTABLISHING MUNICIPAL COMMUTER STATION PARKING LOT FEES WHEREAS, the Village of Buffalo Grove is a Home Rule municipality pursuant to the Illinois Constitution of 1970; and WHEREAS, a Commuter Station Development Agreement dated May 24, 1995 between the Village of Buffalo Grove and the Commuter Rail Division of the Regional Transportation Authority set forth, amongst other items, the general terms and conditions necessary to be followed in the operation of the commuter station parking lot; and WHEREAS, one of the terms and conditions of the Agreement is the necessity to establish fees for the use of the parking facilities that are adequate to defray the Village's operation, maintenance, debt service, lease fees, capital cost recovery, capital reserves and administrative expenses for the operation of the parking facilities; and WHEREAS, any fees that are to be established shall be standardized for all patrons of the parking facilities and shall in no circumstances discriminate against non - residents of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, the following: SECTION 1. There is hereby added Chapter 3.52, Municipal Commuter Station Parking Lot Fees, to the Village of Buffalo Grove Municipal Code, which is to read as follows: CHAPTER 3.52 MUNICIPAL COMMUTER STATION PARKING LOT FEES 3.52.010 3.52.020 3.52.030 3.52.040 3.52.050 3.52.060 Section 3:52.010, Definitions. Definitions Daily Fee Convenience Permit System Resident Parking Refunds Violation - Penalty A. For purposes of this Chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning: 1. "Daily Fee" means the amount required to be paid, as set forth from time -to -time in this Chapter, for the purpose of parking within the Village's commuter parking lot that will be deposited into the appropriate fee collection system established by the Village. The payment of this fee only permits parking for the date of such payment. 2. "Convenience Permit System" means a system that permits the pre- payment of daily fees for a two - month, pre - established period of time as set forth by the Village. Section 3.52.020, Daily Fee. The Daily Fee established for the purpose of parking within the Village's commuter parking lot shall be one Dollar and Fifty Cents ($1.50). The Daily Fee shall be deposited in the appropriate fee collection system to be established by the Village. The fee collection system will be established that permits the identification of a parking space with the appropriate area. The Daily Fee shall only be required to be paid Monday through Friday with the exception being national or state holidays that are observed on any of these days. Weekend parking shall be considered a no -cost use of the Village commuter parking lot. Section 3.52.030, Convenience Parking System Fee. A fee of Sixty Dollars ($60.00) shall be established for the purpose of parking for a defined two -month period within the Village's commuter parking lot. A tag or visor hanger will be sold bi- monthly for the following periods: January- February March -April May -June July- August September- October November - December The number of such tags or hangers will be limited to 250 in any bi- monthly period. The fee for purchase subsequent to the beginning of any bi- monthly period shall be pro -rated as follows: 1st through 15th of first month $60.00 16th through end of first month $45.00 lst through 15th of second month $30.00 16th through end of second month $15.00 The purchase of a convenience parking permit shall not guarantee a purchaser a parking spot within the Village's commuter parking lot. Section 3.52.040, Resident Parking. Twenty -Five percent (25 %) of the total number of parking stalls shall be reserved for Village resident -only parking. Such designated stalls shall be appropriately marked and identified. Proof of residency shall be evidenced by the purchase of a Village of Buffalo Grove vehicle sticker for the applicable sales period. The sale of Village vehicle stickers shall be governed by the terms and conditions of Chapter 10.04 of the Village of Buffalo Grove Municipal Code. Section 3.52.050, Refunds. No refund of fees paid for the purchase of convenience parking permits shall be made for whatever reason after the 15th day of the first month of any bi- monthly period. Prior to the 15th day of the first month, the amount of refund shall be Forty -Five Dollars ($45.00). Section 3.52.060, Violation - Penalty. Any person violating any of the provisions or failing to comply with any of the requirements of this Chapter will be subject to the general penalty provisions of Chapter 1.08 of the Village of Buffalo Grove Municipal Code. SECTION 2. SeverabilitX. If any provision of this Ordinance, or the application of any provision of this Ordinance is held unconstitutional or otherwise invalid, such occurrence shall not affect other provisions of this Ordinance, or their application, that can be given effect without constitutional or invalid provision or its application. Each unconstitutional or invalid provision, or application of such provision is severable, unless otherwise provided by this Ordinance. SECTION 3. The Village Clerk is hereby authorized to publish this Ordinance in pamphlet form. SECTION 4. This Ordinance shall be in full force and effect from and after its passage, approval and publication.
