1987-0659/17/87 • ORDINANCE NO. 87- 65 • AN ORDINANCE AMENDING THE APPEARANCE PLAN OF THE VILLAGE OF BUFFALO GROVE WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS, Village Ordinance No. 72 -12, as amended by Ordi- nance Nos. 74 -38 and 76 -24, established an Appearance Commission and an Appearance Code for the Village; and WHEREAS, Village Ordinance No. 73 -54, as amended by Ordinance No. 81 -20, approved an Appearance Plan for the Village; and WHEREAS, the Corporate Authorities have determined this ordinance to be in the best interest of the public health, safety and welfare of its citizens and that the Corporate Authorities have also determined that the Village of Buffalo Grove should be beautiful as well as healthy, spacious, clean and well balanced. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: Section 1. Section IIA., AREAS AND ELEMENTS UNDER JURISDICTION of Exhibit A to Ordinance No. 73 -54, as amended, is hereby further amended as follows: SECTION IIA: AREAS AND ELEMENTS UNDER JURISIDICTION 1. The Appearance Ordinance provides that the juris- dictional areas of the Appearance Commission are areas within all the Zoning Districts of the Village including public lands and planned developments. These areas include both privately and publicly owned properties. Elements within these areas include: a) Improved and unimproved land, including open spaces, streets and parkways, playgrounds, gardens, malls, streams, yards, rights -of -way and other elements. b) External architectural features of buildings and structures of all types, existing and future, visible to the eye, and above grade. , c) Landscaping, land topography and plant life, natural and man -made. d) Walks, drives, paths, parking areas and plazas. e) Exterior furniture, hardware, signs and markers, posts and fences, barriers, lights and lighting, supplementary structures and appurtenances. 2. The purpose of these criteria is to establish a checklist of those items which affect the physical aspect of the Village environment. Pertinent to appearance is the design of the site, building and structures, planting, signs, street hardware and miscellaneous other objects which are observed by the public. 3. These criteria are not intended to restrict imagination, innovation or variety, but rather to assist in focusing on design principals which can result in creative solutions that will develop a satisfactory visual appearance within the Village. 4. If the Director of Building and Zoning determines that a proposal involves: (a) no external architectural feature; (b) remodeling or changes or an addition in a one family zoning district; or (c) remodeling or changes in any zoning district which will not substantially change or significantly impact upon structures overall general appearance; or (d) a custom home. then no Appearance Commission approval need be obtained. 5. Notwithstanding the foregoing subsection 4., if the Director of Building and Zoning determines that a custom home is radically different or that the architectural design is manifestly inferior or radically different so as to impair the marketability or property values of existing buildings in the immediate area, the Director may refer said custom home to the Appearance Commission. Section 2. Section III.B.1 of Exhibit A to Ordinance No. 73 -54, as amended, is hereby further amended as follows: B. RELATIONSHIP OF SITE TO ADJOINING AREA 1. Adjacent buildings of different architectural styles shall be made compatible by such means as screens, site breaks and materials. In addition to architectural treatments, adjacent homes may not have the same base color. Section 3. Section VII Definitions of Exhibit A to ordinance 73 -54, as amended, is hereby further amended by adding thereto the following: Custom Home - A single family detached dwelling unit which has an individual design and which also has a floor plan unique to that home. Section 4. If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. Section 5. Any person violating the provisions of the Ordinance shall be punished according to the provisions of Chapter 1.08 GENERAL PENALTY, of the Buffalo Grove Municipal Code. Section 6. This Ordinance shall be in full force and effect from and after its passage, approval and publication. This ordinance may be published in pamphlet form. This ordinance shall not be codified.
