1988-081r o ORDINANCE NO. 88 -81 AN ORDINANCE APPROVING AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE VILLAGE OF VERNON HILLS AND THE VILLAGE OF BUFFALO GROVE WHEREAS, Article VII, Section 10 of the 1970 Constitution of the State of Illinois authorizes units of local government to contract and associate among themselves to obtain or share services and to exercise, combine, or transfer any power or function, in any manner not prohibited by law or ordinance; and WHEREAS, the Intergovernment Cooperation Act, as amended (Ill. Rev. Stat., Ch. 127, Paragraph 741 et seq.), also authorizes units of local government to exercise and enjoy jointly their powers, privileges or authority, and to enter into intergovernmental agreements for that purpose; and WHEREAS, the Village of Vernon Hills and the Village of Buffalo Grove desire to accommodate orderly development along their common border in the area of Port Clinton Road. THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Buffalo Grove, Cook and Lake Counties, Illinois, as follows: SECTION 1: The Intergovernmental Agreement between the Village of Vernon Hills and the Village of Buffalo Grove to Accommodate Orderly Development in the area of Port Clinton Road which Agreement is attached hereto and made a part hereof as Exhibit A, be and hereby is approved. SECTION 2: The Village President and Village Clerk are hereby authorized and directed to execute the aforesaid Agreement. o _ o SECTION 3: This Ordinance shall be effective from and after its passage and approval. Stat., ch. 127, s741 et seg.), also authorizes.. units of local government to exercise and enjoy jointly their powers, privileges or authority, and to enter into intergovernmental agreements for that purpose; and, WHEREAS, Vernon Hills and Buffalo Grove desire to accommodate orderly development along their common border in the area of Port Clinton Road; and, WHEREAS, co- operation between Vernon Hills and Buffalo Grove concerning drainage, sanitary sewerage, and street systems is necessary in order to. accommodate orderly development in each of the two village's in this area; and, - 1 - • o WHEREAS, improvements to Buffalo Grove Road and Port Clinton Road are recognized as being desirable involving one lane in each direction with a median initially and two lanes in each direction with a median ultimately; NOW, THEREFORE, it is hereby agreed as follows: I. STREET SYSTEMS A. The right -of -way width, location and aligment of Port Clinton Road and Buffalo Grove Road denoted on Exhibit 1 will be obtained.by each Village to the extent that the denoted right -of -way is located within each Village's corporate limits. B. It is agreed that it is contemplated that the developer of a property immediately south of Port Clinton Road as identified on Exhibit 1, known as the Amli -88 project shall construct the median and - center two lanes of Buffalo Grove Road /Port Clinton Road as denoted on Exhibit 2. Vernon Hills hereby grants permission and permits this work to proceed and in addition grants permission and permits -°the future expansion and addition as shown on Exhibit 1 for Buffalo Grove Road and Port Clinton Road. y C. Each Village will retain jurisdiction and maintenance responsibility of the portions of Buffalo Grove Road and Port Clinton Road which are currently located within their corporate limits. Vernon Hills agrees that they will not close or vacate the road in the future. D. It is agreed that a barrier median shall be maintained on Port Clinton Road so as to prohibit left turn movements into and out of any street in Vernon Hills. or Buffalo -Grove within the area of reduced width median (median with a - 2 - • _ o width of less than 16 feet) as denoted in Exhibit 1. E. Buffalo Grove and Vernon Hills will confer and enter into other agreements in the future as neccessary in order to accommodate any needed improvements along the portion of Buffalo Grove Road and Port Clinton Road denoted on Exhibit 1. Furthermore, Buffalo Grove and Vernon Hills acknowledge that the realignment and extension of Buffalo Grove Road to U.S. Route 45 is a necessary improvement and will confer as necessary in the future to further said extension. In addition, both municipalities agree to use their best efforts to provide r -o -w, solicit contributions and grants, and to co- ordinate with all Highway Transportation Agencies to assure the implementation of this important highway extension. F. Vernon Hills will complete the improvements to the Vernon