AN ORDINANCE ADDING CHAPTER 5.60
GOING OUT OF BUSINESS SALES TO THE
VILLAGE OF BUFFALO GROVE MUNICIPAL CODE
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit
pursuant to the Illinois Constitution of 1970; and
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT.AND BOARD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES,
ILLINOIS, as follows:
Section 1. There is hereby added to the Municipal Code of
the Village of Buffalo Grove Chapter 5.60, which is to read as
follows:

5.60.010 - Adoption of State Code. There is hereby
adopted for the purpose of regulating "going out of business
sales ", an Act of the State of Illinois, entitled: An Act
to Regulate the Sale, Representation and Advertising of
Goods, Wares or Merchandise to Prevent the Fraudulent Sale
Thereof, to Provide Penalties Therefor and to Repeal Act
Therein Named, approved July 23, 1959, as amended. (Chapter
121 -1/2, Illinois Revised Statutes, section 157.1 etc.)
5.60.020 - Termination of Lease. In addition to the
requirements of said State Act, if the applicant having a
going out of business license is a lessee on the premises
where the business is conducted, no such license shall be
issued hereunder and no such sale shall be conducted unless
the applicant has advised the lessor of the premises, in
writing, that the applicant requires that the existing lease
be terminated and that such request to terminate shall be
irrevocable during the period covered by the license.
5.60.030 - Business to Terminate. It shall be unlawful
for any licensee hereunder to continue in business or to
have an interest in any continuing business on the premises
where the going out of business sale took place for a period
of two (2) years after said sale. Each day that the
licensee continues in business in violation of this Section
shall be a separate offense.
.5.60.040 - Violation -- Penalty. In addition to the
penalty set forth in the State Act, any person violating the
provisions of this Chapter shall be punished as provided in
Chapter 1.08 hereof.
Section 2: This ordinance shall be effective from and after
its passage, approval and publication according to law. This
Ordinance may be published in pamphlet form.
