AN ORDINANCE AMENDING CHAPTER 2.18
OF THE VILLAGE OF BUFFALO GROVE MUNICIPAL CODE
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit
pursuant to the Illinois Constitution of 1970; and
WHEREAS, Section 5 -25008 of Chapter 34 of the Illinois
Revised Statutes (1989) provides that a county health department does
not have jurisdiction within a village which maintains a local health
department and employs a full -time health officer; and
WHEREAS, the Illinois Attorney General Opinion No. S -1146
dated August 19, 1976, opines that a home rule municipality can enact
an ordinance conferring the exclusive jurisdiction to act in all
matters related to the health of its citizens upon a designated
municipal official or department; and
WHEREAS, the Village of Buffalo Grove maintains a local
health department and employs a full -time health officer; and
WHEREAS, the Village Board of Health recommends exclusive
jurisdiction in matters concerning retail food store and food service
sanitation rules and regulations;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES,
ILLINOIS, as follows:

SECTION 1: Chapter 2.18 of the Village of Buffalo Grove
Municipal Code is hereby amended by adding Section 2.18.055 as
follows:
2.18.055 Exclusive Jurisdiction. The Village of Buffalo Grove
hereby confers the exclusive jurisdiction to act in all matters
related to and concerning Retail Food Store and Food Service
Sanitation upon the Village's Health Department.
SECTION 2: The Village Clerk is directed to send a copy of
this ordinance to Lake County.
SECTION 3: That all ordinances and resolutions., or parts
thereof, in conflict with the provisions of this Ordinance are,
to the extent of such conflict, expressly repealed.
SECTION 4: That this Ordinance shall be in full force and effect
from and after its passage and approval.