township property required as a result of the Buffalo Grove Road right -of -way requirement. The requirements are denoted as items 1, 3, 4, 5, and 6 in the:August 30, 1988 letter from Vernon township, attached as Exhibit 6. II. SANITARY SEWERAGE SYSTEM A. Buffalo Grove will allow the 75 lot subdivision located in Vernon Hills denoted on Exhibit 3 to discharge into the Buffalo Grove sewerage system or proposed future sewerage system as also denoted on Exhibit 3 subject to the following conditions being caused to be met by Vernon Hills: 1. The entire sanitary sewerage system tributary to. Buffalo Grove's sewerage system shall be. constructed to standards equal or better than Buffalo GroW s Development Ordinance requirements. All 75 lots shall also have sump pump service connections to the storm sewer system constructed to standards equal or better than Buffalo Grove's Development Ordinance standards. - 3 - • o 2. The sewage flow from the 75 lot subdivision in Vernon Hills shall flow to a lift station which discharges through a force main to the connection with a Buffalo Grove sanitary man- hole as denoted in Exhibit 3. Buffalo Grove only agrees to serve 75`single family homes located in the 75 lot.subdivision denoted on Exhibit 3. 3. The flow out of the lift station shall be limited by a variable frequency drive (VFD)which is controlled by metered flow data. The maximum limit on the flow rate shall be 120,000 gallons per day (83 gallons per minute). The maximum total flow which shall be allowed over a 24 hour period is 30,000 gallons. 4. Access shall be provided for the Buffalo Grove Public Works staff to inspect the meter, VFD and pumping systems. 5. A telemetry and monitoring system shall be provided in accordance with Exhibit 4. 6. Before any connection to the Buffalo Grove sewerage system occurs, fees related to initial sewer construction and connection shall be paid to Buffalo Grove in the same amount as would have normally been paid if the 75 lot subdivision had been annexed to Buffalo Grove and covered by Buffalo Grove Recapture Agreements at the same rate per acre as charged to developments within Buffalo Grove. One exception to the normal fees which is agreed will not be required, is the engineering inspection fee (22 %) related to the 75 lot subdi- vision's collection sewerage system which - 4 - • o discharges to the lift station. Only the plan review fee (1 %) will be charged for the subdivision's collection sewerage system. The normal engineering review and inspection charge (32 %) shal -1 be required for the lift station, force main and telemetry monitoring system. A tabulation of these fees is denoted in Exhibit 5. 7. This agreement is contingent upon and subject to an acceptable agreement being entered into between Buffalo Grove and the Lake County Public Works Department-or Vernon Hills which shall provide for all long term operational aspects of this agreement to be adhered to. Buffalo Grove shall receive monthly payment from Vernon Hills for metered sewage flow. This payment shall be at the one and one -half (11) times the rate established by Buffalo Grove for sewerage service to residents of Buffalo Grove as may be amended from time to time in the future. 8. A second flow meter with vault and necessary telemetry /monitoring equipment and installation as described in Exhibit 4 shall be provided or caused to be provided by Vernon Hills. Buffalo Grove shall own and maintain the flow meter with vault and all telemetry equipment - following its complete installation and acceptance by Buffalo Grove's Village Engineer. - 5 - • o 9. Before Buffalo Grove executes any IEPA or other permit applications as an intermediate sewer operator, the Buffalo Grove Village Engineer shall be provided with complete plans and specifications related to the sewerage plans and drainage plans for the 75 lot subdivision denoted in Exhibit 3 and the Buffalo Grove Village Engineer shall be satisfied that all applicable Buffalo Grove standards and other requirements of this agreement are adhered to in the plans and specifications. 