1985-063s 10/7/85 r'1 0 2401.51.0 ORDINANCE NO. 85 -63 AN ORDINANCE VACATING CERTAIN PUBLIC STREETS and RIGHT OF WAYS IN COLUMBIAN GARDENS UNIT #4 and COLUMBIAN GARDENS UNIT #3 WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS, the hereinafter described public streets and right of ways in Columbian Gardens Unit No. 4 and Columbian Gardens Unit No. 3 are municipal right of ways and are currently unimproved; and WHEREAS, it has been determined that the lands abutting the platted Subdivisions have not contributed to nor are they encumbered by said public streets and right of ways; and WHEREAS, the Corporate Authorities have determined that the nature and extent of the public use or public interest to be subserved is such as to warrant the vacation of said public streets and right of ways and that the relief to the public from any burden and responsibility of maintaining same constitutes a public use or public interest authorizing said vacation. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: Section 1: The preambles hereto are hereby incorporated and made a part of this ordinance. Section 2: The following described public streets and right of ways be and hereby are vacated: All of the public streets and right of ways including West Drive, Washington Drive, Terrill Place, Roosevelt Place, Linden Avenue, Lincoln Drive, Dover Place and the unnamed 20 feet wide public right of way lying West of and adjoining the West line of Blocks 14 and 15 in Columbian Gardens Unit No. 4, being a subdivision of a part of the Southeast 1/4 and a part of the East 1/2 of the Southwest 1/4 of Section 34, Township 43 North, Range 11, East of the Third Principal Meridian, accord- ing to the Plat thereof recorded June 26, 1929 as Document No. 339091, together with that part of South Chevy Chase Drive in Columbian Gardens Unit No. 3, being a subdivision in Sections 34 and 35, Township 43 North, Range 11, East of the Third Principal Meridian, according to the Plat thereof recorded May 22, 1929 as Document No. 337110, falling within a tract of land bounded and described as follows: beginning at the intersection of the Easterly right of way line of the 02 f 0 Minneapolis, St. Paul and Sault Ste. Marie Railway with the North line of Columbian Gardens Unit No. 4, aforesaid; thence Easterly along the North line of said Columbian Gardens Unit No. 4 to the Northeast corner thereof; thence Southerly along the Easterly line of Block 20 and its extension in said subdivision to the Northeasterly line of 33.0 feet wide West Drive; thence along the curved Northeasterly line of West Drive which has a radius of 4583.7 feet, convex Northeasterly and whose long chord bears South 34 degrees 28 minutes East, a chord distance of 1069.8 feet; thence along the curved Northeasterly line of West Drive which has a radius of 1146.3 feet, convex Southwesterly, an arc distance of 394.28 feet (chord to said curve bears South 35 degrees 05 minutes 10 seconds East); thence South 89 degrees 56 minutes 11 seconds East 322.99 feet; thence South 00 degrees 19 minutes 00 seconds West to the South line of Section 34, aforesaid; thence Westerly along said last described line to an intersec- tion with the Northerly line of Lake -Cook Road; thence Westerly along said last described line to the Easterly line of the Minneapolis, St. Paul and Sault Ste. Marie Railway; thence Northerly along said Easterly line to the place of beginning, all in Lake County, Illinois. Section 3: A Plat of Vacation of said public streets and right of ways is attached hereto and made a part hereof as Exhibit "A ". Section 4: That title to said vacated public streets and right of ways is hereby declared to be vested in the owners of the subdivided land abutting said public streets and right of ways and that title to those public streets and right of ways on the border of said Subdivisions is not vested in abutting land owners whose land has not contributed to nor encumbered by said public streets and right of ways. Section 5: This ordinance shall be in full force and effect from and after its passage by the affirmative vote of at least three - fourths (3 /4ths) of the Village Trustees then holding office. This ordinance shall not be codified.
