1987-0120 0 ORDINANCE NO. 87- 12 AN ORDINANCE AMENDING TITLE 13 OF THE BUFFALO GROVE MUNICIPAL CODE (MTER WELLS FOR IRRIGATION PURPOSES) BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, ILLINOIS, COOK AND LAKE COUNTIES, ILLINOIS: SECTION ONE: Title 13 of the Buffalo Grove Municipal Code is amended by adding thereto Chapter 13.18 which is to read as follows: CHAP'T'ER: 13.18 Water Wells for Irrigation Purposes SECTIONS: 13.18.010 Purpose 13.18.020 Permit Required 13.18.030 Plan Requirements 13.18.040 Retention of As -Built Plans 13.18.050 Use 13.18.060 Meter Required 13.18.070 Conservation of Water 13.18.080 Approval Authorities 13.18.090 Fees 13.18.100 Violation - Penalty SECTION 13.18.010 Purpose - The purpose of this chapter is to regulate the location, construction, operation, maintenance and abandonment of water wells, to provide minimum standards to safeguard persons, to protect property and to promote the public welfare. Water wells shall only be used to irrigate the property and attendent landscaping existing thereon, denoted in the permit. SECTION 13.18.020 Permit Required- Prior to the commencement of any layout, clearing, or drilling of any well, a permit shall be obtained from the Village Engineer. A permit shall only be authorized for a minimum of three (3) acres under single ownership. No permit shall be issued other than for water wells terminating within the shallow aquifer as defined by the Illinois State Water Survey (ISW /RI83/76). SECTION 13.18.030 Plan Requirements - The application for permit for the construction of a water well shall be accompanied by a location plan which shall indicate, at a minimum, the following: -1- 0 0 1. Proposed finished grading at and within one - hundred fifty (1501) feet of the proposed well location. 2. All storm sewers, sanitary sewers, watermains, open ditches and other improvements within one - hundred (150') feet of the well location. 3. Limits of regulatory flood plain(s). 4. Nature and extent of all other improvements, buildings or features within one - hundred fifty (1501) feet of the well location. 5. Statement describing all other wells, similar in nature, within two thousand (2000') feet of the proposed well, denoting the depth and capacity. 6. Depth of proposed well hole, diameter, size of pump, discharge piping, all other necessary appurtenances and all other details of the well design and installation, including necessary electrical. 7. Legal description of property to be irrigated. SECTION 13.18.040 Retention of As -Built Plans - Plans, specifications and reports submitted for well construction shall be retained by the Village. Upon completion of construction the Village shall receive an as -built plan of the completed construction. As -built plans shall meet the requirements of Section 16.40.070 of the Buffalo Grove Municipal Code. SECTION 13.18.050 Use - Water produced by water wells constructed pursuant to this chapter shall be for irrigation purposes only on the property for which the permit is issued. No cross connection with any water system, public or private, is permitted and all discharges from a water well shall be to a pond, lake or detention basin. Direct pumping to an irrigation system or buried reservoir is prohibited. SECTION 13.18.060 Meter Required - In order for the Village to monitor the use of any water well, the proposed construction shall include a meter capable of recording the total quantity of water pumped. Said meter shall be available to inspection by authorized Village personnel at all times. SECTION 13.18.070 Conservation of Water - All water wells shall be constructed with automatic controls sufficient to shut off the operation of the well at such time as the pond or detention basin to which it is discharging is at its normal water level. The owner of any water well shall observe and be in compliance with all Village ordinances with respect to water conservation. Issuance of a permit for the construction and operation of a water well shall not exempt the owner from any outside or emergency water use ban. SECTION 13.18.080 Approval Authorities - The applicant is responsible for obtaining any other governmental permits governing the proposed construction. Issuance of any required permits shall be a prerequisite for Village permit issuance. -2- « k SECTION 13.18.090 Fees - To cover the cost of the Village's review of the plans and inspection of the proposed construction, and in addition to any other required fees, there shall be a fee of $500.00 paid for each water well permit issued. SECTION 13.18.100 Violation - Penalty - Any person violating any portion of this Chapter shall be punished according to the provision of Chapter 1.08 of the Buffalo Grove Municipal Code. In addition the Village shall have the right to revoke the Village's water well permit. cFr*rrnrT 9 This ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law.
