1980-013• 0 ORDINANCE NO.80 -13 AN ORDINANCE HOLDING THE COUNTY OF COOK HARMLESS FOR THE OPERATION AND MAINTENANCE OF CERTAIN STRUCTURES WITHIN COOK COUNTY RIGHT -OF -WAYS WHEREAS, the Village of Buffalo Grove, Lake and Cook Counties, Illi- nois, hereinafter referred to as "Village ", deems it desirable and ne- cessary to construct fire hydrants, fences, install street lights, plant trees, construct bus shelters and other improvements within Cook County Right -of -Ways with Village limits; and NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT and BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, LAKE and COOK COUNTIES, ILLINOIS: SECTION 1. The Village shall indemnify, keep and save harmless the County ,ts`agents, officials and employees, against all injuries, deaths, loss,damages, patent claims, suits, claims, judgments, costs and expenses, liabilities, which may in anywise accrue against the County, in consequence of the granting of permit for structures to be owned, operated and maintained by the Village, or which may in anywise result therefrom, whether or not it shall be alleged or determined that the act was caused through negligence or omission of the Village or its employees, of the subcontractor or his employees, if any, and the Village shall at its own expense, appear, defend and pay all charges of attorneys and all costs and other expenses arising therefrom or incurred in connec- tion therewith. The Village expressly understands and agrees that any per- formance bond or insurance protection required by permit, or otherwise provided by the Village, shall in no way limit the responsibility to indemnify, keep and save harmless and defend the County. In defending the County, the Village may utilize any defenses which are available to itself as an indemnifier or to the County as a governmental body possessing various partial or complete immunities. SECTION 2. This Ordinance shall not be cancelled or changed without 30 ays wr tten notice by registered mail to Mr. Richard H. Golterman, Cook County Superintendent of Highways, 118 North Clark Street, Chicago, Illinois, 60602. SECTION 3. If this Ordinance is terminated, it will be cause for im- mediate termination and cancellation of all pending or unexpired permits. SECTION 4.
