AN ORDINANCE AMENDING CHAPTER B.G. -16 OF
THE BUFFALO GROVE MUNICIPAL CODE
WHEREAS, the Village of Buffalo Grove is a home rule unit pur-
suant to the Illinois Constitution of 1970.
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF BUFFALO GROVE, COOK and LAKE COUNTIES, ILLINOIS:
SECTION 1.
Chapter B.G. -16 of the Buffalo Grove Municipal Code is hereby
amended to read as follows:

ENFORCEMENT, PENALTY and DISPOSAL

BG -16 -101 - Applicabilit : The penalty provisions of this chap-
ter are applicable to the Illinois Vehicle Code, as adopted by re-
ference as the Traffic Code of the Village, to the Buffalo Grove
Supplement thereto and to the ordinances of the Village.
BG -16 -102 - Arrests - Prosecution:
A. The Buffalo Grove Police shall patrol the public highways
and make arrests for the violation of the provisions of the
Village's ordinances.
B. The Village Attorney or his designated alternate shall prose-
cute all violations which occur within the corporate limits of
Buffalo Grove and which are written under Village Ordinances.
BG -16 -103 - Citations:
A. Whenever a Peace Officer is authorized to arrest a person
without a warrant because of a violation of an ordinance, said
Peace Officer may, in lieu of the filing of a Complaint in Court,
in the first instance issue to such alleged violator, a CITATION,
1, advising said person that he has violated a specified
Ordinance.
2, requesting him to make payment in an amount applicable
to said alleged violation as set forth in Section 16 -104 of this
Chapter as settlement of said violation claim, and
3. informing him that upon failure to so settle, a Complaint
will be filed in Circuit Court charging him with such violation.
B. Pursuant to said CITATION, the person so accused of said
violation may settle and compromise the violation claim in re-
spect of such Ordinance violation by paying to the municipality
the applicable amount as shown in the schedule set forth in Sec-
tion 16 -104 of this Chapter, within a period to be specified in
said CITATION.
C. Such payment shall be made in accordance with the instruc -.
tions contained in the aforesaid CITATION, at the office of the
Village Clerk, who shall issue a receipt for the money so received
and promptly remit said amount to the Village Treasurer to be cre-
dited to the proper municipal fund.
D. In the event that the person to whom said CITATION is issued
fails to settle and pay said violation claim within the prescribed
time, or within a period of time specified in a Final Notice (if
one is served upon him) then the Peace Officer is authorized to
cause a Notice to Appear to be served upon said alleged violator
and is authorized to file a Complaint and to prosecute the same
in the Circuit Court.
E. The fact that an automobile or motor vehicle which is il-
legally operated or parked is registered with the Secretary of
State in the name of said alleged violator; or, in the alternative,
in the event that a vehicle sticker issued by a municipality has
been issued in the name of and to said alleged violator, shall be
considered prima facie proof that said alleged violator was in
control of or was the operator of the automobile or motor vehi-
cle at the time of such alleged violation.
BG -16 -104 - Penalties: The violation claim described in said
CITATION so to be issue pursuant to the terms of this Chapter,
may be settled, compromised and paid in the respective amount set
forth in the following schedule:
A. In the event that said payment is made prior to the mailing
by the municipality or by the Peace Officer of a Final Notice,
the following amounts shall be accepted as a settlement:
1. Sprinkling Ban Violation $10.00
2. Dog at Large $10.00
3. No Dog or Cat License $10.00
4. No Rabies Tag $10.00
5. Excessive number of animals $10.00
6.
Garbage - no covers
$10.00
7.
Garbage - out to early
$10.00
8.
"Sold" sign posted over 24 hours
$10.00
9.
Advertising on Parkway
$10.00
10.
Parking after 2 inch snow
$10.00
11.
Parking in loading zone

tion 1005 -6 -1 of Chapter 38, Illinois Revised Statutes, as
may be amended from time to time.
SECTION 2.
This ordinance shall be in full force and effect from and
after its passage, approval and publication. This Ordinance
may be published in pamphlet form.
