1983-012ORDINANCE NO. 83- 12 APPROVING A FIRE MUTUAL AID AGREEMENT WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and, WHEREAS, the Village of Buffalo Grove is desirous of cooperating with surrounding fire departments; and, WHEREAS,the Village of Buffalo Grove and the surrounding Fire Districts and Villages have found it desirous to share equipment and manpower for the mutual benefit of each other and the general public; and, WHEREAS, the Village of Buffalo Grove may supply such equipment and manpower as determined by the Fire Chief in accordance with the attached document marked Mutual Aid Agreement. NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows: SECTION 1. That the Village President be and is hereby authorized to sign the attached document marked Mutual Aid Agreement, a copy of which is attached hereto and made a part hereof as is fully set forth, and the Village Clerk is authorized to attest said document upon the signature of the Village President. SECTION 2. This Ordinance shall not be codified in the Municipal Code of Buffalo Grove. SECTION 3. This Ordinance shall be in full force and effect from and after its passage and approval. AYES: 6 - Marienthal, Stone, O'Reilly, Hartstein, Gerschefske, Schwartz NAYES: 0 - None ABSENT: 0 - None PASSED:February 7 1983 APPROVED: February 7 APPROVED: ATTEST: lake Press nt Pro Tem Villas Clerk " a$:�i3 4. o • MUTUAL AID AGREEMENT These Articles of Agreement, made and entered into on the 7th day of February , A.D., 19 83by and between all the Participat- ing Municipalities that have approved and adopted in the manner as provided by law and are herein listed at the end of this Agreement. SECTION ONE - PURPOSE The purpose of this Agreement is to provide for a program of Mutual Aid between all of the Participating Municipalities whereby the Aiding Municipalities will be obligated to respond to the Stricken Municipality with such equipment and manpower as has been predetermined by the Fire Chief of each Municipality through the Box Alarm Assignments. SECTION TWO - DEFINITIONS For the purpose of this Agreement, the following terms are defined as follows:. A. "Municipality A city, Village, or Fire Protection District having a recognized Fire Department; B. "Mutual Aid ": A definite and prearranged written agreement and plan whereby regular response and assi.stance is provided for in event of alarms from certain boxes or locations i.n a Stricken Municipality by the Aiding Municipalities in accordance with the Box Alarm Assignments as developed by the Fire Chiefs of the Participating Municipalities; C. Participating Muni.ci.palities ": A Municipality that commits itself to this Mutual Aid Agreement by adopting an Ordinance authorizing participation i_n the program with other Partici- pating Mun.i.ci.paliti.es for rendering and receiving Mutual Aid in the event of a. fire or other disaster in accordance with the Box Alarm Assignments. D. "Stricken Municipality ": The Municipality in which a fire or other disaster occurs that is of such a magnitude that it cannot be adequately handled by the local Fire Department; E. "Aiding Municipality ": A Municipality furnishing fire equipment a.n.d manpower to a. Stricken Municipality. SECTION THREE - AGREEMENT TO EFFECTUATE THE MUTUAL AID PLAN The Village President, Mayor, or Board of Trustees of each Participating Municipality is authorized on behalf of that Municipality to enter into and from time to time to alter and amend on the advice of the Fire Chief and with the consent of the governing body of that Municipality, an agreement with other Municipalities for Mutual Aid according to the following: 1. Whenever a fire or disaster is of such magnitude and consequence that it i.s deemed advisable by the Senior Officer present, of the Stricken Munici.pali.ty, to request assistance of the Aiding Muni.cipa.li.ties, he is hereby authorized to do so, under the terms of this Mutual Aid Agreement and the Senior Officer present of the Aiding Municipali.ti.es are authorized to and shall forthwith take the following action. a. Immediately determine what equipment is required according to the Mutual Ai.d Box Alarm Assignment.. EXHIBIT I - 2 - b. Immediately determine if the required equipment and personnel can be committed in response to the request from the Stricken Municipality. c. Dispatch immediately the equipment required to the Stricken Municipality in accordance with the Box Alarm Assignments. 2. The rendering of assistance under the terms of this Mutual Aid Agreement shall not be mandatory in accordance with the Box Alarm Assignments if local conditions prohibit response. In that event it is the responsibility of the Aiding Municipality to immediately notify the Stricken Municipality of same. 3. All of the Participating Municipalities agree to waive all claims against the other party or parties for compensation for any loss, damage, personal injury or death occurring in consequence of the performance of this Mutual Aid Agreement. General Liability Insurance, Personal Injury and Property Damage Insurance against loss or damage of equipment is the responsibility of each Participating Municipality as it applies to their own manpower and. equipment. All services performed under this Mutual Aid Agreement shall be rendered without reimbursement to any Municipalities. 4. The Senior Officer present, of the Stricken Municipality, shall assume full responsibility and command for operations at the scene. He will assign Senior Officers and equipment, of the Aiding Municipalities, tcj• positions when and where he deems necessary. 5. The Fire Chief, Officers and personnel of all Participating Municipalities are invited and encouraged to frequently visit each others facilities for familiarization tours, and to jointly conduct training sessions and hypothetical disaster exercises. SECTION FOUR. - TERMINATION Any Municipality may withdraw from the Northwest Cook County Master Mutual Aid Agreement by noti.fy.ing the Fire Chiefs of the other Partici- patin.g Muni.ci.pali.ti:es i.n wri.ti.ng. Whereupon the withdrawing Municipality will terminate parti.ci.pati.on. ninety (90) days from date of the written notice. SECTION FIVE ADOPTION. This Mutual Aid Agreement shall. be in full force and in effect with the passage and approval of a companion Ordinance by all Participating Munici.pal.i.ti.es, in. the manner provided by law, and the signing of this - 3 - Agreement by the Village President, City Mayor, or Trustees of a Fire Protection District.
