1984-035ORDINANCE NO. 84 - 35 AN ORDINANCE AMENDING TITLE 8 OF THE VILLAGE OF BUFFALO GROVE MUNICIPAL CODE WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the provisions of the Constitution of the State of Illinois of 1970. NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: SECTION 1: Title 8 of the Village of Buffalo Grove Municipal Code is hereby amended by adding Chapter 8.28, which is to read as follows: CHAPTER 8.28 FOOD AND BEVERAGE VENDING MACHINE ORDINANCE Section 8.28.010 Adoption by Reference. The Vending of Food and Beverages- -1978 Sanitation Ordinance and Code of the U. S. Food and Drug Administration, as modified in this chapter, is hereby adopted by reference. Section 8.28.020 Amendments. The Vending of Food and Beverages- - 1978 Sanitation Ordinance and Code of the U. S. Food and Drug Adminis- tration is hereby amended as follows: Section 6 -108 Permit Exemption is hereby deleted. Section 6 -203 Notification of Inspection Findings. A. Whenever an inspection of food vending machines is made, a copy of the completed inspection form provided by the Regulatory Authority shall be furnished to the operator. B. Whenever the Regulatory Authority discovers a violation of any provision of this ordinance, it shall notify the operator concerned either by the inspection report form or by other written notice. Such form or notice, which is a public document shall: (1) Describe the condition found; (2) Provide a specific and reasonable period of time for the correction of the condition; and (3) State that an opportunity for a hearing on inspec- tion findings will be provided if a written request for such hearing is filed with the Regulatory Authority within 10 days of receipt of the notice. The Regulatory Authority may also advise the operator in writing that unless the violations are corrected within the specified period of time, any permit issued under the provisions of this ordinance may be suspended or revoked in accordance with the provisions of Chapter 6, or court action may be iniated. Section 6 -204 Inspection Report Form FD 30'78 -See Appendix B is hereby deleted. Section 6 -601 Penalties. Any person violating the provisions of this chapter shall be punished according to the provisions of Chapter 1.08, GENERAL PENALTY. Section 6 -602 Injunctions is hereby deleted. If any provision or application of any provision of this ordinance is held invalid, that invalidity shall not affect other provisions or applications of this ordinance. This Ordinance shall be in full force and effect from and after its passage, approval, and publication, in pamphlet form.
