ORDINANCE NUMBER 83- 62
AN ORDINANCE PROVIDING FOR THE
ACQUISITION OF LAND IN LAKE COUNTY, ILLINOIS
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, THAT:
Section 1: The real estate hereinafter described is
hereby determined to be useful, advantageous, necessary or
desirable and in the best public interest to be acquired by the
Village of Buffalo Grove for street or highway purposes.
Section 2: It is hereby determined that the real estate
hereinafter described be used, occupied and developed for those
purposes as set forth in Section 1 hereof.
Section 3: That the real estate hereinafter described is
privately owned and is legally described as follows:
PARCEL 0001: That part of the Southwest 1/4 of Section
33, Township 43 North, Range 11, East of the Third
Principal Meridian described as follows, to wit:
Commencing at a point in the Center of McHenry Road
which is North 33, degrees 40 minutes West 753.5 feet
from the intersection of the South line of said
Southwest 1/4 with the center line of said McHenry
Road; thence at right angle to center or said road
North 56 degrees 20 minutes East 41.90 feet to a point
of beginning on the existing East line of McHenry Road,
thence continuing North 56 degrees 20 minutes East
11.70 feet to a point on line 53.60 feet Easterly and
parallel to the said center line of McHenry Road;
thence South 33 degrees 40 minutes East parallel with
the center of said McHenry Road a distance of 119.39
feet more or less to a point on the Northwesterly line
of premises conveyed to the Catholic Bishop of Chicago
by Deed recorded as Document #650618; thence South 55
degrees 41 minutes West along said Northwesterly line
of premises conveyed to the Catholic Bishop of Chicago,
a distance of 1.70 feet to the existing East line of
McHenry Road; thence North 38 degrees 27 minutes,08
second West a distance of 119.83 feet, more or less, to
the point of beginning, containing therein 0.018 acres
acres all in Lake County, Illinois.
PARCEL 0002: That part of the Southwest 1/4 of the
Southwest 1/4 of Section 33, Township 43 North, Range
11, East of the Third Principal Meridian, described as
follows: Commencing at a point in the center of McHenry
Road a distance of 753.5 feet North 33 degrees 40
minutes West from the intersection of center of road
and South line of the SOuthwest 1/4 of said Section 33;
thence at right angles to the center line of said road

degrees 40 minutes West from the intersection of the

central angle of 8 degrees 10 minutes 48 seconds, for a
distance of 136.37 feet to the South line of the
Grantor's property; thence South 55 degrees 22 minutes
54 seconds West along the South line of the Grantor's
property, 62.43 feet to a pont in said McHenry Road,
103.5 feet South 33 degrees 40 minutes East of the
point of beginning; thence 103.5 feet North 33 degrees

therein 0.224 acres of which 0.190 acres was previously

distance of 74.64 feet to the point of beginning;

2.08 feet to a pont on a curve having a radius of
953.19 feet, the center of said curve bears North 72
degrees 20 minutes 33 seconds East from said point;
thence Southerly along a curve concave to the East,
radius 953.19 feet, central angle of 3 degrees 20
minutes 1 second a distance of 55.46 feet; thence South
69 degrees 32 seconds West a distance of 2.0 feet to a
point on a curve concave having a radius of 955.19
feet, the center of said curve bears North 69 degrees
32 secnds East from said point; thence Northerly along
a curve concave to the East, radius 955.19 feet,
central angle of 3 degrees 17 minutes 57 seconds, a

174.40 feet to the North line of the Grantor's
property; thence West along said North line a distance
of 48.63 feet to the centerline of McHenry Road; thence
South 6 degrees 30 minutes East along the centerline of
McHenry Road a distance of 212.80 feet to the point of
beginning, containing therein 0.246 acres of which
0.205 acres was previously dedicated in Lake County,
Illinois.
PARCEL 0004 - TEMPORARY EASEMENT: That part of the
Southwest 1/4 of Section 33, Township 43 North, Range
11, East of the Third Principal Meridian, described as
follows: Beginning at a pont in the centerline of
McHenry Road which point is located as follows:
Commencing at the intersection of the South line of
Section 33 aforesaid and the centerline of said road,
said intersection being 920.0 feet East of the
Southwest corner of said Section; thence North 33
degrees 40 minutes West along the centerline of said
road 1022.0 feet; thence North 6 degrees 30 minutes
West along the centerline of said road 34.7 feet;

74.64 feet to the point of beginning of the land herein
described; thence continuing along the said line a
distance of 6.24 feet to a point on a curve having a
radius of 949.19 feet, the center of said curve bears
North 72 degrees 24 minutes 42 seconds East from said
point, thence Northerly along a curve concave to the
East, radius 949.19 feet, central angle of 10 degrees
18 minutes 41 seconds, for a distance of 170.82 feet;
thence West a distance of 6.05 feet to a point on a
curve having a radius of 955.19 feet, the center of
said curve bears North 82 degrees 46 minutes 9 seconds
East from said point; thence Southerly along a curve
concave to the East, radius 955.19 feet, central angle
of 10 degrees 27 minutes 40 seconds, a distance of
174.40 feet to the point of beginning, containing
therein 0.024 acres in Lake County, Illinois.
Section 4: That William Raysa, Attorney for the Village of
Buffalo Grove, and William Balling, Village Manager of the
Village of Buffalo Grove be and hereby are authorized, empowered
and directed to cause said property to be appraised by indepen-
dent qualified real estate appraisers, to determine title to said
real estate, to cause said •real.estate to be surveyed, bored or
platted as may be necessary, to offer to purchase said property
from the owner or owners thereof at the approved appraisal price,
subject only to final approval of this Board, and otherwise to
attempt to agree on behalf of the Village of Buffalo Grove with
the owner or owners of the lands hereinbefore described for the
purchase thereof by the Village of Buffalo Grove.
Section 5: That in the event the compensation to be paid
for said parcel of land cannot be agreed upon with the owner or
owners of said land, or in the event the owners or persons with
interest of title cannot be located, or ascertained, then William
Raysa, Attorney for the Village of Buffalo Grove, shall be, and
he is hereby authorized, instructed and directed to institute and
maintain in the name of and on behalf of the Village of Buffalo
Grove, in a court of competent jurisdiction such proceedings as
may be appropriate under the laws of the State of Illinois
relating to the exercise of the right of eminent domain and such
other statutes as may be applicable, for the condemnation of said
parcel of property or such part or parts thereof as may not have
been acquired by purchase.
Section 6: All ordinances or parts of ordinances in
conflict with the provisions of this ordinance are hereby
repealed insofar as they conflict herewith.
Section 7: This ordinance shall be in full force and
effect from and after its passage and approval according to law.
