1981-004ORDINANCE NO. 81 -4 ORDINANCE ELECTING TO BECOME A MEMBER OF THE NORTHWEST WATER COMMISSION WHEREAS, the Village of Buffalo Grove has received an allocation of Lake Michigan water pursuant to Administrative Order No. LMO 80 -4 of the State of Illinois Department of Trans- portation; and WHEREAS, the President and Board of Trustees of the Village of Buffalo Grove (for the purpose of acquiring a source of Lake Michigan water supply for the Village of Buffalo Grove) desire to join the Northwest Water Commission (formerly the Des Plaines, Mount Prospect, Arlington ITeights and Palatine ?'rater Commission, and hereinafter sometimes referred to as the "Commission "); and WHEREAS, the Commission is currently engaged in development activities necessary to procure and establish a common source of supply of Lake Michigan water for the Village and other proposed users and has thereby incurred and will further incur expenses for development costs, including but not limited to plans, feasibility studies, legal, engineering and financial consulatnt fees, admin- istrative expenses and right -of -way acquisition. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, AS FOLLOWS: SECTION ONE: The Village of Buffalo Grove hereby elects and determines to acquire a common source of supply of water as a member of the Northwest Water Commission as it is now or may here- after be constituted. SECTION TWO: The Village of Buffalo Grove hereby declares its intention to obligate itself to bear its proportionate share of Commission development costs, which is 15.5 %, including, but not limited to, plans, feasibility reports and engineering and legal fees, and in accordance with such intention hereby obligates itself to pay immediately the specific amount of $33,333 in one lump sum as Buffalo Grove's share of certain development costs hereinafter incurred by the Commission for the aforesaid purposes. Said sums to be used only for expenses incurred by the Commission after the effective date of ordinance. Pursuant to such obligation, the Village Manager is hereby directed to cause a check in the amount of $33,333 and signed by the appropriate Village officers to be issued and delivered to the Northwest Water Commission. -2- ``.. SECTION THREE: Also pursuant to the aforesaid obligation, and in the exercise of its home rule powers and its powers and authority under the Intergovernmental Cooperation provisions of Article VII, Section 10 of the 1970 Illinois Constitution and the Illinois Intergovernmental Corporation Act (Ill. Rev. Stat, ch. 127, s741 et seq.), the Village of Buffalo Grove hereby obligates itself to pay the specific amount of $1,035,400.00 on or about May 1, 1981, as its proportionate share (15.50) of the interim financing necessary for additional Commission development costs, including but not limited to legal, engineering and financial con- sultant fees, administrative expenses and right -of -way acquisition costs, and as established in the Northwest ?rater Commission Financing Report prepared for the Commission by Duff and Phelps, Speer & Co. and dated January, 1981, (hereinafter referred to as the "Financial Report); including Buffalo Grove supplement as Exhibit A., provided, however, that such obligation shall be contingent upon the obligations of the Villages of Arlington Heights, Palatine and Wheeling to pay, on or about April 1, 1981, their proportionate shares as established by said Financial Report. SECTTON FOUR: The Village President is hereby authorized and directed to appoint a person meeting the qualifications set forth in Ill. Rev. Stat. ch, 24, s11-135 -2 to serve as the commissioner representing the Village of Buffalo Grove immediately upon approval and ratification of the addition of Buffalo Grove to the Commission's membership as provided in Ill, Rev, Stat. ch, 24, s11- 135 -3. SECTION FIVE: If for any reason the Village of Buffalo Grove is found not to be a member of Northwest Water Commission, said Commission will return any monies paid pursuant to Section Three of this Ordinance. By the Commission approving of Buffalo Grove's membership pursuant to this ordinance the Commission hereby ob- ligates itself under this section.