10. Before any sewage is discharged to the Buffalo Grove sewerage system, an Illinois registered Professional Engineer shall submit a certification that the completed construction conforms to the plans and specifications which were approved by the Buffalo Grove Village Engineer. Also, before any sewage is discharged to the Buffalo Grove sewage system, the BuffaT6- Grave Village Engineer shall perform any reviews or inspections he'deems necessary or appropriate to confirm that the _ provisions of this agreement and any applicable permits have been complied with. III. STORM DRAINAGE SYSTEM A. Within one year from the date of this agreement,.Vernon Hills agrees to provide, or cause to be provided, a storm sewer of a minimum diameter of 33 inches with an invert elevation of 675.00 USGS at the manhole denoted as the "Buffalo Grove Point of Connection" on Exhibit 3 and flowing on to the Indian Creek in a manner so as to cause no obstruction to flow at the denoted connection point. Vernon Hills also agrees to obtain a general drainage easement along the course of this storm sewer from the denoted point of connection to the Indian Creek. The grading along this easement shall be adequate to allow the flow of water from the area tributary to the storm sewer to flow over land in the case of obstruction of the storm sewer. This grading shall be sufficient to insure that the elevation of a 100 year storm flow will be no greater than 684.0 USGS at the denoted point of connection. The general drainage easement shall conform to Exhibit 3. Vernon Hills hereby agrees that Buffalo Grove may utilize the easement rights described herein and that Buffalo Grove is hereby permitted to utilize any Vernon Hills street right -of -ways along the described pipe to clear any drainage obstructions which may exist or which may occur in the future. This agreement shall be effective upon approvraT ty ordinance by the parties hereto. This agreement shall be effective for a term of 20 years after its effective date and may be renewed thereafter by mutual agreement by the parties hereto. ILt4k age Clerk (Seal.) - 7 - EXHIBIT 4 Telemetry and Monitoring System The telemetry and monitoring system shall include the provision, installation, start -up and other work and materials as follows: Flnw Mortar A highly accurate, reliable, sewage flow meter shall be provided and installed in a meter vault. The meter shall provide a pulse signal to a telemetry system to allow another device to compute totalized flow. The meter shall also provide a 4 to 20 ma output which varies linearly with the metered flow rate. The exact type, model, and manufacturer of this meter shall be as specified by the Buffalo Grove Village Engineer. Mortar Uault A concrete meter vault shall:be provided. The meter vault shall include a sump pump. The location and details -of the vault shall be as specified by the Buffalo Grove Village Engineer. - 'Monitoring Elements The system shall include devices which can identify and relate to a telemetry system, the following status and alarm conditions: Status - Entry status of equipment control tab4 tet Entry status of meter vault Alarms - Illegal entry of equipment control cabinet , Illegal entry of meter vault Power failure Communication failure Telemetry System A field confirmation of the feasibility of utilizing Buffalo Grove's current radio telemetry type system at this location shall be performed. If feasible, Buffalo Grove's current radio telemetry system shall be expanded'to communicate all flow rate, totalized flow and other required status and alarm signals to Buffalo Grove's existing central telemetry computer. Any necessary licensing shall be provided. If necessary, the Village Engineer shall specify an alternate telemetry system. J EXHIBIT 4 - cont'd Monitoring Output A new CRT-screen display denoting the current status of all monitored data shall be provided with a key stroke command on Buffalo Grove's existing CRT monitor. A format similar to other existing CRT screen displays shall be adhered to. A six color graphic printer shall be provided and shall give an automatically generated daily report denoting: 1. The total flow occurring during the past 24 hours. 2. The maximum flow rate observed in the past 24 hours. 3. A graph.of flow rate vs. time for the past 24 hours. A key stroke command to suspend and to resume printing each of these daily reports shall be provided. Submittal Requirements As -built drawings, 0 & M manual updating and shop drawings on all elements of the telemetry and monitoring system shall be provided to the satisfication of the Buffalo Grove Village Engineer. 0 EXHIBIT 5 All fees which must be paid to Buffalo Grove related.to Buffalo Grove allowing 75 lots in Vernon Hills to discharge to Buffalo Grove's sewerage system are as follows: 1. Lake County Tap -On Fee - $1,200.00 /lot x 75 lots = $90,000.00 2. Village Tap -On Fee - $843.43/acre x 27.0 /acre = $22,772.61 3.
