ORDINANCE NO. 84- 58
AN ORDINANCE AMENDING TITLE 5 OF THE BUFFALO GROVE
MUNICIPAL CODE, BUSINESS TAXES, LICENSES and REGULATIONS
WHEREAS, the Village of Buffalo Grove is a home rule unit
pursuant to the Illinois Constitution of 1970; and
WHEREAS, the corporate authorities have become aware of
increasing incidences of stolen property being sold to and
purchased by local retailers that deal in precious metals,
unbeknown to them; and
WHEREAS, the corporate authorities recognize the need to
prevent this activity through better controls and monitoring; and
WHEREAS, the corporate authorities believe that the best
method of controlling and monitoring these transactions is by
cooperation with the precious metal retailer and monitoring by
the Buffalo Grove Police Department;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK and LAKE COUNTIES,
ILLINOIS:
SECTION 1: Title 5, of the Village of Buffalo Grove
Municipal Code, as amended, is hereby amended by adding Chapter
5.52, titled Precious Metal Dealers, which shall read a,s follows:
5.52.010 - License Required
It shall be unlawful for any person to act or
operate as a precious metals dealer without
obtaining a general commercial business
license as set forth in Chapter 5.04. The fee
for said license shall be as promulgated in
Chapter 5.04.
5.52.020 - Precious Metals Defined
Precious metals are hereby defined as items
of gold, silver or platinum, such as bullion,
coins, rings, bracelets, silverware, jewelry,
chains, necklaces or items of similar import,
whose fair market value exceeds the sum of
twenty -five dollars ($25.00). Fair market
value defined as the average price paid for
the item in the current retail market.
5.52.030 - Precious Metals Dealer Defined
Precious metals dealer shall mean a person
who purchases precious metals from the
public. No person shall be deemed a precious
metal dealer if the number of purchases in a
calendar year does not exceed three (3).
5.52.040 - Required Record Keeping
Every precious metals dealer shall keep a
ledger in which shall be written in ink at
the time of each and every purchase, the date
of the transaction, a description of all
goods, items, articles and other things pur-
chased, the amount of the purchase price, the
name and address of the seller, and the
driver's license number of the seller. The
driver's license number of the seller shall
be taken by the purchaser from the driver's
license presented to him. If the seller does
not have a current driver's license or other
valid identification, two other items of
identification verifying the name, address
and date of birth of the seller must be
presented and recorded. Each transaction will
be assigned a control number.
5.52.050 — Handling of Precious Metals
All precious metals purchased must be photo-
graphed and the photograph identified by the
corresponding ledger control number. The
photographs must be retained for one (1)
year. All precious metals purchased must be
retained for ten (10) days prior to dispos-
ing, altering or changing it's original
physical appearance in any manner.
5.52.060 - Inspections. All precious
metals purchased, photographs and the trans -
action ledger must be made available to
officers of the Buffalo Grove Police Depart-
ment upon their request.
5.52.070 - Minimum Age - Seller. No dealer
shall purchase any precious metal from any
person under the age of sixteen (16) years.
5.52.080 - Violation - Penalty. Any person
violating the provisions of this Chapter
shall be punished as provided in Chapter
1.08.
SECTION 2: This ordinance shall be in full force and
effect from and after its passage, approval and publication. This
ordinance may be published in pamphlet form.
