ORDINANCE NO. 88- 80
AN ORDINANCE AMENDING SECTIONS 10.04.030 AND 10.16.BG -16 OF
TITLE 10 OF THE VILLAGE OF BUFFALO GROVE MUNICIPAL CODE
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to
the Illinois Constitution of 1970; and
WHEREAS, the Village of Buffalo Grove desires that the owners of
registered vehicles be compliant with the requirement to annually purchase
vehicle registration stickers; and
WHEREAS, to encourage owners of registered vehicles to purchase the
vehicle stickers by the due date, the penalties for non - compliance will be
increased to show the Villages commitment to ensure that vehicle sticker
purchases are made.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS that:
SECTION 1. Title 10, Chapter 10.04, Section 10.04.030 Fees - Designated,
Section H of the Village of Buffalo Grove Municipal Code is amended to read
as follows:
10.04.030 Fees - Designated
H. All passenger vehicles regardless of horsepower, all recreational
vehicles, and all trucks regardless of gross weight that are
licensed on or after January sixteenth of any year will be charged
an additional ten dollars ($10.00) as a late purchase penalty. The
assessment of this charge will not apply to senior citizens,
handicapped, purchases of new vehicles, new resident or commercial
vehicle purchases, or transfers from existing registration at any
time during the registration period.
SECTION 2. Title 10, Chapter BG -16, Section BG -16 -105, Subsection A,
Compliance Violation Penalties of the Village of Buffalo Grove Municipal Code
is amended to read as follows:
BG -16 -105 Compliance Violation Penalties
A. Any person accused of a violation of Section 10.04.020 of this
Title, or violating Section 3 -401, 3 -701, 11 -1406, 11 -1411, 12 -101,
12 -201, 12 -202, 12 -204, 12 -205, 12 -209, 12- 211(a), 12 -401,
12- 405(d), 12 -502, 12 -503, 12 -601, 12 -602, 12 -603, 12 -702, 12 -710,
13 -111, or 15 -104 of the Illinois Vehicle Code, as herein adopted

may settle or compromise the claim against him or her for such
alleged violation as follows:
(i) by paying to the Village within ten (10) days of the,
time of such alleged offense was committed, the sum of Fifteen
Dollars ($15.00), except for violation of Section 10.04.020, where
the sum of Twenty -Five Dollars ($25.00) will be due, and presenting
to the Village proof of compliance with the section allegedly
violated;
(ii) in the event payment is not received within said ten (10)
days and Final Notice has been mailed, then by paying to the
Village the sum of Twenty Dollars ($20.00) except for violation of
Section 10.04.020, where the sum of Thirty Dollars ($30.00) will be
due, and presenting to the Village proof of compliance with the
section allegedly violated;
(iii) in the event payment is not received within the time
prescribed in the Final Notice, and a Notice To Appear has been
served and a Complaint filed in the Circuit Court, then by paying
to the Village the sum of Twenty -Five Dollars ($25.00), except for
violation of Section 10.04.020, where the sum of Thirty -Five
($35.00) will be due, and presenting to the Village proof of
compliance with the section allegedly violated;
(iv) in the event payment is not made prior to the date of
the actual Court day, payment of any fine and costs, shall be in
such amounts as may be determined and established by the Circuit
Court.
Provided, however, the municipality may, within its discretion,
refuse to accept such compromise and settlement where there are
aggravating circumstances surrounding the violation. A claim
against an alleged offender of the sections set forth in this
section shall be evidenced by the issuance of a "PCV" violation.
SECTION 3. This ordinance shall be in full force and effect from and
after its passage, approval and publication in the manner provided by law.
This ordinance shall be effective as of January 1, 1989.
