THEFT ORDINANCE
WHEREAS, Section 11 -1 -1 of the Illinois Municipal Code as amended
expressly grants to the corporate authorities of each municipality the
power to pass and enforce all necessary police ordinances; and
WHEREAS, the public health, safety, welfare and moral's in this
municipality will be served by providing ordinance protection against
theft, pursuant to the aforesaid enabling legislation and the police
power of the Village; and
WHEREAS, it is the intent of the Village to legislate against
misdemeanor theft in Buffalo Grove.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS:
SECTION l: Amendment to Chapter 9.52 of Buffalo Grove Municipal Code
There is hereby added to the Municipal Code of the Village of Buffalo
Grove, Illinois, the following Chapter 9.52 - Theft which is to read as follows:
Chapter 9.52
Theft
SECTION 9.52.010 - General Prohibitation
It shall be unlawful for any person, firm or corporation to commit a
theft within this municipality upon either public or private property.
SECTION 9.52.020 - Designated Acts
A person commits theft when he knowingly:
A) obtains or exerts unauthorized control over property of the owner; or
B) obtains by deception control over property of the owner; or
C) obtains by threat control over property of the owner; or
D) obtains control over stolen property knowing the property to have
been stolen by another, or under such circumstances as would reasonably
induce them to believe that the property was stolen; and
1. intends to deprice the owner permanently of the use or benefit of
the property; or
2. knowingly uses, conceals or abandons the property in such manner
to deprive such owner permanently of such use or benefit; or
3. uses, conceals or abandons the property knowing that such use,
concealment or abandonment probably will deprive the owner
permanently of such use or benefit.

SECTION 9.52.040 - Violation - Penalty
Any person violating the provisions of this chapter shall
be punished as provided in Section 1.08.010.
SECTION 2: Effective Date
This Ordinance shall become effective upon its passage, approval
and publicatiz)n. This ordinance may be published in pamphlet form.
