1986-046ORDINANCE NUMBER 86- 46 AN ORDINANCE PROVIDING FOR THE ACQUISITION OF LAND IN LAKE AND COOK COUNTIES WHEREAS, the President and Board of Trustees of the Village of Buffalo Grove have adopted a plan for the acquisition of certain properties hereinafter described for municipal purposes; BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, THAT: Section 1: The real estate hereinafter described is hereby determined to be useful, advantageous, necessary and desirable and in the best public interest to be acquired by the Village of Buffalo Grove for municipal purposes. Section 2; It is hereby determined that the fee simple title to the real estate hereinafter described be acquired and be used, occupied and developed for those purposes as set forth in Section 1 hereof. Section 3: That the real estate hereinafter described is privately owned and is legally described as follows: THAT PART OF THE SOUTHEAST 114.017 SECTION 32, TOWNSHIP 43 NORTH, RANGE 11, EAST OF THE THIRD PRINCIPAL MERIDIAN AND THAT PART OF THE NORTHEAST 114 OF SECTION 5, TOWNSHIP 42 NORTH, RANGE 11 EAST OF THE THIRD PRINCIPAL MERIDIAN, DESCRIBED AS FOLLOWS: COMMENCING AT THE INTERSECTION OF THE EAST LINE OF THE SOUTHEAST 114 OF SAID SECTION 32 WITH THE CENTER LINE OF CHECKER ROAD: THENCE NORTH 77 DEGREES 03 MINUTES 27 SECONDS WEST ALONG SAID CENTER LINE OF CHECKER ROAD, 490.00 FEET. Section 4; That William Raysa, Attorney for the Village of Buffalo Grove, William Balling, Village Manager of the Village of Buffalo Grove, or Richard Redmond, Counsel for the Village of Buffalo Grove, be and hereby are authorized, empowered and directed to cause said property to be appraised by independent qualified real estate appraisers, to determine title to said real estate, to cause said real estate to be surveyed, bored or platted as may be necessary, to offer to purchase said property from the owner or owners thereof at the approved appraisal price, subject only to final approval of this Board, and otherwise to attempt to agree on behalf of the Village of Buffalo Grove with the owner or owners of the lands hereinbe fore described for the purchase thereof by the Village of Buffalo Grove. Section 5: That in the event the compensation to be paid for said parcel of land cannot be agreed upon with the owner or owners of said land, or in the event the owees or persons with interest of title cannot be located, or ascertained, then William Raysa, Attorney for the Village of Buffalo Grove, and Richard Redmond, Counsel for the Village of Buffalo Grove, shall be, and they are hereby authorized, instructed and directed to institute and maintain in the name of and on behalf of the Village of Buffalo Grove, in a court of competent jurisdiction such proceedings as may be appropriate under the laws of the State of Illinois relating to the exercise of the right of eminent domain and such other statutes as may be applicable, for the condemnation of said parcel of property or such part or parts thereof as may not have been acquired by purchase. 0 Section 6: All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed insofar as they conflict herewith. Section 7: This ordinance shall be in full force and effect from and after its passage and approval according to law.
