(B) 8/28/95 ORDINANCE NO. 95 - 85 ORDINANCE AUTHORIZING ACQUISITION OF REAL PROPERTY WHEREAS, the President and Board of Trustees of the Village of Buffalo Grove have adopted a plan for the acquisition of certain properties hereinafter described for municipal purposes: BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES'OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, THAT: Section 1. The real estate hereinafter described is hereby determined to be useful, advantageous, necessary and desirable and in the best public interest to be acquired by the Village of Buffalo Grove for municipal purposes. Section 2. It is hereby determined that an easement in the real estate hereinafter described be acquired and be used, occupied and developed for those purposes as set forth in Section 1 hereof. Section 3. That the real estate hereinafter described is privately owned and is legally described in Exhibit "A" attached hereto and made a part hereof. Section.4. That William Raysa and Richard Skelton, Attorneys for the Village of Buffalo Grove, be and hereby are authorized, empowered and directed to cause said property to be appraised by independent qualified real estate appraisers, to determine title to said real estate, to cause said real estate to be surveyed, bored or platted as may be necessary, to offer to purchase said property from the owner or owners, subject only final approval of this Board, and otherwise attempt to agree on behalf of the Village of Buffalo Grove with the owner or owners of the lands hereinbefore described for the purchase thereof by the Village of Buffalo Grove. Section 5. That in the event the compensation to be paid for said parcel of land cannot be agreed upon with the owner or owners of said land, or in the event the owners or persons with interest i of title cannot be located, or ascertained, then William Raysa and Richard Skelton, Attorneys for the Village of Buffalo Grove, shall be, and they are hereby authorized, instructed and directed to institute and maintain in the name of and on behalf of the Village of Buffalo Grove, in a court of competent jurisdiction such proceedings as may be appropriate under the laws of the State of Illinois relating to the exercise of the right of the eminent domain and such other statutes as may be applicable, for the condemnation of said parcel of property or such part or parts thereof as may not have been acquired by purchase. Section 6. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed insofar as they conflict herewith. Section 7.
