A copy of said Agreement is attached hereto and made a part hereof. W I T N E S S E T H: WHEREAS, the parties may enter into this agreement as authorized by the Lake County Board of Health Ordinance Article X, Animal /Rabies Control, Section 18, and the Illinois Animal Control Act;, and, WHEREAS, in the interest of further inter - governmental cooperation, the parties have agreed to coordinate rabies and animal control services; and, WHEREAS, in the absence of coordination agreement, the rabies and animal control procedures of the Municipality and the rabies and animal control procedures of the Board of Health could duplicate and overlap; and, WHEREAS, the parties have determined that the following Agreement is in the mutual best interests of both Lake County and the Municipality; NOW, THEREFORE, in consideration of the mutual covenants herein contained, it is agreed by and between the parties hereto as follows: 1. The Municipality shall provide Lake County registration services for its residents and shall maintain a comprehensive listing of all animals registered in the village. 2. Any Municipality resident who purchases or displays a Village animal license at the time of purchase of a Lake County Rabies Registration will be permitted to pay a registration fee as follows: Rabies Surgically Animal Vac. Fee Spayed /Neutered Cat /Dog One Year $ 5.00 $ 2.00 Cat /Dog Three Year $13.00 $ 5.00 3. The Board of Health will supply Lake County tags to the Municipality for sale by the Municipality and the Municipality will remit any Lake County Rabies Registration fees collected to Lake County bimonthly. 4. The Board of Health shall impound and provide rabies observation by a licensed veterinarian for all stray biting animals delivered to the Lake County Shelter facility. The Municipality shall answer all health related animal calls made by the Municipality's residents for apprehending stray animals, a. biting stray animals or severely injured animals. The Lake County Board of Health or its agents shall not be responsible for any damages, injury or loss occurring prior to the delivery of animals to the Lake County Board of Health or its agents, and resulting from its participation in the Lake County Animal /Rabies Control Program. Cost of impoundment of animals other than biting animals will be billed at the rate of $12.00 per animal per day to the Municipality. 5. The Board of Health shall impound and provide rabies observation by a licensed veterinarian for all stray biting animals. The Board of Health shall investigate and transport to the State Laboratory all specimens of animals suspected of being rabid and which may have infected a person. 6. The Board of Health shall provide animal bite review and evaluation of all animal bite reports by medical personnel at no cost to the Municipality or its residents. 7. The Board of Health shall assist the Municipality with animal bite investigations. Upon receiving a report of an animal bite the investigating officer shall immediately report the animal bite information to the Board of Health. A completed AFFIDAVIT, supplied by Lake County, directing the animal owner to confine such animal for rabies observation shall be given to Lake County and the owner, keeper or harborer of the suspect animal. Follow -up activities for all reported animal bites shall be the responsibility of the Board of Health, the only exception will be for enforcement measures where the investigating officer is required. 8. The Board of Health shall maintain a comprehensive filing system of all animals registered in the Municipality, and other participating municipalities, and to make registration information available to authorized personnel for the investiga- tion of animal bites or for the return of lost animals. This information will be made available during Lake County business hours, except in the case of biting animals or severely injured animals, when a twenty -four (24) hour service shall be available. 9. The Board of Health will assist the Municipality when requests are made of the Lake County Sheriff's Department regard- ing the removal of animals through court ordered evictions. In the absence of the municipal warden or his representative, the Board of Health shall charge a service visit fee of $25.00 as stated in Section 10 of this Agreement. -2- 10. The Board of Health shall provide assistance to the Municipality for animal control services in the absence of the Village Warden or upon request of the Municipality on a utiliza- tion basis at a fee of $25.00 per service visit. Payments shall be made monthly to Lake County. The Municipality shall receive a monthly billing from Lake County stating the amount due based on the utilized services for the previous month. 11. The Board of Health shall provide educational materials, including posters and pamphlets, and other educational programs relating to rabies and animal control specifically directed toward youth, officials, and the general public. 12. The Board of Health and the Municipality agree that the animal controls services to be provided by Lake County hereunder shall be in addition to such services currently provided by the Municipality. In the event that the Municipality shall cease providing said services, this Agreement shall be void. 13. Both parties of this Agreement shall provide each other with a copy of their current Animal /Rabies Control Ordinance, if available, and shall notify each other of any revisions made to that Ordinance. 14. This Agreement shall be cancelable upon. sixty (60) days notice in writing to the other party. This Agreement shall be effective as of the date given above and shall be.subject to an annual review on the anniversary of the effective date. This Agreement shall remain in force from year to year thereafter without further action, but may be terminated by either party as provided in Section 14.
