AN ORDINANCE ESTABLISHING TEMPORARY HOURS OF
OPERATION FOR RETAIL FOOD STORES
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the
Illinois Constitution of 1970; and,
WHEREAS, Section 11 -20 -1 of the Illinois Municipal Code (Illinois Revised
Statutes, Ch. 24, Par. 11 -20 -1) allows the Village to establish and regulate
markets and markethouses; and,
WHEREAS, Section 11 -20 -1 of the Illinois Municipal Code (Illinois Revised
Statutes, Ch. 24, Par. 11 -20 -2) allows the Village to regulate the sale of food
for human consumption and to locate and regulate the places where and the manner
in which food for human consumption is sold; and
WHEREAS, in order to determine whether the twenty -four hour operation of
retail food stores is injurious to the safety, health, comfort, quiet, morals and
general welfare of the public, it is deemed desirable to permit such operations
for a fixed, temporary period of time for the evaluation of the effects of such
operations on the public and Village as a whole:
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS:
Section 1. Chapter 5.40, Hours of Operation in Residential Areas, of the
Buffalo Grove Municipal Code is hereby amended to read as follows:

HOURS OF OPERATION IN RESIDENTIAL AREAS
Sections: 5.40.010 Retail Operation
5.40.020 Retail Food Stores
5.40.030 Violation -- Penalty
5.40.010 - Retail Operation. Except as otherwise provided in this Chapter, where
the building line or portions thereof of a retail structure or the customer
parking area or driveway and /or portion thereof is located within eighty feet of
a building line of a residential structure, the operation of same between the
hours of midnight and seven a.m. is prohibited, except that a retail operator or
shop owner may petition the Village Manager for a six a.m. opening provided:
A. Parking is restricted in a method authorized by the Village Manager
within the eighty -foot buffer between the hours of six a.m. to seven a.m.
B. A permit is applied for and received from the Village which sets forth
the requirements, maintenance and other guidelines for the restricted parking.
5.40.020 Retail Food Stores. Retail food stores in excess of 30,000 square feet
may operate twenty -four hours a day from Thursday, November 28, 1985, through
Monday February 3, 1986, subject to the following requirements:
A. A permit is applied for and received from the Village.
B. A written report is submitted weekly to the Village Manager describing
any incidents or problems occurring between the hours of midnight and seven a.m.
each day.
5.40.030 Violation -- Penalty. Any person violating the provisions of this
Chapter shall be punished as provided in Chapter 1.08.
Section 2. This Ordinance shall be in effect from and after its passage,
approval and publication. This ordinance may be published in pamphlet form.
This Ordinance shall not be codified.
