1985-075f _ 0 0 Exhibit A 0DINANCE' ,NO. 85- 75 AN ORDINANCE AUTHORIZING AN OBLIGATION TO THE NORTHWEST WATER COMMISSION FOR A PROPORTIONATE SHARE OF DEVELOPMENT, CONSTRUCTION AND OPERATING COSTS WHEREAS, the Village of Buffalo Grove (the "Village ") is a member of the Northwest Water Commission (the "Commission "); and WHEREAS, the Commission is constructing a water supply system (the "System ") to provide the Village and other Commission members and customers with a common source of supply of Lake Michigan water; and WHEREAS, the reservoir and pumping station portion of the System ( "Division A") experienced a major failure (the "Failure ") while under construction; and WHEREAS, the Failure has caused not only direct structural damage to Division A, but also consequential damages to the Village, the Commission and other Commission members; and WHEREAS, the Commission and its members have received certain funds in settlement of liability for a portion of the above - mentioned damages; and WHEREAS, The Commission and its members have entered into an Agreement regarding the use of said settle- ment funds, which Agreement requires the adoption of this Ordinance. -1- 0 0 NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Btiffalo Grove , Cook and Lake i0oliNjoW [Counties], Illinois, as follows: SECTION ONE: Pursuant to Ill. Rev. Stat. ch. 24, 1(11- 135 -1, and in the exercise of its home rule powers and its powers and authority under the Intergovernmental Cooperation provisions of Article VII, Section 10 of the 1970 Illinois Constitution and the Illinois Intergovernmental Cooperation Act (Ill. Rev. Stat. ch. 127, 11741 et seq.), the Village is hereby obligated to advance its tentative allocation and /or ultimate share of the PRC settlement funds, all as provided for in that certain "Agreement Regarding Use of Settlement Funds," dated November 4 , 1985, as its proportionate share of Commission development, construction and operating costs. The Village Manager is hereby authorized and directed to take all actions necessary to effectuate said advance in accordance with the terms of the aforesaid Agreement. SECTION TWO: This Ordinance shall be in full force and effect from and after its passage and approval in the manner provided by law. -2- o a PASSED this 4th day of November , 1985.
