1994-0609/7/94 ORDINANCE NO. 94-60 WEAPONS SALES CONTROL ORDINANCE WHEREAS, the Village of Buffalo Grove is a Home Unit pursu- ant to the Illinois Constitution of 1970; and WHEREAS, firearms play a major role in the commission of homicide, aggravated assault, armed robbery and accidental injury and death; and WHEREAS, 1992 FBI statistics showed of the 23,760 murders committed in this country, 15,376 involved the use of firearms; and WHEREAS, the Corporate Authorities of the Village of Buffalo Grove believe that the easy and convenient availability of types of firearms and ammunition have increased the potentiality of firearm related deaths and injuries; and WHEREAS, the President and Board of Trustees of the Village of Buffalo Grove believe that it is necessary and desirable to protect the residents of the Village of Buffalo Grove from loss of property, death and injury by regulating the sale, and avail- ability of firearms in the community. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows: Section 1. The Corporate Authorities do hereby incorporate the foregoing WHEREAS clauses into this Ordinance, thereby making the legislative findings hereinabove set forth. 0 0 Section 2. There is hereby added to the Municipal Code of the Village of Buffalo Grove, Chapter 9.90, which is to read as follows: Chapter 9.90 Weapons Control Section 9.90.010 - Definitions. As used in this Chapter, the following words and phrases shall have the meaning ascribed to them: A. "Ammunition" means ammunition or cartridge cases, primers, bullets, or propellant powder designed for use in any firearm. B. "Commercially sell" means in the business of selling for compensation. C. "Firearm" means any device, by whatever name known, which is designed to expel a projectile or projectiles by the action of an explosion, expansion of gas or escape of gas; excluding, however: 1. any pneumatic gun, spring gun, paint ball gun or B- B gun which either expels a single globular projectile not exceeding .18 inch in diameter and which has a maximum muzzle velocity of less than 700 feet per second or break- able paint balls containing washable marking colors; 2. any device used exclusively for signalling or safety and required or recommended by the United States Coast Guard or the Interstate Commerce Commission; or -2- o 0 3. any device used exclusively for the firing of stud cartridges, explosive rivets or similar industrial ammuni- tion; 4. an antique firearm (other than a machine -gun) which, although designed as a weapon, the Department of State Police finds by reason of the date of its manufacture, value, design, and other characteristics is primarily a collector's item and is not likely to be used as a weapon. Section 9.90.020 - Sale of Firearms Prohibited. No person shall commercially sell for compensation any firearm. Section 9.90.030 - Ammunition. A. No person shall commercially sell for compensation any ammunition. B. No person shall engage in the business of manufac- turing, assembling, or reloading ammunition to commercially sell for compensation. Section 9.90.040 - Confiscation. A. Any firearm or ammunition obtained in violation of Sections 9.90.020 or 9.90.030 is hereby declared contraband and shall be confiscated. B. Any firearm or ammunition so confiscated, if not required for evidence, shall be retained for Police Depart- ment use or destroyed at the direction of the Village Chief of Police. -3- 0 0 Section 9.90.050 --Penalty. Any person who violates any provision of this Chapter shall be subject to a fine pursuant to Chapter 1.08. Section 3 - Severability If any section, subsection, paragraph, sentence or clause of this ordinance or the applica- tion thereof to any person is for any reason deemed to be invalid or unconstitutional, such decision shall not affect, impair or invalidate any remaining portion, section or part thereof or application of this ordinance to any other person. Section 4. This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form.
