ORDINANCE AUTHORIZING AN OBLIGATION TO THE NORTHWEST
14ATER COMMISSION FOR A PROPORTIONAL SHARE OF DEVELOP-
MENT, CONSTRUCTION AND OPERATING COSTS
WHEREAS, the Village of Buffalo Grove, (the "Village ") is a member
of the ;Northwest Water Commission (the "Commission "); and
WHEREAS, the Commission is currently engaged in its project to
procure and establish a common source of supply of Lake Michigan water
for the Village and other Commission members and customers (the "project ");
and
WHEREAS, in connection with said project, the Commission has incurred
and will further incur development, construction and operating costs; and
WHEREAS, the "General Obligation Financing 'Alternative 2 "' report
prepared for the Commission by Speer Financial, Inc., and dated January 26,
1982 (the "1982 Financial Plan ") calls for each Commission member municipality
to advance to the Commission a proportionate share of the funds required for
the development, construction and operating costs of the Commission's project;
and
WHEREAS, the Village President and Board of Trustees have determined
it to be in the best interest of the Village to participate in the Commission's
project in accordance with the 1982 Financial Plan; and
WHEREAS, the Village and the Commission have entered into the "North-
west Water Commission Water Supply Contract for the Village of Buffalo
Grove," dated April 6, 1981 (the "Contract ''), and intend to enter into the
"First Amendment to Northwest Water Commission Water Supply Contract for
the Village of Buffalo Grove" (the "Amendment "); and
WHEREAS, the Commission, the Village, and the Commission's other
member municipalities will enter into the "Intergovernmental Agreement
Providing for Proportionate Transfers of Funds Between the Northwest Water
Commission and its Member Municipalities" (the "Intergovernmental Agreement "),

which Intergovernmental Agreement provides for, under certain circumstances,
advances by the Village to the Commission in the total amount of $9,411,879.00
(Nine Million Four Hundred Eleven Thousand Eight Hundred Seventy -Nine Dollars);
and
WHEREAS, Ill. Rev. Stat. ch. 24, p. 11 -135 -1 (1981) authorizes the
Village to obligate itself for a proportionate share of the Commission's
development, construction and operating costs and provides that no prior
appropriation shall be required to incur such obligations; and
WHEREAS, pursuant to such authority and in the exercise of its home
rule powers and its powers and authority under the Intergovernmental
Cooperation provisions of Article VII, Section 10 of the 1970 Illinois
Constitution and the Illinois Intergovernmental Cooperation Act (111. Rev.
Stat. Ch. 127, P. 741 et sect.), the Village President and Board of Trustees
have determined to obligate the Village for its proportionate share of the
Commission's development, construction and operating costs in accordance
with the 1982 Financial Plan and as more specifically hereinafter set
forth; and
WHEREAS, the Village will have available sufficient funds to pay the
amounts hereinafter provided for.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees
of the Village of Buffalo Grove, Cook and Lake Counties, Illinois, as
follows:
SECTION ONE: Pursuant to 111. Rev. Stat. ch. 24, p. 11- 135 -1 and in
the exercise of its home rule powers and its powers and authority under the
Intergovernmental Cooperation provisions of Article VII, Section 10 of the
1970 Illinois Constitution and the Illinois Intergovernmental Cooperation
Act (111. Rev. Stat. ch. 127, P. 741 et seq.), the Village of Buffalo
Grove is hereby obligated to bear the specific amount of $9,411,879.00
(Nine Million rour Hundred Eleven Thousand Eight Hundred Seventy-Nine
Dollars) as its said proportionate share of Commission development, con-
struction and operating costs. $4,426,800.00 (Four Million Four Hundred
Twenty -Six Thousand Eight Hundred Dollars) of said amount shall be transferred

to the Commission upon seven (7) days' written notice from the Commission
given on or after May 26, la82. $52,979.00 (Fifty -Two Thousand Nine Hundred
Seventy -Nine Dollars) of said amount shall be transferred to the Commission
on February 1, 1983. $4,932,100.00 (Four Million Nine Hundred Thirty -Two
Thousand One Hundred Dollars) of said amount, if required under the terms
of the Intergovernmental Agreement;, shall be transferred to the Commission
upon ninety (90) days' written notice from the Commission given on or after
December 1, 19"2. The Village Manager is hereby authorized and directed to
cause the aforesaid amounts to be transferred to the Commission in accordance
with the terms of the Intergovernmental Agreement.
SECTION TWO: This Ordinance shall be in full force and effect from
and after its passage and approval in the manner provided by law.
