1992-0788/19/92 ORDINANCE NO. 92- 78 AN ORDINANCE AMENDING SECTION BG -16 -104, PENALTIES, AND SECTION BG -16 -105, COMPLIANCE VIOLATION PENALTIES, OF THE VILLAGE OF BUFFALO GROVE MUNICIPAL CODE WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, THAT: Section 1: Subsections A.2., B.2. and C.2. of Section BG -16 -104 of Title 10 of the Village of Buffalo Grove Municipal Code is hereby amended to read as follows: BG -16 -104 Penalties: A.2. Dog at Large $30.00 B.2. Dog at Large $35.00 C.2. Dog at Large $45.00 Section 2: Section BG -16 -105 of Title 10 of the Village of Buffalo Grove Municipal Code is hereby amended to read as fol- lows: BG -16 -105 Compliance Violation Penalties: A. Any person accused of a violation of Section 10.04.020 of this Title, or violating Section 3 -401, 3 -701, 6 -101, 11 -1406, 11 -1411, 12 -101, 12- 201, 12 -202, 12 -204, 12- 205,.12- 209,12- 211(a), 12 -401, 12- 405(d), 12 -502, 12 -503, 12 -601, 12,602, 12 -603, 12- 603 -1, 12 -702, 12 -710, 13 -111, or 15 -104 of the Illinois Vehicle Code, as herein adopted, may settle and compromise the claim against him or her for such alleged violation as follows: (i) By paying to the Village within ten (10) days of the time such alleged offense was committed, the sum of Twenty -Five Dollars ($25.00). (ii) In the event payment is not received within said ten (10) days and Delinquent Notice has been mailed, then by paying to the Village the sum of Forty Dollars ($40.00). (iii) In the event payment is not received within the time prescribed in the Delinquent Notice, and a Notice to Appear has been served and a Complaint filed in the Circuit Court, then by paying to the Village the sum of Fifty Dol- lars ($50.00). (iv) In the event payment is not made prior to the date of the actual Court day, payment of any fine and costs shall be in such amounts as may be determined and estab= lished by the Circuit Court. B. Provided, however, the Village may, within its discretion, refuse to accept such compromise and settlement where there are aggravating circumstances surrounding the violation. A claim against an alleged offender of the sections set forth in this section shall be evidenced by the issuance of a "PCV" violation. Section 3: This ordinance shall be in full force and effect from and after its passage, approval and publication.
