ORDINANCE AUTHORIZING AN OBLIGATION TO THE NORTHWEST
WATER COMMISSION FOR A PROPORTIONATE SHARE OF DEVELOP -
MENT COSTS _
WHEREAS, the Village of Buffalo Grove (the "Village ") is a
member of the Northwest Water Commission (the "Commission ");.and
WHEREAS, the Commission is currently engaged in its project
to procure and establish a common source of supply of Lake Michigan
water for the Village and other Commission members and customers (the
"project "); and
WHEREAS, in connection with said project, the Commission has
incurred and will further incur development costs including, but not
limited to, plans, feasibility studies, legal, engineering and financial
consultant fees, administrative expenses and property and right -of -way
acquisition; and
WHEREAS, the "Northwest Water Commission Financing Report"
prepared for the Commission by Duff and Phelps, Speer & Co. and dated
January, 1981 (the "Financial Plan ") calls for each Commission member
municipality to advance to the Commission a proportionate share of the
funds required for interim development costs of the Commission's project;
and
WHEREAS, the Village President and Board of Trustees have
determined it to be in the best interest of the Village to participate
in the Commission's project in accordance with the Financial Plan; and
WHEREAS, the Village and the Commission have entered into the
"Northwest Water Commission Water Supply Contract for the Village of
Buffalo Grove," dated April 6, 1981 (the "Contract "), which Contract
provides for, inter alia, an advance by the Village to the Commission
in the amount of $1,035,400 (one million thirty -five thousand four
hundred dollars); and

WHEREAS, 111. Rev. Stat. ch. 24, p11 -135-1 (1979) authorizes
the Village to obligate itself for a proportionate share of the Commission's
development costs and provides that no prior appropriation shall be required
to incur such an obligation; and
WHEREAS, pursuant to such authority and in the exercise of its
home rule powers and its powers and authority under the Intergovernmental
Cooperation provisions of Article VII, Section 10 of the 1970 Illinois
Constitution and the Illinois Intergovernmental Cooperation Act (111. Rev.
Stat. ch. 127, p741 et sej., the Village President and Board of Trustees
have determined to obligate the Village for its proportionate share of
the Commission's development costs in accordance with the Financial Plan
and as more specifically hereinafter set forth; and
WHEREAS, the Village will have available sufficient funds to pay
the amount hereinafter provided for.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of
Trustees of the Village of Buffalo Grove, Cook and Lake Counties, Illinois,
as follows:
SECTION ONE: Pursuant to Ill. Rev. Stat. Ch. 24, P11 -135-1 and
in the exercise of its home rule powers and its powers and authority
under the Intergovernmental Cooperation provisions of Article VII, Section 10
of the 1970 Illinois Constitution and the Illinois Intergovernmental
Cooperation Act (111. Rev. Stat. ch. 127, p741 et seq., the Village of
Buffalo Grove is hereby obligated to bear the specific amount of $1,035,400
(one million thirty -five thousand four hundred dollars) in one lump sum,
as its said proportionate share of Commission interim development costs
including, but not limited to, plans, feasibility studies, legal, engineering
and financial consultant fees, administrative expenses and property and
right -of -way acquisition. Pursuant to such obligation, the Village Manager
is hereby authorized and directed to cause said amount to be transferred
to the Commission in accordance with the terms of the Contract.

SECTION TWO: This Ordinance shall be in full force and effect
from and after its passage and approval in the manner .provided by law.
